This correspondence is in reference to the Forrest Creek Mitigation Bank located
approximately seven miles northeast of Hillsborough and six miles northeast of Durham in
northeastern Orange County, North Carolina. The purpose of this letter is to confirm the year
credit release as requested in your letter of February 5th, 2009.
As shown in your amended Mitigation Banking Instrument the credit release schedule allows
for a 10% release of credits from the total of 7,040 restoration and enhancement credits.
However, the as-built drawings adjusted the total slightly showing a total of 7,072 credits from
restoration and 601 from preservation. This adjustment allows for a release of 707 restoration
and enhancement credits, as well as an additional 10 restoration and enhancement credits and 1
preservation credit to make up for the difference between the plans and the as-built reports. By
copy of this correspondence, we confirm that you have satisfied the above requirements and that
a total of 718 credits are now available for sale.
