8. PROJECT SUMMARY: The applicant proposes to replace a remnant wooden
bulkhead with a new vinyl bulkhead, construct an off-shore riprap sill to protect a 404
wetland shoreline, install a boatramp, and construct a pier & platform with a boatlift
and mooring piles.
Proiect Setting
The site of the proposed development is a located on Bay Point at 329 Whites Neck Lane, off
of SR 1390 on Knotts Island, Currituck County adjacent to Knotts Island Bay and the Currituck
Sound. The property has approximately 1,750' of shoreline on the north and east side and is
bordered on the south and west side by a single parcel of land.
The tract is 16 acres in size and contains approximately 5 acres of USACE 404 and coastal
wetlands located in the northwest corner and eastern side of the property. The remaining
area is further divided into approximately 8 acres of agricultural fields and 3 acres of cleared
uplands along the northern shoreline. The portion of the tract that the proposed
development will take place in is within the cleared upland area and an adjacent section of
404-wetlands. The upland area is flat, has an elevation of approximately 2.5 ft above
normal water level (NWL), has sandy soils and is vegetated with loblolly pines (Pious
taeda), live oaks (Quercus virginiana) and mowed yard grasses. Man-made structures
include a gravel road, a single-family residence, a barn, sheds, a bulkheaded canal with a
boathouse that has filled in and a bridge over the canal. The adjacent property to the west
and south is largely undeveloped with USACE 404-wetlands and agricultural fields with no
man-made structures. Based on available information, there appears to be no
archaeological sites on this property, however, site # CK24 is located approximately 1.4
miles to the southwest.
The shoreline within the development area is approximately 650' long. A remnant 497'
bulkhead that has fallen into disrepair exists along this shoreline. Due to storms and age, it has
been washed out in several places causing erosion to occur landward of the bulkhead along its
entire length. The bulkhead now averages 12.8' waterward of the current NWL with a maximum
distance of 30'. A 1 ft erosion escarpment exists at NWL. Approximately 135' of shoreline
exists to the west of the remnant bulkhead that borders USACE 404-wetlands and a portion of
coastal wetlands along the property boundary. Coastal wetlands species identified within this
area include giant cordgrass (Spartina cynosuroides), black needlerush (Juncus reomerianus)
and cattails (Typha spp.).
The waters of the Currituck Sound in this area are classified as SC and are closed to shellfish
taking. There is approximately 1 mile of open water to the east of the project site and 2 miles of
open water to the north of the project site. Water depths with the project site range from NWL
to -2.5' and the bottom substrate within this area is made up of fine sands. Due to high water
turbidity within the project site, no Submerged Aquatic Vegetation was observed, however, it
was observed floating within the water column.

Previous permits issued for development on this property include CAMA Major Permit #174-78
issued in 1978 for maintenance excavation within the canal, USACE general permits
SAWC078-N-027-000406 issued in 1978 for maintenance excavation within the canal and
SAWC078-N-025-0080 issued in 1982 for the replacement of a bulkhead, and CAMA General
Permit A176 issued in 1985 for repair work to an existing pier and bulkhead.
Development Proposal
In order to prevent further erosion, the applicant proposes to construct a bulkhead at the
approximate location of the remnant bulkhead. The bulkhead will be run in a straight alignment
for 477'. Approximately 307will be constructed 2 ft waterward of the existing remains and the
remaining 170' will be constructed landward of the existing structure to keep the alignment
straight. The return wall on the east side of the proposed bulkhead will turn back into the
property for 29' where it will tie into an existing bulkhead of a canal that has filled in. The return
wall on the west side of the proposed bulkhead will turn back into the property and run for 48'
along the existing return walls alignment into the upland area. The bulkhead will average
approximately 12.5' waterward of the existing NWL and will have a maximum distance of 27'
from NWL.
The applicant then proposes to construct an offshore riprap sill to protect a shoreline that
borders USACE 404 wetlands and an area of coastal wetlands. The riprap sill will tie into the
western return wall of the proposed bulkhead. The sill will begin 25' landward from the
bulkhead corner and run in a straight alignment for 99' and then turn back towards shore and
run for approximately 11' to the shoreline where it will end. The landward toe of the sill ranges
from 8' to 22' from NWL and the base will be 4 ft wide.
In order to provide water access, the applicant proposes to construct an 84'x 6' long pier that
will end with a 24'x 16' open platform with built in benches. A 13'x 13' boatlift is proposed on
the western side of the platform and two mooring piles are proposed on the eastern side of the
platform to provide a second slip. The mooring piles will be placed 16' out from the platform
and will be 13' apart.
In order to provide boat access, the applicant proposes to construct a 35' x 15' boat ramp at the
base of the pier on the eastern side. The applicant proposes two possible designs that both
have identical footprints of 20' x 15' waterward of NWL. The first design will have a vinyl
bulkhead built on the east and west side of the ramp extending out from the bulkhead 20'
where a temporary cofferdam will be constructed to keep water out of the ramp area during
construction. The enclosed area will be backfilled and capped with concrete to create an angle
that will be even with the top of the bulkhead. The concrete ramp will extend landward of the
bulkhead for 15'. The second design would be a pile supported timber frame ramp with a
slotted-board deck and a 15' timber apron extending landward from the bulkhead.
Anticipated Impacts
• The construction of the bulkhead along the proposed alignment will result in the filling of
approximately 5,600 SF of Estuarine Waters and Public Trust Area AEC's with clean fill from
an upland source.

• The construction of the riprap sill along the proposed alignment will result in the filling of
approximately 482 SF of Estuarine Waters and Public Trust Area AEC's.
• The placement of the pier and platform will result in the shading of 888 SF of shallow water
habitat within the Estuarine Waters and Public Trust Area AEC's.
• The proposed concrete boat ramp will result in the filling of 300 SF of shallow water habitat
within the Estuarine Waters and Public Trust Area AEC's.
• The proposed concrete boat ramp will result in 225 SF of impervious surface within the
Estuarine Shoreline AEC.
• The alternative wooden boat ramp will result in the shading of 300 SF of shallow water
habitat within the Estuarine Waters and Public Trust Area AEC's.

Location: 329 Whites Neck Lane. The property is located at the extreme south east
portion of Knotts Island, NC. It faces Knotts Island Bay/Back Bay to the north and the
channel that separates Knotts Island Bay from Cuzrituck Sound to the east (see location
map).
Overview: This project includes the repair/replacement of an existing bulkhead, building
a boat ramp and re-building a pier where one previously stood. It also includes placing a
rip-rap sill along approximately 100 feet of unprotected shoreline at the west end of the
property. A major permit is being sought as the bulkhead is longer than 500 feet, and
some portions of the bulkhead are washed out greater than 5 feet. The proposed 100' pier
is to replace one has been gone now for several years.
We recently inherited this property from my father-in-law Joe Burt. Due to his declining
health, the property has not been kept up and our goal is to restore it to its previous
splendor. The house looks out over Knotts Island Bay across a grass yard that extends to
the water's edge. The bulkhead has been in need of repair for some time with loss of
back fill along its length but Tropical storm Ernesto caused three breaches in the
bulkhead and the erosion in these locations has been at a very rapid rate. This storm
flooded the house and extensive repairs were required. As this was Joe Burt's residence,
this took precedence over repairing the bulkhead and then with his rapid decline in health
and subsequent death we could not address the bulkhead repairs until now.
Replacement of bulkhead in front of house
There has been a bulkhead here for decades. The current bulkhead is in severe disrepair
and is washed out to various degrees along its entire length. It is a long straight bulkhead
477 feet in length with a turn back on the west end and continuing into the canal on the
east end. We propose constructing a new vinyl bulkhead immediately in front of the
existing bulkhead, except in one area where it will cross behind the old bulkhead. In the
area with the greatest amount of erosion, the new bulkhead will pass landward of the old
bulkhead to reduce the amount of backfill and produce straighter line between the east
and west bulkhead returns. The current bulkhead still retains soil along the majority of its
length. The water depth in front of the bulkhead is on average 12-18" deeper than
immediately behind the bulkhead. (see cross section). The waterline varies behind the
bulkhead. For the majority of the length of the bulkhead the waterline varies from zero to
four feet, however there are three sections where it is more and one severely eroded area

maintenance excavation in an existing canal located off Currituck Sound
and Knotts Islands Bay, Knotts Island, Currituck County, North Carolina.
You should acknowledge that you accept the terms and conditions of the
attached permit by signing each copy in the space provided ("Permittee"
on page 4). All pages of both copies of the signed permit should then
be returned to this office for final authorization. For your convenience,
a self-addressed envelope is inclosed.
Title 33, Part 209, of the Code of Federal Regulations reads in part
that "A $10.00 fee will be charged for permit applications when the work
is noncommercial in nature and provides personal benefits that have no
connection with a commercial enterprise..." and "A fee of $100.00 will
be charged for permit applications when the planned or ultimate purpose
of the project is commercial or industrial in nature and is in support
of operations that charge for the production, distribution, or sale of
goods or services." As your application fits the former category, you
are requested to remit your check for $10.00 made payable to the Treasurer
of the United States. The check should accompany the signed copies of

Reference your recent telephone conversation with Mr. Steven Lund of my staff
regarding your proposed replacement of approximately 325 linear feet of
deteriorating bulkhead at your property known as Bay Point Farms adjacent to
Knotts Island Bay at Knotts Island, Currituck County, North Carolina.
Construction and backfill of a new bulkhead at an alignment not exceeding 2 feet
waterward of the existing bulkhead is authorized under Department of the Army
general permit SAWC078-N-025-0080 (copy inclosed). This general permit is
applicable only along shorelines void of wetland vegetation such as marsh grass
and wooded swamp or where all construction is to be accomplished landward of
such vegetation.
If, after reviewing the general and special conditions of this general permit
you find that it does not meet your needs, please contact Mr. Lund at telephone

o. This general permit will not be applicable to proposed construction when the District Engineer believes
that authorization may be warranted but that the proposed activity might significantly affect the quality of the
human environment.
P- This general permit will not be applicable to proposed construction when the District Engineer determines
after any necessary Investigations that the proposed activity would adversely affect areas which possess
historic, cultural, scenic, conservation, or recreational values. Application of this exemption applies to:
(1) Rivers named in Section 3 of the Wild and Scenic Rivers Act (15 U.S.C. 1273), those proposed for
inclusion as provided by Sections 4 and 5 of the Act, and wild, scenic, and recreational rivers established by
State and local entities.
(2) Historic, cultural, or archeological sites listed in or eligible for Inclusion in the National
Register of Historic Places as defined in the National Historic Preservation Act of 1966 and its codified
regulations and in the National Historic Preservation Amendments Act of 1980.
(3) Sites included in or determined eligible for listing in the National Registry of Natural Landmarks.
(4) Endangered or threatened species or habitat of such species as determined by the Secretaries of the
Interior or Commerce and conserved in accordance with the Endangered Species Act (16 U.S.C. 1531).
q. At his discretion, the District Engineer may determine that this general permit will not be applicable to
a specific construction proposal. In such case, the procedure for processing an individual permit in accordance
with 33 CFR 325 will be available.
r. Any construction of a proposed bulkhead and backfiII which does not comply with the general permit, must
have prior approval under the customary permit regulations administered by the Corps of Engineers and as found in
CFR 320-329.
II. Special Conditions
a. This general permit does not eliminate the need to obtain any other required Federal, State, or local
authorization.
b. This general permit only applies to work along shorelines which are experiencing erosion due to water
and/or wave action.

d. Bulkhead with backfilI and placement of riprap material authorized by this general permit will be
limited to a maximum shoreline length of 500 feet.
e. Bulkhead and riprap material authorized by this general permit must be positioned to extend an average
distance of not more than 2 feet waterward of the mean high water (MHW) elevation contour (distance relative to
the average water line (AWL) in nontidal areas.
f. This general permit does not authorize bulkhead with backfiil or riprap material that extend further
waterward than 5 feet from the MHW elevation contour at any point along its alignment (distance relative to the
average water line (AWL) in nontidal areas).
