Pete Cecile called me today and said that he needs to put together his
permit renewal paperwork in the near future. He asked if there were any
engineers in the Boone area that are knowledgeable about what we need
for permitting/renewals. Do you guys have some names and numbers that I
could give him to investigate? This would be a chance to recommend
someone you know that would do a good job on the renewal package, so
that we get a complete/thorough submittal to review. Please let me know
soon, so I can get back to the Ceciles. Thanks. TD

RENEWAL OF MINING PERMIT CHECKLIST
As provided in G.S. 74-52 of The Mining Act of 1971, a mining permit may be
renewed at any time during the 2 years prior to its expiration. The
following items are required to renew a mining permit:
1) The appropriate mining permit renewal processing fee must be
submitted to this office (see attached fee schedule).

2) The permittee must complete a new mining permit application form
(copy attached) except for the Notification of -Adjoining
Landowners section. The renewal can only be for the acreage
covered by the existing permit document. If any additional
acreage is to be affected by mining, a modification request (and
corresponding fee) must accompany the renewal request.
3) A letter must be submitted to-this--DepArtment by the permittee
requesting renewal of the mining permit for a period not to
exceed 10 years and must clearly address how the continued
operation will not invoke any of the 7 denial criteria listed
under G.S. 74-51 of the Act. This letter must also describe any
expected changes in the operation of the mine and must state
whether additional land is to be added or affected by mining at
this site. Additional acreage to be added to this permit
(affected or unaffected) shall require a modification request and
the appropriate modification processing fee. New disturbances
within the permitted area requiring new sediment andlor erosion
control measures will also require a major modification.
-4) An updated mine map must be submitted for the site delineating
the sizes and locations of all existing and proposed features of
the mining operation, including sediment and erosion control
measures. Typical construction details must be submitted for
each sediment and erosion control measure, existing or proposed.

fee. in addition, the mine map must locate all new.adjoining
landowners, indicatesediment and erosion control measures for
the new acreage, and*address all of the items listed under
Section B. Maps in the application form. Please note that you
will be required to.comple-fe-the' not1fic-a-t-ton-s-ection of the
application if you are adding land to the 'permit. Lastly, any
Oroposed sediment and erosion control measures must be
accompanied by supporting design calculations.
The original of the following item is required:
5) The performance (reclamation) bond must be evaluated to assure it
is sufficient to cover the proposed activity for the renewal
period.
All mining permits for unreclaimed sites must be renewed. If your mine ' site
is inactive and reclaimed, Please contact the Land Ouality Section for more
information.
