Davis Dear Mr. Davis: In response to your letter of July 23, 1993 and as a follow-up to our meeting in Raleigh on July 28, 1993, please accept the following as the response of Radford Quarries of Boone, Inc. to your inquiry. 1) In response to Item 1, please note the changes on the attached maps placing all mining operations inside the proposed perimeter boundary. All buffers are indicated on the map as requested with the acreage adjusted to 16.50 acres. 2) In response to Item 2, please find the enclosed check in the amount of $750.00. 3) In response to Item 3, please find all "PY references removed and the new perimeter dike marked. As I indicated in our meeting on July 28, 1993 and as marked on the revised map, the area between the permit boundary and the river bank will be pe�rmanefitly revegetated with native species and remain undisturbed as soon -as the matter is resolved with the Town of Boone. At this time my clients are under a court order that prevents "any" activity on the area referred to in your July 23, 1993 inquiry. Further, please find enclosed the elevation study performed by Municipal Engineering for the "EDS" site located to the rear of the shop property and existing hay field which established the 100 and 500 year flood elevations indicated on the revised map. This information is consistent with the flood elevations on the enclosed FIRM map. I have also attached one (1) copy of the actual "EDS" map which I showed you on July 28, 1993. Due to the age and discoloration of this map, I was unsuccessful in being able to duplicate this information. Please retain it in your file for future reference. RANDAL Sp. A DEHNR Page 2 4) In response to Item 4, please see the enclosed letter from Al Childers with the local Soil Conservation Service. He has also completed the calculation you requested and scaled them upon the enclosed graph. You will note that he did not deem it advisable to excavate the channel you referred to in paragraph 4, therefore it is not included on the map. After further discussions with Mr. Childers regarding the topography of the property from Bamboo Road to the sediment basin creating a natural distribution of any water on that side into the existing natural ground provided in the hay field beside and behind the sediment basin, it was deemed advisable to . remove the perimeter dike in that area. The other perimeter dike did appear to be necessary to protect the integrity of the New River. 5) In response to Item 5, please see the revised map attached which adjusted the elevations consistent with the new location of the sediment basin. Further ' the map now indicates that the basin will be cleaned out on a minimum schedule of every six months or after a significant rain fall. 6) In response to Item 6, please find the attached letter from Mr. Chris Penick at Penagro, Inc. Further, the trees you have indicated are already in place and now shown on the map. 7) Your next item is numbered as 9). In response to your Item 9, please find the rock dam indicated on the revised map. At the last visit of Mr. Doug Miller to the site this area was repaired with a five (5) gallon bucket of rock. I hesitate to call it a rock dam, but since it is mentioned in your letter, I have addressed it on the map. 8) In response to your Item 10, please see the revised map attached and the note provided which places the discharge point inside the permit boundary. 9) In response to your Item 11, please see the revised diagram as we discussed in your office on July 28, 1993. This information has also been transferred to the revised map as you had requested. 10) In response to your Item 12, please see the revised map attached which you released to me at our meeting on July 28, 1993. 1 have had the Watauga County Tax Mapping Office revise the map, which contains a new note from Ms. Church regarding Castiblanco/Austin. It appears that Austin purchased a small tract from Ms. Hollar to locate a catch basin within to protect the erosion of a culvert providing drainage to Mr. Austin's residence near by. After completion of the catch basin and regrading the site, Mr. Austin sold the property to Castiblanco. Both parties have been notified of the permit DEHNR Page 3 application. The map revision by Ms. Church also reflects the buffer distances between Ms. Hollar's residence, Mr. Harmon's residence and the Watauga County Landfill property. I have also enclosed a revised page of the application to reflect these distances, since these have changed due to moving the permit boundary to meet the finished slope and safety ledge requirements. Other applicable revisions on pages of the application are also enclosed to reflect the acreage changes. 11) In response to your Item 13, please see the revised map attached which relocates the Surplus Material Storage area to a more aesthetically pleasing site. The area indicated is 75' x 100'. It will not be in the dewatering area and should pose no threat to any environmental concerns. While in Raleigh, on July 28, 1993, 1 met with representatives from the Air Quality section to review the revised permit application. They seem pleased with our revisions. That information is being resubmitted simultaneously with the return of this information to your office. I am in the process of procuring the reclamation bond you have requested. I will forward it to you under a separate cover. Thank you for your input on July 28. It was prompt completion of the items enclosed.
