The North Carolina Division of Marine Fisheries (NC DMF) Artificial Reef Program has
been formally operating since the 1970's, and has a total of 67 permitted artificial reefs and
oyster sanctuaries within the state of North Carolina. Twenty-five (25) of these sites are in the
states estuaries, while 42 are in ocean waters. In 2016, the NC DMF released an artificial reef
guide which outlines each of the artificial reefs and oyster sanctuaries. The artificial reef guide
provides material information, latitude longitude information, and a figure of the material on
each of the reef sites. A pdf version of the hardcopy reef guide can be found at:

interactive reef guide, set up in an ArcGIS format is available here:

f763aa55. The interactive guide is complete with material shapefiles, latitude/longitude
information, side -scan sonar imagery, and much more. This is available for review by the public,
state, and federal agencies.
Boundaries for each reef site were defined in a boundary packet which detailed the
coordinates of each reef, material locations, reef boundaries, and acreages of reefs and materials.
This packet was accepted by Division of Coastal Management on April 10, 2017 and USACE on
October 10, 2017. Letters acknowledging the acceptance of this reef packet are shown in
attachments 1 and 2.

Acceptable Materials
For reef construction, NCDMF intends to use only biologically suitable materials that are
approved for reef building. Accordingly, NCDMF adheres to program documentation which
details specifications for acceptable reef construction materials, based on federal and state
guidance (references available upon request). It should be specially noted that all materials
placed at the state's artificial reef sites are free of hydrocarbons, contaminants, and toxins, as
required by the United States Army Corps of Engineers (USACE), the Environmental Protection
Agency (EPA), the United States Coast Guard (USCG), and other agencies involved in
permitting of artificial reefs. All trash, wood, lines, and floating debris must also be removed. If
materials are found to be contaminated, the material would be disposed of properly and not put
on our artificial reefs or oyster sanctuaries.
Project Background
Stakeholders
The North Carolina Division of Marine Fisheries (NCDMF) has entered a partnership
agreement with the Oregon Inlet Artificial Reef Committee (OIARC) to create and develop a
new reef site, AR -165 (Figure 1). This artificial reef will provide additional opportunities for
anglers and divers around Oregon Inlet. DMF will permit this site and work with contractors to
ensure materials are suitable for reef construction and remain within the boundaries of the reef
site.
Proposed Developments
Reef Site
AR -165 is a newly proposed reef site outside Oregon Inlet. The location was chosen
through public input and meets the criteria outlined in the reef site selection protocol. The site
was found to be devoid of natural hard bottom habitat and has a bottom composition conducive
to development (Figure 2). Because this is a new reef site, no vertical clearance has been
established. The nearby AR -160 has a vertical clearance requirement of 30 ft. We propose the
same requirement be established for AR -165. With a water depth of 68 ft., that will allow for 38
ft. of vertical profile. Once this site is permitted, NCDMF would like to have it added to the reef
site boundary packet referenced in attachments 1 and 2.
Materials
The proposed development will contribute up to two decommissioned, cleaned, and
prepared vessels (100'-200' class) and up to 8,000 tons of recycled precast concrete. These are
both suitable materials as defined by the North Carolina Division of Marine Fisheries Guidelines and
Specifications for Acceptable Artificial Reef Materials. Due to the currently unpredictable nature of
USACE permits, we will not secure materials or vessels until a permit is issued. Prospective
locations of material deployments are shown in Figure 3.
Reef Monitoring
During construction, NCDMF staff will serve as observer(s) to ensure proper permit and
building compliance. Deployed materials will be surveyed with calibrated onboard sonar to
verify compliance with vertical clearance requirements.
When time allows, staff will survey the sites with bathymetric mapping equipment, as an
update to the Artificial Reef program's artificial reef guide and habitat records. Staff will also
perform SCUBA surveys on reef sites to observe material condition, as time allows. The

Artificial Reef program also employs an online survey for recreational users to provide feedback
on Artificial Reefs through its website. Further, artificial reefs are included in MRIP survey
questionnaires, which can offer valuable biological information.
Protected Resource Avoidance
Construction will not occur January 1 -March 15 to abate concerns over interactions with
Atlantic and shortnose sturgeon. NCDMF staff will perform any additional avoidance measures
prescribed by USACE consultation process with NMFS. We would also request that USACE
sends the entire 163 acre site, rather than the 9.3 impacted acres to NMFS for protected resource
review.

This letter is in response to the NC Division of Marine Fisheries Artificial Reef Program's
request to modify and document the expansion of numerous artificial reef and oyster sanctuary sites
throughout the estuarine and coastal waters of North Carolina. The reef site boundaries specified within
this letter arc existing or permitted and have been accurately documented. 'These boundaries will be kept
on file with each related CAMA permit, and on file in with the NC Division of Coastal Management in
the 2017 major permit archives under 2017 NC DMF AR BOUNDARY MODIFICATION. If at any
time your agency wishes to access these records, apply for a permit or permit modification, or modify a
boundary, this letter shall be referenced, along with the appropriate reef site information. This
endorsement does not convey an active permit or authorization to conduct development within the newly
acknowledged reef site boundaries. Any future development may require modification of an active
permit or the need to proceed through the NC Division of Coastal Management's CAMA major
permitting process. Please contact a representative of the Division prior to the commencement of any
activity for this determination.

-68ft below mean low water (MLW) at the site. NOAA chart 12204 indicated bottom
material is composed of shell and sand at the proposed location. The waters of the Atlantic
Ocean in this area are classified as SB and open to shellfish taking.

Development Proposal
The applicant proposes to construct a new artificial reef by placing two decommissioned,
cleaned, and prepared vessels (100' — 200' class) and up to 8,000 tons of recycled precast
concrete over 9.3 acres of the proposed 163 acre reef area. Fill elevation will be limited to
no more than 38ft., leaving a 30ft. navigation clearance for the site, similar to a nearby
artificial reef, AR -160.
Anticipated Impacts
The project will result in approximately 9.3 acres of Public Trust Area, Estuarine Waters,
areas of environmental concern, ocean bottom being filled with two vessels and 8,000 tons
of recycled precast concrete. The water depth in the area will change from -68ft to -30ft
below MLW. Temporary water turbidity will occur during construction. New fish habit will be
created.

The North Carolina Division of Marine Fisheries (NCDMF) has entered a partnership agreement with the Oregon Inlet
Artificial Reef Committee (OIARC) to create and develop a new reef site, AR -165 (Figure 1). This artificial reef will provide
additional opportunities for anglers and divers around Oregon Inlet. DMF will permit this site and work with contractors to
ensure materials are suitable for reef construction and remain within the boundaries of the reef site.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.

All construction will be conducted by contractors. Vessels will be transported to the site and sunk. Concrete materials will be
transported by barge and offloaded using heavy equipment.
