Salisbury Street Raleigh, North Carolina 27604 RE: Hensley Subdivision Phase V - Pre -Construction Notification Application 11314 & 11308 Holly Springs New Hill Road, Holly Springs, Wake County, North Carolina Dear Mr. Lastinger and Ms. Higgins: On behalf of HHHunt Shaffer, LLC, we are requesting authorization from the USACE to use NWP 29 for 0.139 acres of additional permanent non -isolated, jurisdictional wetland impacts for fill/grading and infrastructure construction for the proposed residential development, Phase V of Hensley Subdivision. We are also requesting a 401 WQC from the NC Department of Environmental Quality for the above referenced impacts. Phase V of Hensley Subdivision is a 9.75 acre proposed residential development and associated infrastructure (e.g., roads and utilities). The project is located at 11314 & 11308 Holly Springs New Hill Road, Holly Springs, Wake County (Latitude: 35.6627-N Longitude: -78.8589-W). The project is in the White Oak Creek Watershed in the Cape Fear River Basin. The Water Quality Classification for Middle Creek is C. James Lastinger, USACE, visited the site with Scott Mitchell May of 2016 to confirm the delineation. The proposed project impacts consist of 0.139 acres of permanent non -isolated wetland impact. The impacts are required for fill and grading for lot and roadway construction. These impacts will result in cumulative impacts for non -isolated wetlands, with a total of 0.322 acres. Previous phases of Hensley Subdivision resulted in 0.183 acres of non -isolated wetlands impacted. Mitigation is anticipated for the additional permanent non -isolated wetland impacts. See attached permits for more detail on previous impacts from USACE permit (SAW -2013-02420, July 20, 2015) and DWR permit (DWR# 15-0663, July 24, 2015). Previous DMS invoice, attached, included 0.50 acres of mitigation credit. An additional 0.144 acres of mitigation credit has been requested from DMS. Please refer to attached PCN, supporting materials and plans for details describing the proposed impacts. The Eagle Act prohibits take of bald and golden eagles and provides a statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid disturbing bald eagles. The T(S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(SIA) designation has no effect on land management activities by private landowners in North Carolina, part of the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss.
