I was hoping to clear up some potential confusion on one of the comments we received from the Town in regards to the Goose Creek Buffer widths. It was our understanding from reviewing the Town of Stallings Ordinance (Section 52.39) as well as the NCDEQ regulations (https://deg.nc.gov/riparian-buffers-frequently- asked-questions ) that only streams that are shown on the quadrangle topographic maps prepared by the United States Geologic Survey or the most recent soil survey prepared by the Natural Resources Conservation Service department are subject to the 100 buffer width requirement. The attached pdf is an exhibit prepared by Len Rindner of Wetlands and Environment Planning Group that depicts the results of a field meeting with NCDENR on 6/29/17 where stream classifications along with buffer widths were discussed and agreed upon. Specifically, I would like to draw your attention to RPW D as being not subject to Goose Creek Buffer rules and thus not needing a 100' buffer. Based on this field visit and the approved rezoning we have been operating under the premise that his RPW was subject to only a 50' buffer. Obviously, we are very concerned if this was not the case as it would have a very negative impact on the current site plan. Our hope is that we can all resolve this issue quickly so we can move forward with addressing the remaining comments.
