Dear Ms. Bylow:
On January 30, 2018, the Division of Water Resources (DWR) received documentation from
Restoration Systems, LLC (RS) that the subject site had been constructed in its entirety and
monitoring plots had been installed. On February 1, 2018, Ms. Merritt, with assistance from
Raymond Holz and Worth Creech with RS, inspected the site and confirmed that all the subject
site had been completely planted, all monitoring plots were installed, all pipes removed and
matting installed, all poultry barns and impervious surfaces removed within the easement
boundary and cattle exclusion fencing had been installed. There was only one small area along
UT -2 near the northern -most easement boundary, where RS needs to add supplemental plantings
to ensure Zone 1 of the Neuse Riparian Buffer is planted including its tops of banks. A copy of
the map prepared by RS showing this area is attached to this letter for reference.
Additionally, the current performance bond (#22BSBHC3723) to cover performance obligations
for the construction of the subject site, is with The Hartford Fire Insurance Company and expires
upon the approval of the As -Built Report by the DWR.
In accordance with the MBI, signed on July 7, 2017, the following Project Milestones have been
met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements
for the above -referenced tract and 20% of your Nitrogen nutrient offset credits
(0.20 x 33,390.65 lb -N = 6,678.13 lb -N) are now available for sale. Additionally, 20% of your
Neuse buffer mitigation credits (0.20 x 264,844.80 ft2 = 52,968.96 ft2) are now available for sale.
Please update the credit ledgers accordingly.
Please note that nutrient offset credits generated at this site must be used for impacts in
HUC 03020201 of the Neuse River Basin excluding the Falls Lake Watershed pursuant to
15A NCAC 02B .0240. Additionally, the riparian buffer credits must be used for impacts
in the Neuse River Basin in accordance with guidelines in the Consolidated Buffer
Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015.
