Bamboo Road Quarry Mining Permit No. 95-03 Watauga County Dear Mr. and Mrs. F=?L I sincerely apologize for the delay in addressing the concerns outlined in your letter dated June 7, 1993 about the above referenced mine site. An acknowledgement letter was to have been sent to you within a few days after your letter was received, and I am responsible for its being misfiled. The Mining Act of 1971 (Act) states that a public hearing will be held if the Department finds that significant public interest exists concerning the application. It further states that the public hearing must be held within the first 60 days after the filing of the application. Your letter was received slightly over two months after we received the application.. A public hearing on this application was not held as significant public interest did not exist, as reflected by a lack of response to the notice of application. Please be advised that the application f or this site was reviewed by this section and other sections within the Department with regards to the seven denial criteria listed in the Act. Upon completion of the review, the Department issued a mining permit to Radford Quarries of Boone, Inc. on August 16, 1993 to operate the Bamboo Road Quarry in Watauga County. The concerns expressed in your letter were taken into consideration and were addressed in the permit conditions. As a new mining permit has been issued for this site, all previous violations have been addressed. The mining permit contains operating conditions requiring compliance with other permits required by the state. It also contains conditions to protect adjoining properties and the South Fork New River.
