Dear Ms. Alexander and Ms. Higgins,
On behalf of our client, LCD Acquisitions, LLC, Kimley-Horn is submitting the attached additional
information for the above referenced project per the US Army Corps of Engineers (USACE)
Incomplete Application Notification dated January 18, 2018.
Below is an outline of the USACE comments with a brief narrative addressing each item. The
USACE comments with Kimley-Horn response and explanation are as follows:
1) The PCN indicates the purpose and need it to construct a multifamily residential development
however the plans provided only show the construction of roads and division of new lots.
Please provide a site plan for the development which includes building footprints, amenities,
parking, etc.
a. Included with this response package is an additional plan sheet showing all proposed
development within the property.
2) At this time it is unclear if the applicant has avoided and minimized. It appears access from
T►inity Rd can be utilized without impacts to waters of the U. S. Please explain the need for
access from Westchase Blvd.
a. The north -south road crossing through the property that extends from Trinity Road to
Westchase Boulevard, shown on the attached Site Plan as Oglethorpe Avenue, is
required by the City of Raleigh as a condition of development within the property. The
proposed roadway is included in the City's transportation plan and a required component
of development in this area due to the property's location within the Arena Small Area
Plan in the City's 2030 Comprehensive Plan. The road will be a public right-of-way and
will improve the interconnectivity of the City's transportation network in the vicinity.
Development within this area is also required to be developed in a "gridded" road
network, which further requires the proposed roadway alignments to be oriented in a

distinct north -south or east -west direction. Due to the multiple City requirements
concerning the placement and location of the roadway corridor, developing the property
without connecting to Westchase Boulevard is not possible and connections to both
Trinity Road and Westchase Boulevard are necessary. The roadway corridor in question
is also shown on the City's MAPS application clearly extending from Trinity Road and
continuing north to Westchase Boulevard. See the MAPS screenshot below (roadway
corridor shown in purple):
Given the required roadway extension within the property, LCD Acquisitions, LLC has still
avoided and minimized impacts to jurisdictional features to the extent practical by utilizing
the required public roadway corridor as the primary entrance/exit routes to the proposed
development, and by utilizing a retaining wall along the western slope of Oglethorpe
Avenue. Wingwalls and headwalls are proposed at all culvert inlets/outlets to further
reduce stream impacts from fill slopes (reduced from a total of 280 LF in the previous
submittal to 264 LF in the revised PCN application.
3) Please provide a typical detail for the culvert installation at impact area 1.
a. Typical details have been provided for impact areas 1 and 2. Additionally, culverts have
been upsized from the previous submittal based on comments received by the City of
Raleigh, and wingwalls have been used to reduce fill slopes. This has reduced impact
length along S1 and will better maintain flow and aquatic habitat in stream S1 following
construction.
4) Additionally, the applicant is proposing to construct a stub road in the northeastern comer of
the property, impact area 2. This road does not appear to have a logical termini/valid
purpose and need. Please revise the plans to avoid impacts associated with the stub road.
a. As discussed above, the project area is within the City of Raleigh's Arena Small Area
Plan and is subject to special requirements from the City as a condition of any

development occurring within the property. One of those requirements is that the property
must be developed in a "gridded" layout, with logical north -south and east -west roadway
corridors on specific block intervals based on zoning. The property is currently zoned CX -
12 -CU which requires a block perimeter of 2,500'. Given the size of the property and the
location of the required north -south roadway, the eastern north -south road (shown on the
Site Plan as Thornberry Street) is required by the City of Raleigh's Unified Development
Ordinance (UDO) and must be located close to the eastern property line. The intent of
that secondary north -south road is to meet City requirements for development within the
CX- zoned property within the Arena Small Area Plan while providing logical
interconnection within the multi -family residential areas, amenities, pedestrian areas, and
to existing roadway facilities in the vicinity.
The proposed Thornberry Street terminates at a stub out located in high ground along the
northern property boundary as required by the City of Raleigh to maintain the logical
connections of the urban block network in the Arena Small Area Plan. Ample high ground
is available on the adjacent property to construct and/or continue the roadway corridor
towards a logical terminus at Westchase Boulevard (as required by the City) without
additional environmental impacts to complete. Additionally, due to existing commercial
and industrial development along the eastern property boundary, access to the adjacent
property parcel north of the project area would be substantially confined by the
construction of the Station at Raleigh development without the logical gridded street
network required by the City of Raleigh. The stub street termination is provided for
potential connectivity from that parcel to the larger Arena area by a presently unknown
and unrelated project independent of LCD Acquisitions, LLC's project. The stub street
termination is located at the property boundary to prevent the isolation of any parcel or
otherwise restricting access to City roads by other property owners.

The project will be constructed as a single development. The stub road in the northeastern corner of the Site is a required
roadway extension by the .City of Raleigh as a condition of site plan approval due to the Site's location within a planned
urban development district. The road alignment continues from the Station at Raleigh development to northern property
boundary, providing clear and logical connections to the interior road network and residential/parking areas. The road
terminates with a stub street at high ground at the property boundary, and ample high ground is available on the adjacent
propertyto construct any City of Raleigh -required road corridors independent of the proposed project and without
additional environmental impacts. Any development undertaken by others at any point in the future is entirely beyond the
control of LCD Acquisitions, LLC and would be subject to independent permitting with the USACE for any jurisdictional

3i. Comments: Unavoidable impacts to stream S1 will result from.the proposed project. S1 will be permanently, impacted as a
result of two perpendicular road crossings associated with the project. Site 1 is the primary entrance and exit road into the
property carrying•traffic from Westchase Boulevard and Trinity Road; and also includes impacts associated with outlet
protection at the downstream end of the culvert. Riprap will be utilized.for outlet protection and will be keyed into the bank,,
during installation` so no permanent loss of waters will result from the outlet protection. Site 2 is a secondary road that
terminates as a.stub road in the northeastern corner of the property, and is a required road connection by the City of Raleigh
as a condition of'site plan approval due to the project's location within a planned urban development district (a "block layout"
district). The road alignment continues from the Station at Raleighdevelopmenttonorthern'property boundary, providing clear
and logical connections to the interior road network and residential/parking areas. The road terminates with'a stub street at

6i. Comments: Unavoidable impacts to the protected riparian buffer associated with stream S 1 (UT to Richlands Creek) will
result from the proposed construction of a main north -south connector road between Westchase Boulevard to the north and
Trinity Road to the south. This main north -south connector road will serve -as the entrance and exit route into the development:
A second road crossing will result from the proposed project in the northeastern corner.of the Site due to the project's location
within a City of Raleigh,urban development block district: The secondary road is also oriented in a north -south direction from
Trinity Road in the south to the property line in the north. A third impact site will result from the construction of a stormwater
management pond outfall below Site 2. All riprap protection at Site 3 will stop at or before top of bank to prevent stream
impacts to S1.
D. Impact Justification and Mitigation
1. ,Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Impacts to the streams and buffers within the project corridor were minimized to the extent practical.'Stream impacts were
minimized by aligning the road crossing to be as close to perpendicular crossing over S1 as possible at the crossing locations.
Headwalls have also been utilized in the design to allow narrower fill slopes and minimize the culvert length and impacts to
S1. Stream S1 crosses the entire property along the `northern boundary, preventing any,access to Westchase Boulevard
without a stream impact. The stream crossings were selected to utilize perpendicular crossings with minimal buffer impact.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Impacts'to streams and buffers within the corridor will be minimized to the extent practical throughout the construction, process
by avoiding stream and buffer features whenever possible. Where feasible, staging and construction access routes will be
located in upland areas throughout the corridor., Silt fencing, sediment basins, and other Stormwater Control Measures
(SCMs) will be used -throughout the construction process to minimize impacts to downstream receiving waters and minimize
runoff from the construction sites.

The NC Natural Heritage Program Element Occurrence Database (updated October 2017) indicates no known
occurrences any federally listed threatened or endangered species within 1.0 mile of the project area. Suitable habitat is
not present within the study area for Michaux's sumac due to the open field being used for parking and regularly
maintained through mowing, and field edges are overgrown with vine shrub species. Habitat is not present for red -
cockaded woodpecker due to the lack of mature pines and historic development within this area resulting in successional
forests. Suitable habitat is also not,present for dwarf wedgemussel due to the low -flow, encised, and rocky nature of
stream S1.
Incidental take of Northern long-eared bat (NLEB) is prohibited if it occurs within a hibernaculum, or if it results from tree
removal activities within 0.25 mile of a known hibernaculum or the activity jeopardizes a known maternity roost tree or
trees within a 150 -foot radius of the maternity roost tree. Per the NC Natural Heritage Program Element Occurrence
Database (updated October 2017), there are no known occurrences of NLEB, hibernaculums, or roost trees within 1.0
mile of the project area.
Due to the lack of known occurrences within the study area and the lack of suitable habitat within the study area, the
proposed project is not anticipated to have any effect on any federally listed threatened or endangered species.

within the project area is listed in the database as'"Survyed" in 1989, but is not listed on the NR or NR SL. Thestructure
in the project area is the Medlin House (WA0945), and a family cemetary is located along the! eastern property boundary.
Due to the presence of the surveyed structure and the location within the central area of Raleigh resulting in over 40
known properties/sites, within a 1.0 -mile radius of the project, Kimley-Horn conducted an Environmental Review With the
NCSHPO in advance of this permit application. Attached is the Kimley-Horn project review request outling the findings of
the historical properties investigation, as well as the concurrence letter from NCSHPO (dated August 22, 201,7) confirming
that the proposed development will have No Effect on historic or archaeological sites.
