Dear Ms. Alexander and Mrs. Higgins:
On behalf of the Town of Knightdale, Timmons Group is submitting a Preconstruction Notification (PCN) for
Nationwide Permit (NWP) 14 and General Certification (GC) 4135 associated with the Hardin Hill Lane
Extension project located in Knightdale, North Carolina. The Hardin Hill Lane Extension project site is
comprised of approximately 2.7 acres of public right-of-way and approximately 2 acres of land currently
owned by the Town of Knightdale. The project site begins at the roundabout which is located at the
intersection of existing Hardin Hill Lane and Panther Rock Boulevard. The project site extends north and
northwest and terminates at property owned by the Town of Knightdale. The approximately 2 acres of land
owned by the Town of Knightdale is proposed to be a park operated and maintained by the Town of
Knightdale. The proposed Town of Knightdale Park will be comprised of a mix of active and passive
recreational areas such as playgrounds, walking trails, and shade trees. Anticipated patrons to park include
nearby residential areas and an elementary school (i.e. Hodge Road Elementary school located
approximately 1 mile northeast). The purpose of the project is to provide a primary road access (i.e. Hardin
Hill Lane Extension) to the proposed Town of Knightdale Park. A primary access road is required so that
access to a proposed park location can be achieved. To provide access to the proposed Town of Knightdale
Park, the proposed Hardin Hill Lane Extension project will cross one stream. Consequently, a total of 105
linear feet of permanent stream impact and 70 linear feet of temporary stream impact are proposed. Neuse
River Buffer impacts are also proposed associated with the road crossing that total 9,348 square feet within
Zone 1 and 5,048 square feet within Zone 2. Additional impacts to waters of the U.S. and riparian buffers
located within the project site are not proposed. Please find enclosed for your review the following items:

PROJECT HISTORY & EXISTING CONDITIONS:
The project site is comprised of approximately 2.7 acres of public right-of-way and approximately 2 acres
of land currently owned by the Town of Knightdale. The majority of the project site is forested that is
dominated by a mix of pine and mixed hardwood species. The project site is located within the Neuse River
Basin (HUC 030202011103) and within the Poplar Creek — Neuse River sub -watershed. Land use within
the vicinity of the project site consists of residential, institutional, commercial, and undeveloped areas. The
project site drains to Neuse River, which has a DWR Stream Classification of Class C and NSW. Floodplain
areas are not located within the project site according to the North Carolina Flood Insurance Rate Map
3720174300J (issued May 6, 2006).
A wetland delineation was conducted by Soil and Environmental Consultants. A Neuse River Buffer
Determination (NC DWR RRO #16-389) was issued on December 16, 2016. In addition, a Nationwide
Permit was issued on October 18, 2017 (USACE Action Id.: 2017-02165) and a 401 Water Quality
Certification and Neuse River Buffer Authorization was issued on September 6, 2017 (DWR # 17-0895) for a
road crossing at the same location of the proposed project.
PROPOSED PROJECT:
The purpose of the project is to provide a primary access road (i.e. Hardin Hill Lane Extension) to the
proposed Town of Knightdale Park. Currently, the Town of Knightdale Park owns approximately 2 acres of
land. The proposed park will be operated and maintained by the Town of Knightdale. A primary access road is
required so that access to a proposed park location can be achieved. The proposed Town of Knightdale Park
will be comprised of a mix of active and passive recreational areas such as playgrounds, walking trails, and
shade trees. Anticipated patrons to park include nearby residential areas and an elementary school (i.e. Hodge
Road Elementary school located approximately 1 mile northeast). Consequently, a total of 105 linear feet of
permanent stream impact and 70 linear feet of temporary stream impact are proposed. Neuse River Buffer
impacts are also proposed associated with the road crossing that total 9,348 square feet within Zone 1 and
5,048 square feet within Zone 2. Additional impacts to waters of the U.S. and riparian buffers located within
the project site are not proposed.

The proposed 72" RCP associated with the road crossing will be buried 1' below the stream bed and
measure 94 linear feet. Of the total 175 linear feet of stream impacts, 44 linear feet of temporary stream
impacts associated with rip -rap dissipator pads, which will be installed flush with the existing grade of the
stream bed to allow for aquatic life passage. In addition, there will be another 26 linear feet of temporary
stream impacts associated with the construction of a coffer dam and diversion channels so that culvert
installation can be achieved in dry conditions. Therefore, there will only be a total of 105 linear feet of
permanent stream impact associated with culvert installation.

The width of the road crossing through the buffer is 130 feet. In accordance with the Neuse River Riparian
Buffer Rules (15A NCAC 0213 .0233) Table of Uses, the road crossing is an allowable use within the buffer
and mitigation is not required. Impacts to riparian buffers have been minimized to the maximum extent
practicable by aligning the road through the buffer as close to 90 degrees as possible.
Stormwater Management
Water quality treatment and water quantity control will be provided for the project site using stormwater
control measures (SCMs) designed to capture the design storm and release it slowly. The stormwater
management plan will be reviewed and approved by the Town of Knightdale prior to construction.
AVOIDANCE & MINIMIZATION:
Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by
incorporating resourceful site planning, including the utilization of the wetland delineation to adjust the
layout to avoid and minimize impacts. Avoidance and minimization measures were also accomplished
during the design phase of the project. The Applicant has avoided and minimized impacts to the greatest
extent practicable given the project's purpose and need. The proposed stream impacts are the result of
necessary access to the proposed Town of Knightdale Park. The proposed road crossing has minimized
impacts to the maximum extent practicable by aligning the crossing as close to 90 degrees as possible.
The dissipator pad associated with the culvert will be installed flush with the existing grade of the stream
bed to allow for aquatic life passage.
Proper sedimentation and erosion control methods will be utilized during all phases of construction and
installation as described in accordance with the requirements of the North Carolina Department of
Environmental and Natural Resources Erosion Control Planning and Design Manual and local codes. All
work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground.
The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer
dams, tree protection, clearing only as necessary to install devices. All erosion and sediment control
measures will be checked for stability and operation following every runoff producing rainfall, but in no case
less than once every week. Any needed repairs will be made immediately to maintain all measures
designed. An erosion control inspections report is required and will be kept by the owner's representative.
Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will
meet all relative requirements of Best Management Practices and Engineered Stormwater Control
Structures as outlined through State and Local Stormwater Rules. Measures will be taken to prevent oil,
tar, trash, debris and other pollutants from entering the adjacent jurisdictional streams. Any excess
excavated materials not utilized as back fill will be placed and contained within upland areas and
permanently stabilized to prevent erosion into adjacent jurisdictional streams. Therefore, stockpiling of
excavated material within jurisdictional streams will be strictly prohibited as part of the construction of this
project. All project construction activities initiated within jurisdictional streams will be carried to completion
in an expeditious manner to minimize the period of disturbance within the jurisdictional streams.
MITIGATION:
There will be a total of 105 linear feet of permanent stream impact and 70 linear feet of temporary stream
impact associated with culvert installation. The proposed permanent stream impact is less than the 150
linear feet; and therefore, at this time, the Applicant does not propose stream. The width of the road crossing
through the buffer is 130 feet. In accordance with the Neuse River Riparian Buffer Rules (15A NCAC 02B
.0233) Table of Uses, the road crossing is an allowable use and mitigation is not required. Therefore, at
this time, the Applicant does not propose buffer mitigation.
SUMMARY:
The Town of Knightdale proposes Hardin Hill Lane Extension from the existing intersection of Hardin Hill
Lane and Panther Rock Boulevard to an approximately 2 acres of land currently owned by the Town of
Knightdale for purposes of providing a primary access road to a proposed Town of Knightdale Park. The
proposed Town of Knightdale Park will be operated and maintained by the Town of Knightdale and
comprised of a mix of active and passive recreational areas such as playgrounds, walking trails, and shade
trees. To provide access to the proposed Town of Knightdale Park, the proposed Hardin Hill Lane
Extension project will cross one stream. Consequently, a total of 105 linear feet of permanent stream
impact and 70 linear feet of temporary stream impact. Neuse River Buffer impacts are also proposed
associated with the road crossing that total 9,348 square feet within Zone 1 and 5,048 square feet within
Zone 2. At this time, the Applicant does not propose stream or buffer mitigation.
Therefore, at this time, we are requesting confirmation that the proposed project qualifies under the
conditions of NWP 14 and GC 4135. In addition, we are requesting authorization of the proposed project

Location description: The protect is located to the south of Water Tower Lane on three tracts of land, 19.1 acres (apartment
site), 2.7 acres (publie right-of-way), and 0.02 acres a[liacent to right -of way owned by Cheswick Investments. These tracts

Description of projects area and activity: This verification authorizes impacts to 155 linear feet of an unnamed tributary to the
Neuse River. to construct the northern portion of Hardin Hill Lane from the existine roundabout. The road construction will
facilitate the development of Hodge Road apartments, a 228 unit complex. 117 linear feet of stream channel will be
permanently impacted to install a culvert 72" RCP and 48 linear feet of stream channel will be permanently impacted to
install a Horan disaster nod. The riprap will be embedded in the stream channel.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the enclosed
Conditions, your application signed and dated 7/13/2017, and the submitted plans C2, C3, & C4 dated 2/15/2017. Any violation
of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration
order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified, suspended
or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this
verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified
nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would
no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction)
or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has
been exercised on a case-by-case basis to modify, suspend or revoke the authorization.

2 -The permittee must notify the USACE, in writing, prior to beginning work within waters of the United States and provide a copy of

3 -Please be advised that if additional impacts to waters of the U.S., either on this property or on/adjacent to this property and
associated with this project/activity, are proposed at a later date, those impacts will be combined with the current impacts to waters of
the U.S. and will be reviewed cumulatively. Generally, compensatory mitigation will be required if individual or cumulative (i.e., past
and present) losses or degradation of waters of the U.S. are greater than 150 linear feet of perennial or intermittent stream channel
and/or 0.1 acre of wetland. Additionally, cumulative impacts that result in the loss or degradation of greater than 300 linear feet of
perennial or intermittent* stream channel, and/or 0.5 acre of wetland, will be processed under an Individual Permit. This verification

2. Stormwater Management Plan SMP Approval from local Community Required
The stormwa ter management plan (SMP) must be approved by the Town of Knightdale and
meet the requirements of this Certification. The SMP may not be modified without prior
written authorization from the Town of Knightdale. 115A NCAC 02H .0506(b)(3)]
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre -Construction Notification. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur. [15A NCAC 02H .0501
and .0502]
4. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within
these boundaries approved under this authorization shall be clearly marked with orange
warning fencing (or similar Nigh visibility material) for the areas that have been approved to
infringe within the buffer, wetland or water prior to any land disturbing activities to ensure
compliance with 15 NCAC 02H.0500. [15A NCAC 02H.0506 (b)(2) and (c)(2) and 15A NCAC
02H.0507 (c)]
5. This approval is for the purpose and design described 1n your application. The plans and
specifications for this project are incorporated by reference as part of the Certification and
Buffer Authorization. If you change your project, you must notify the Division and you may
be required to submit a new application package with the appropriate fee. If the property is
sold, the new owner must be given a copy of this approval letter and General Certification
and is responsible for complying with all conditions. [15A NCAC 02B .0507(d)(2)]
