PROJECT SUMMARY: The applicant is proposing to construct a dock with 5 boatslips, 2 story building and additional stormwater filtration systems. J N.C. Narrative Description: The applicant previously received state permit #08-02, which authorized the removal of submerged structures located in the Trent River on 1/22/02. A Major Modification was issued for the construction of a wetlands area, bulkhead, elevated boardwalk, and a pier, that is set to expire on 12/31/2008. This application is being processed as a second Major Modification. The subject property is located at 529 South Front Street in New Bern, Craven County. The project site is found by traveling on Hwy. 70 West toward the City of New Bern and exiting at Pembroke Road. At the top of the exit, turn right onto Pembroke Road. Travel approximately 1/3 mile and turn right on Pollock Street. Travel t/z miles and turn right on Metcalf Street. Take the frist left on Front Street and the project site is immediately on the right. The subject property is 1 lot totaling 5.7 acres. The parcel presently contains a stormwater control structure in the form of retention ponds that were permitted under Major Permit # 8- 02, as well as a bulkhead armoring the shoreline. The parcel is approximately 3.5' above Normal Water Level and there are thin patches of coastal wetlands immediately waterward of the existing bulkhead. The waterbody is approximately 1500' across at this location and the property has approximately 645' of shoreline. Upstream from the project location is the NC Railroad and the surrounding area consists of mixed residential and commercial uses. The Sheraton Grande Marina is located approximately 350' downstream and there are community piers with no dockage constructed by the City of New Bern approximately 1000' upstream. Water depths at this location range from --4' to -6' NWL. The Division of Water Quality classifies this area as SC-NSW waters. This area is not a Primary Nursery Area. This portion of the Trent River is closed to the taking of shellfish and no visible shellfish were observed. The City of New Bern Land Use Plan classifies this area as Developed, and Conservation within the AEC's. 10. Project Description: The applicant is the NC Dept. of Cultural Resources. The proposal is for the construction of a History Education Center to serve the public. Water dependent and non-water dependent amenities are proposed. On the highground, the applicant is proposing to construct (6) bioretention areas surrounded with pourous paving stones for parking. The bioretention areas are located on the east side of the project site from South Front Street to the buffer. The pourous paving stones will provide parking for 61 vehicles. There will be additional parking for 25 vehicles on the asphalt surface surrounding the bioretention area. The additional parking would be located to the east of the bioretention ponds and adjacent to the southern most bioretention pond. Intersecting the bioretention/parking area would be (2) concrete sidewalks leading to concrete biking/walking area. Additionally, there is a wooden walkway proposed leading from the concrete biking/walking area to the proposed wood decking. Various sizes and configurations of concrete walking areas and patios would surround the proposed two-story Tryon Palace History Education Center. On the south side of the proposed Tryon Palace History Education Center would be pedestrian pavers with a covered rain cistern N.C. Dept. of Cultural Resources/Tryon Palace Historic Sites and Gardens Waterfront Project Page 03 to trap stormwater. The building is located approximately 250' from the NWL. The building will be 54,000 gross square feet with utilities running to South Front Street. The project was permitted under DWQ Stormwater Permit # SW7041015MOD and Sedimentation and Erosion Control Permit # Crave-2008-014. The applicant is proposing to construct wood decking and a covered pavilion immediately landward of the bulkhead. The pavilion will be 18' X 20' and located 38' landward of the NWL. There are multiple retaining walls and benches placed in various locations for landscaping around the constructed wetlands and on the boardwalk. This landscaping is figured into the overall grading and impervious surface calculaton for the project impacts. Total highground disturbance resulting from this project will be 4.45 acres. The total impervious surface resulting from this project will be 72% with 23% impervious coverage in the AEC. Below the normal water line, the applicant was originally permitted, but did not construct, a pier with a gazebo. The applicant is now proposing to construct a docking facility with 5 boat slips. The docking pier will be 69' X 12' with a 14' X 24' "L"-Head platform. A gangway is proposed connecting the platform to a 8' X 98' dock with (2) 8' X 40 finger piers and a 4.5' X 40' finger pier. The docking facility will be 83' into a waterbody that measures approximately 1500' across. Water depths at the waterward end of the structure are approximately -4 to -6'. 11. Anticipated Impacts: There will be 193,842 square feet of highground disturbance resulting from the grading of the project site. Total impervious surface for the tract would be 181,253 square feet with 57,107 square feet in the AEC. This amounts to 72% of impervious surface on the highground and 23% in the AEC. Total platform size and shading impacts from the docking facility will be 2992 square feet. This amount exceeds the allowable platform size for this shoreline by 412 square feet. It is my determination that the excess square footage requested should be allowed by rule 15A NCAC 7H .0208 (b)(6)(d) stating, "projects requiring dimensions greater than those stated in this rule shall be permitted only if greater dimensions are necessary for safe use, or to support a water dependent use that cannot otherwise occur." This clocking facility will be connected the New Bern River Walk and will provide an education center for the public and will be accessed from the highground and water. Total usurpation of public trust area for this docking facility would be 6000 square feet. Minor turbidity will occur while setting the pilings. No coastal wetlands or SAV will be impacted from this project. The wooden slatted decking does exceed the 200 square feet allowable in the Estuarine Buffer, but this project falls within the NC Division of Water Quality Neuse River Buffer and a variance will be required. Tryon Palace Historic Sites & Gardens are making improvements to the site in an effort to attract people to the downtown and historic districts of New Bern. The building and grounds will provide educational resources for Tryon Palace. The boardwalk improvement will provide waterfront access to the public, and is associated with the Riverwalk project. The fixed pier will provide recreation for the public. A floating dock will provide additional small boating access to the downtown and historic districts. The floating dock will also serve as a temporary dock for historical vessels. All features of the project are intended to provide additional access to the waterfront of New Bern. c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. The building and parking facilities are to be constructed utilizing standard construction practices. The building will be constructed with a driven pile foundation. The proposed fixed pier consists of a concrete substructure supporting a timber superstructure. Precast concrete piles will be driven by a pile-driving hammer positioned on a floating barge. The barge will use survey equipment or construction template to maintain proper alignment of the structure. The same method shall be used to drive the precast concrete guide piles for the floating dock. Once the piles have been driven as specified, cast-in- place concrete bents will be constructed. The contractor will use floating platforms or barges to access the bent locations. Concrete will delivered to the site and pumped or crane and bucket placed from the landside of the construction. The remaining timberwork is performed topside. The floating dock structure is a manufactured product that will require minimal assembly on site. The system will likely be trucked to the sight and placed in the water by crane. Decking materials and utilities installment will be performed topside. d. List all development activities you propose. The proposed development consists of one 54,000 sf building and associated parking facilities and landscaped areas. A fixed pier consisting of a concrete substructure and timber superstructure is also proposed for the site. A metal floating dock with timber decking is also proposed for the development and will be accessed via the fixed pier. e.
