Authorizing development in Dare County adjacent Croatan Sound, off NC 345, in
Skyco Community , as requested in the permittee's application dated 10/23/17, including
the attached workplan drawings (2) Drawing 1 of 2 dated 8/11/17 and Side View dated 8/21/17.
This permit, issued on February 7, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.

1) The alignment of the authorized offshore sills shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start
of construction.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

2) The offshore sill material shall consist of clean oyster shell, rock or masonry materials such as, but not
limited to, granite, marl, or broken concrete. Sill materials shall be of a size sufficient and design to
prevent its movement from the approved alignment by wave or current action. If directed by the
Division of Coastal -Management, -the- permittee shall be responsible for removal- of any materials or -- _-
debris that becomes dislodged or moves outside the authorized alignment.
3) The offshore sills authorized under this permit modification shall be allowed only in waters that average
less than four feet in depth along the proposed alignment as measured from the normal water level
contour.
4) The height of the permitted offshore sill shall not exceed six inches above the normal water level.
5) The offshore sill openings and overlap sections as depicted in the approved workplan drawings.
6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
7) This Major Modification shall be attached to the original Permit No. 24-08, which was transferred on
12/8/10, as well as all subsequent renewals, refinements, and modifications, and copies of all documents
must be readily available on site when Division personnel inspect the project for compliance.
8) All conditions and stipulations of the active permit remain in force, under this Major Modification,
unless specifically altered herein.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW -
2018 -00023 issued 2/5/18.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2017-1608.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.
