3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application: The property contains the existing and active Wake Stone Corporation Moncure Quarry which opened in
1974. The quarryprovides hard metavolcanic rock products (e.g, ABC, #57 stone, riprap, etc.). The Deep Riverborders
the northern property line. The river is the Chatham & Lee County line. US -1 highway borders the eastern property line.
Deep River Road borders the southern property line. Surrounding land uses primarily include vacant forested land, rural
residential and agriculture. Portions of the Deep River State Trail park land is located on the other side of the river in
Chatham County. Along with the Lockville Dam, Canal and Powerhouse historic site, also on the other side of the river in
Chatham County, with the exception of the dam which extends across the river. (The quarry maintains a 100' buffer
along the river to insure protection of the river and these public lands and cultural resources.)

The purpose of the project is to provide the necessary infrastructure to allow for the continued operation of the existing
quarry.
3e. Describe the overall project in detail, including the type of equipment to be used:
Please refer to the attached "Project Description". The project consists of mining permit modifications to allow for the
continued operation of the existing quarry. These modifications include, but are not limited to, the 195' extension of the
existing 30" corrugated metal pipe (CMP) culvert and riprap outlet protection, fill to finished grade (+/- 260' MSL), 8-12" of
compacted ABC stone surface treatment, and construct the relocated fuel and lubricant station, equipment maintenance
shop, quality control (QC) lab, and employee building. All fill slopes will be stabilized with vegetation. Two water quality
skimmer basins (SB -2017-01 and SB -2017-02) will be constructed to treat both temporary construction and post -
construction stormwater runoff. Off-road mine haul trucks and tracked equipment (dozers and excavators) will be used.

D. Impact Justification and Mitigation
1. Avoidance and Minimization

Please refer to the attached "Project Description". The project consists of mining permit modifications to allow for the
continued operation of the existing quarry. Wake Stone Corporation (WSC) determined that the proposed location
provides the only viable alternative for the intended uses due to limited acreage and necessity for a central location away
from public thoroughfares. WSC hired S&EC to perform a delineation of potential jurisdictional wetlands, streams and
waters. Once it was found that the proposed location contained a jurisdictional intermittent stream and small wetland,
WSC revisited their plans in attempts to avoid and minimize impacts. Fill slopes were pulled back, skimmer basins
relocated and impacts were minimized from upwards of 266 If of stream to only the 1861f requested.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Please refer to the attached "Project Description" The project will be in full compliance with DEQ mine permit conditions,
including erosion and sediment control and NPDES stormwater management requirements. A 100' buffer has been
established along the Deep River. All fill slopes will be stabilized with vegetation. Two water quality skimmer basins (SB -
2017 -01 and SB -2017-02) will be constructed to treat both temporary construction and post -construction stormwater
runoff.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft
states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in-fill,
most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. This
project involves a private quarry. The quarry merely provides stone products (riprap, etc.) to meet the demands of the
surrounding community and does not in of itself result in additional development or the associated potential water quality
impacts. We anticipate that the DWR will advise us if any additional information is needed.

4a. Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from
the proposed project, or available capacity of the subject facility.
The existing facilities (office and employee break room) are on septic systems. The existing office is on city water. The
existing employee building is supplied by a well. The relocated shop and employee building will have its own septic system
when the structure is permitted for construction by Lee County, with a well the likely source of potable water. All necessary
septic, well and water permits will be properly obtained.

The NC-Natural Heritage Programs Data Explorer Map was used to search for elemental occurrences of federally
protected species listed within 1 mile of the project boundaries. It was determined based on the search that there are no
elemental occurrences or species that are listed as federally Threatened/Endangered within the project area or action
area. See attached NHP Report generated 12/22/2017.
While there are no known federally listed TIE species within the action area, there are two (2) species within the Deep
River adjacent to the project area. These include the Cape Fear Shiner (Notropis mekistoscholas) and Harperella
(Ptilimnium nodosum). No impacts will occur to these species associated with this project. The quarry maintains a 100'
buffer along the Deep River. It's also evident on the plans that the majority of the undisturbed buffer along the
approximately 5, 000 fee of adjacent Deep River boundary is in excess of 200' wide. None of the proposed impacts are
directly to the Deep River or it's perennial tributary streams without first being treated by approved NPDES sediment
control measures. Wake Stone Corporation has operated the Moncure Quarry since the 1970's with an exemplary record
of compliance with all regulatory programs, including stormwater and pit dewatering discharges approved under the
NCG02 NPDES General Permit. Given these buffers and water quality measures, we do not anticipate the project will
have a potential impact to these federally listed species.
Please note the final 4(d) rule identifies the Northern Long-eared Bat as a Threatened species within Lee County. We
estimate twenty-two (22) trees will be removed within the "action area" being the footprint of the intermittent steam and
wetland (0.027 acres x 800 trees per acre = 22 trees). While routine blasting and percussive activities occur in
association with the quarry operations, it's not anticipated that such activities will be needed within the proposed "action
area ".

borders the property, but no impacts are proposed to it. Wake Stone Corporation acknowledges these important cultural
resources and as such maintains a minimum 100' buffer along the Deep River to avoid impacts to them.

MONCURE QUARRY — Mining Permit Modifications Permit No. 53-10
Project Description
The purpose of the project is in keeping with the 2010 Mining Permit modification which
provided planning for the ultimate buildout of the site. That permit action provided DEQ
approval for the relocation of the quarry office and scales facility, realignment of the customer
entrance road, relocation of the primary surge pile down into the pit, relocation of the secondary
crushing plant to the existing north fill, phased development of a satellite mine pit, and ultimate
connection of the existing pit to the satellite pit once the secondary plant is relocated. Surge pile
relocation will occur next year, with relocation of the secondary plant to follow closely. Once
the secondary plant is relocated, the existing fuel/station and open-air equipment
maintenance/service are and existing employee breakroom and Quality Control Lab must be
relocated in order to connect the existing and satellite pits.
The proposed project site was selected based on several factors. Although company
controlled land (upland area) exists immediately west of the approved area for relocation of the
quarry office/scales and customer entrance road facilities, the fuel/lubricant station and
equipment maintenance shop needs to be located as close as possible to the pit, plant, and
stockpiles as it is impractical to move mining equipment (particularly the large tracked
equipment such as dozers, hydraulic shovels, and track excavators) long distances for servicing.
Placement of the shop and lube station, employee break room and Quality Control Lab in the
proposed area will provide close proximity for these vital portions of the overall quarry
operation. It will also prevent having these facilities near Deep River Road, thereby making
access easier to control in order to minimize the risks of theft and vandalism that has previously
occurred.
The project will consist of utilization of mobile mining equipment for the placement of
waste overburden and decomposed rock fill in the area outlined in the plans. Once logging has
been completed, proposed skimmer basins (SB -2017-01 and SB -2017-02) will be constructed to
NC DEQ specifications for collection of site runoff and containment of sediment. The proposed
30" X 195' of CMP culvert extension and rip rap outlet protection will be installed per the plans
to provide continued flow of surface water currently draining via the intermittent stream reach
proposed for impact. Placement of fill will begin once all S&EC structures, culvert extension,
and culvert outlet protection are in place.
Construction Sequence:
• Flag Limits of Disturbance (LD) line as indicated on plans.
• Contract logging of area within the LD.
• Stump and grub footprint of proposed basins SB -2017-01 and 02.
• Construct basins SB -2017-01 and 02.
• Stump and grub footprint of proposed culvert extension and install culvert and outlet
protection device to the lines and grades indicated in the plans.
• Utilizing off-road mine haul trucks and tracked equipment (dozers and excavators) place
and compact overburden and decomposed rock fill in lifts. Finished lifts not to exceed 20
vertical feet. Fill to be placed from the lowest elevation upwards until the finished grade
is reached at approximately Elevation +260' MSL. Final surface treatment of the fill will
be with 8-12" of compacted ABC stone.

Project Description
• Stabilize all fill slopes with mixed grasses and legumes according to the DEQ/Mining
Permit approved re -vegetation plan and specifications.
• Construct new fuel and lubricant station, equipment maintenance shop, QC Lab, and
employee building.
The proposed location provides the only viable alternative for the intended uses due to the
limited acreage available within the Mining Permit Boundary, the necessity for centralized
location of the proposed facilities, and the need to keep such facilities remote from public
thoroughfares. In reaching the decision that this area provides the only viable alternative, and in
recognition of the presence of jurisdictional waters, the overall project footprint was designed to
provide only the minimal areas needed for the proposed shop, lube station, and QC
Lab/employee break room. Plans for fill placement and construction of the requisite Sediment
and Erosion Control structures specifically incorporate Company efforts to minimize impacts to
the aquatic resources, keeping impacts to 186 linear feet even though the NWP program provides
for greater impacts. Proposed basins SB -2017-01 and SB -2017-02 were designed and located in
such a manner as to preclude the need to impact an additional 60-80 linear feet of stream
(reference the rectangular course of the Limits of Disturbance (LD) line on the plans.
As mentioned above, site design planning provided for the placement of requisite sediment &
erosion control structures in such a location and manner as to preclude the need for an additional
60-80 linear feet of stream impacts. Placement of the culvert extension and outlet protection
device as shown on the plans provides sufficient space for placement of the culvert and rip rap
pad completely within the minimized LD, which was determined by engineering analyses of
various fill iterations that might provide sufficient surface area for infrastructure placement. The
final design, as proposed in the PCN, is the minimal disturbance footprint that will provide the
minimal area needed for the planned building structures.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this
acceptance will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS
receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and
payment must be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by
an applicant is calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the

Thanks for meeting David Lee (Wake Stone) and I at this site yesterday. I understand that you verified the stream is
jurisdictional from the check dam down and that it's "intermittent". I also understand that you verified the small
wetland is jurisdictional as well.
Please let us know as soon as you can, after confirming with Jean, if the proposed stream impacts (less than 3001 can be
reviewed and hopefully approved under NWP44.
We understand that mitigation will be required for any stream impacts. We'll most likely propose a 1:1 ratio, but will
provide the NCSAM forms and do our best to justify this ratio in the application instead of 2:1.

This is the quarry project that I just mentioned to you in another project email.
Wake Stone Corporation is looking for a new shop location at their Moncure Quarry. Unfortunately it's looking like the
best location is over a 1st order stream. I'd like to meet with you at the quarry, show you the stream and present you
their conceptual plans and anticipated impacts. I'd like for them to get your initial read on their proposal before we
move any further down the road with it.
Attached is their signed agent authorization. I'll provide maps and concept plans before the site visit. The quarry
address is on the agent authorization form. It's in Moncure near the intersection of US -1, Deep River Road and the Deep
River. It's about 12 miles south of Pittsboro.
Please let me know if we can fit this in on October 10th after our site visit in Chatham County.

Through coordination with Mr. Kevin_ Martin with Soil and Environmental
Consultants, we have learned of your plans to impact 0.287 acre of
jurisdictional wetlands associated with improvements to an existing roadway
and the construction of a dike on your property located at the north end of
Stone Quarry Road, approximately 1/4 mile north of S.R. 1466, east of Mcncure,
Chatham County, North Carolina. The site is located adjacent to, and above
the headwaters of, an unnamed tributary to Deep River.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal_
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters.
Your proposed work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval.
This verification will be valid for two years from the date of this
letter unless the nationwide authorization is modified, reissued or revoked.
This verification will remain valid for the two years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification. If during the two ,years,
the nationwide permit authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the nationwide permit, activities which have commenced or are
under contract to commence, in reliance upon the nationwide permit, will
remain authorized. This is provided the activity is completed within twelve
months of the date of the nationwide permit's expiration, mcd:fication or
revocation.
