On behalf of the owner, E C Perry, please find attached a complete application and supplemental
information requesting written concurrence from the US Army Corps of Engineers (USACE) and
North Carolina Division of Water Resources (NCDWR) that the activities associated with the
Nichols Farm residential development (formerly known as the E.C. Perry Property) may proceed
using Nationwide Permit (NWP) 12 and the associated General Certification (GC) 4133 for
impacts related to sewer line installation and NWP 18 and GC 4139 for a single impact related to
a stormwater BMP discharge.
Proiect Location, Description, and Purpose
The proposed Nichols Farm Subdivision (Project) involves the development of a single 50.161 -
acre parcel bounded on the east by Doc Nichols Road. The Project is located approximately 0.8
mile southwest of the Doc Nichols Road and Olive Branch Road intersection in eastern Durham
County, NC. The Project will be a residential subdivision of single-family homes and contain the
associated utilities needed for such a project including subdivision roads, two stormwater BMP
devices, and sewer, water, electricity. The Project will have sewer service that ties into existing
municipal lines located adjacent to the Project to the west and south. The stormwater plan is being
reviewed by Durham which is a delegated authority. The project will provide additional housing to
meet the current demand in this area of Durham County.
Proiect History
The proposed Project was originally evaluated at the same time as the proposed 43.33 -acre
Sagewood subdivision (impacts requested under separate submittal) which is the partially
adjacent parcel to the north. The draft site plan had proposed these two parcels be a single low
impact development with one shared road however complications with local planning ordinances

prevented this plan from moving forward. The two parcels have since been planned and reviewed
as separate and independent projects without shared name, roads, or amenities.
A wetland and stream delineation was completed in 2016 and the delineation approved by Mr.
Eric Alsmeyer of the USACE during a field visit on August 3, 2016. The Neuse River Riparian
Stream Buffers were approved by Mr. Rick Trone of the NCDWR during a field visit on Jul 1, 2016.
The determinations made by Mr. Alsmeyer and Mr. Trone are reflected on the attached impact
maps.
Avoidance and Minimization
Proposed subdivision roads were aligned to avoid impacts to streams and wetlands. No impacts
to wetlands are proposed. The stream and riparian buffer impacts shown on the attached maps
will result from the installation of a stormwater BMP and sewer utility crossing. These impacts
have been aligned so as to cross the drainages at perpendicular angles in order to minimize
resulting impacts.
Project Imaacts
Overall proposed temporary stream impacts total 89 linear feet that result from the installation of
sewer line (NWP 12) and a stormwater BMP discharge (NWP 18). No wetland impacts are
proposed. The Project is within the NCDWR regulated Neuse River buffered basin. Overall Neuse
River Riparian Buffer impacts total 4,951 square feet of Zone 1 buffer impacts and 4,387 square
feet of Zone 2 buffer impacts.
Mitigation
No permanent stream or wetland impacts are proposed therefore no mitigation has been
proposed. Proposed buffer impacts are considered "exempt" or "allowed" therefore no buffer
mitigation has been proposed.

parties that dispute a determination made by the DWR may request a determination by the Director. An
appeal request must be made within sixty (60) days of date of this letter. A request for a determination by the
