PROJECT SUMMARY: This project is being proposed as a major modification to Major Permit 214-06. The applicant proposes to add a pier extension and platform to the existing pier previously authorized. Narrative Description The Town of Morehead City Newport River Pier Extension project is located on Radio Island along Highway 70 within the Newport River and north of the existing high rise bridge. The tract is bordered by a spoil island owned and used by the NC Ports Authority to the east and the DOT Bridge right-of-way to the south. The Town of Morehead property is 181,645 square feet in its entirety and is an average of 0' to 13' above NHW. Presently there is an existing pier, bulkhead, riprap, boardwalk, restroom and parking lot on this tract. Small fringes of coastal marsh are located north and south along the shoreline of the proposed work however will not be affected. They mostly consist of Spartina alterniflora. The undeveloped portion of remaining high ground is comprised mostly of jurisdictional wetlands, cedars and scrub bushes. The developed portion of the high ground contains a rest room facility, parking lot, boardwalk and paved access road. The existing development is a public project. The Morehead City Land Use Plan classifies this property as Port Mixed Use, with all AEC's classified Conservation. This section of the Newport River is not designated as Primary Nursery Area and is closed to the taking of shellfish. The Newport River carries a water classification of SC. Riparian corridors were determined through the original permit # 214-06 and shall pertain to the newest proposal and meet all required setbacks. Substrate in the Newport River is mostly sand and silt. No SAV's or shellfish beds were observed within the proposal project area. 10. Proiect Description: The existing major permit # 214-06, which was issued on December 20, 2006, authorized the public fishing pier replacement, expansion and shoreline stabilization with riprap. The applicant's current proposal is to add a 100' extension to the existing pier with a 15' x 30't-platform. The pier width would be 16' with the extension length at 100'. Per the applicants, the 16' width is needed for handicap access, safety and public access. The total length of the shoreline is 435'. The new pier would start at the end of the existing pier and extend waterward for 100' with a 15' 30' platform. The waterward edge of the proposed platform would be located a distance of 1,552 feet from the centerline of the existing channel with final water depths of an average of -7.82'. The pier is strictly for fishing and not for boating use. The width of the Newport River in this area is 2,300 feet. The proposed pier extension with platform would make the total length from NHW 420'. 11. Anticipated Impacts: The proposed pier extension and platform would shade and incorporate 2,050 ftz of open waters. The setting of pilings would cause temporary turbidity. There would be no hindrance to navigation. The width of the pier would be greater than six feet however per Field Investigation Report: Town of Morehead City Page 03 711.0208 (6) (A) could be permitted if the greater width is necessary for safety or to improve public use access. The applicants state that this is the case. The total pier length which includes the platform would be at 420'. Rules 7H.0208(6)(k) does allow for lengths past 400' if this would give access to deeper water for a rate of 1' per 100'. This project would add additional public access and better fishing access. This is the case as shown on the plat dated received 12/29/09 and through field verification. The proposal is for the extension of an existing pier for public use. The applicants propose an extension 100' in length and 16' wide. The width of the pier would be greater than six feet, however per 7H.0208 (6) (A) could be permitted if the greater width is necessary for safety or to improve public use access. Per the applicant this is necessary. The DCM district agrees with this assessment because of the large volume of the existing user group. The total pier length, which includes the platform, would be 420' From the NHW. This includes the existing portions as well as the proposed extension. According to Rule 7H.0208 (6) (k) the CRC would allow for lengths past 400' if this would give access to deeper water for a rate of l' per 100'. This is the case as shown on the plat dated received 12/29/09 and through field verification. Therefore I recommend the project be authorized as proposed on plats dated received December 29, 2008, contingent upon the following specific conditions and all applicable standard conditions: 1. The authorized structure and associated activity must not cause an unacceptable interference with navigation. 2. Recommend handrails for the proposed extension (not for boating use). The plans propose the pier to be extended along the same line as the existing pier. It is proposed that the pier have a width of 16 LF for the length of the 100 LF extension in consideration of handicap access, safety, and public access. At the end of the 100 LF extension a 30 LF x 15 LF tee is proposed to allow additional people access to the more desirable fishing areas. The site of the project is on the north side of US 70 immediately east of Morehead City - Beaufort high-rise bridge over the Newport River. The site is owned by the State and leased to the Town.
