Hi Dalton,
I have received the information that you submitted to the Division on January 11, 2018. The submittal is considered a
partial response to our letter dated December 8, 2017 and therefore the application will be considered incomplete and
remain on hold until Item #2 of our letter has been addressed.
With regards to Item #1, the Division acknowledges that you have revised the project and have identified the limits of
buffer disturbance to be within Zone 2 only. However it shows that the grading will be conducted at the Zone 2/Zone 1
boundary line and it is unclear whether any impacts to Zone 1 will need to occur for the purposes of construction access
or sediment/erosion control. While such impacts may not necessitate a Major Variance, they must be identified and
quantified and may require a buffer authorization from the Division. The impacts to Zone 2 as proposed will require a
Minor Variance, and a variance application must be submitted to the Division.
Please note that a complete technical review of the project will not be completed until Item #2 in our December 8, 2017
letter has been addressed and the Division may require additional information upon a complete technical review of the
project.
