This is a preexisting condition noted and photographed in our diaries before we started moving dirt. The dirt is being excavated from a bank near station 19+00 (Rt.) by Gary Jones, one of the local property owners. He then hauled the dirt to this "low bank" area to level things up. I'm told he's done this in other areas along the creek including in front of his house but that area has already revegetated. He's also known for scraping up gravel off our road for his own personal use. This area is on private property beyond our construction limits. We don't have a reclamation plan for this area and would never approve a waste pit within 50' of a stream anyway. I suspect that we have nothing to do with this but it's possible our contractor did something stupid or allowed the property owner to take some dirt on his own. It could also be a preexisting condition. I'll have the District Office investigate further just to be sure. As our application indicates, we will be replacing 2 wet pipes carrying small UTs to Cobb Creek. Cobb Creek does not cross the DOT maintained portion of this road so the 5 perched pipes mentioned below must be on private property. If they were ours, we would certainly attempt to address the perching problem, provided that if didn't result in pipe slopes that fish couldn't navigate anyway. Sorry! Nevertheless, like you said, if we don't speak up, we can't complain about the poor condition of the landscape. So, here's one Scott, Jake and I saw yesterday while evaluating some culverts on Cobb Creek. Location: 36.272090, -81.684360. FYI — this stream has 5 perched culverts in about 600 m and as a result, the BKT population is about to blink out. Anyway, it appears to be DOT work. Do you know if they have a permitted project ongoing here? Notice the paved road with seeded banks in the top picture. Online it shows it as being a state-maintained secondary route, Chestnut Grove Rd. Down from here it's washed out gravel. The ideal situation would be for them to replace the culverts during road construction but that's probably wishful thinking. The picture quality isn't great, but there was a spoil pile with no containment effort being made. This is odd because on the other side of the road there's silt fencing, small retention basins and coir logs in place. As Scott pointed out, it looks like some of the dirt that isn't bare has been pushed into the stream channel.
