We subsequently received two separate responses from your office, dated December 22, 2008 and January 5, 2009, requesting additional information about this project. Please note that we requested an extension to the 30-day response deadline prior to this submittal. The requested information is provided below and in the attachments included with this letter. The following additional information was requested in your letter of December 22, 2008: This office believes that the skimmer basin labeled on the plans at Site I can be moved or reconfigured to avoid the impacts to the wetland. Please revise the plans to minimize the impacts. The wetland area proposed to be impacted by the skimmer basin shown in the plans is located within both the permanent right of way and the construction easement for the project. The possibility of relocating the skimmer basin was evaluated, and it was determined that even if the basin was relocated out of the wetland, this area would still be disturbed during construction of the project due to the proximity of the wetland to the road. It is also worth noting that the original alignment of Judd Parkway was curved to the south to minimize impacts to wetlands as much as possible. The area proposed to be impacted by the basin totals approximately 118 square feet in size. If it were possible to work around this tip of wetlands, additional easement area would have to be obtained to relocate the skimmer basins. This would also result in a small patch of wetlands being cut off from the remaining wetlands located downstream across the road and from its hydrology source, causing the avoided wetlands to eventually convert to an upland area. Due to these considerations, we do not believe that it is possible to avoid impacts to this wetland. 2. This office believes that the rip-rap pad and pipe outlet channel labeled on the plans at Site 2 can be moved or reconfigured to minimize the impacts to the wetlands. Please revise the plans to minimize the impacts. The plans have been modified to avoid this impact. The pipe and outlet structure have been moved to the east, and are now located outside the wetland area. Five sets of revised plans (8 'h" X 11") showing this change are included with Attachment A. Please note that the plans include a table that reflects the updated impact totals. The total wetland impact has been reduced from 0.70 acre to 0.68 acre. Impacts to isolated wetlands remain the same (0.22 acre). The following additional information was requested in your letter of January 5, 2009: Per the requirements of the Neuse River Riparian Buffer Rule, you must show that this site meets diffuse flow requirements with a level spreader or other BMP per Chapter 8 of the BMP Manual. Level spreader calculations are included in Attachment B to demonstrate that the site meets the requirements per Chapter 8 of the BMP Manual. Full sized plan sheets that show the detail for the level spreader are also included. 2. Please submit a Level Spreader Supplement Form with all required items for each proposed level spreader. The requested Level Spreader Supplement Form is included in Attachment B. Thank you for agreeing to allow additional time beyond the 30-day response window to gather the requested information. This maintenance record will be kept in a log in a known set location. Any deficient BMP elements noted in the inspection will be corrected, repaired or replaced immediately. These deficiencies can affect the integrity of structures, safety of the public, and the removal efficiency of the BMP. Important maintenance procedures: - Immediately after the filter strip is established, any newly planted vegetation will be watered twice weekly if needed until the plants become established (commonly six weeks). - Once a year, the filter strip will be reseeded to maintain a dense growth of vegetation - Stable groundcover will be maintained in the drainage area to reduce the sediment load to the vegetation. - Two to three times a year, grass filter strips will be mowed and the clippings harvested to promote the growth of thick vegetation with optimum pollutant removal efficiency. Turf grass should not be cut shorter than 3 to 5 inches and may be allowed to grow as tall as 12 inches depending on aesthetic requirements (NIPC,1993).
