Comments: Impact proposed are an "allowable" use according to 15A NCAC 02B .0233(6) Page 5 of 10 D. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. A detailed wetland delineation and Neuse Buffer evaluation was conducted on the property in order to design a plan that would avoid and minimize impacts to wetlands, streams and buffers to the maximum extent practicable. As such, the only impacts to wetlands are to "isolated" wetlands and are under 0.10 acre, therefore notification for these impacts to the NCDWQ was not required. The only other proposed impacts, which are unavoidable, are to the riparian buffers. These proposed impacts are perpendicular, non-electric utility impacts which are unavoidable because the existing manholes are within the riparian buffer. In order to connect to the existing sanitary sewer these proposed connections are necessary. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Per the engineer, the sewer connection will be made and the existing grade will be re-established quickly. The disturbed area will be protected by silt fence and every effort will be made to provide vegetation cover within the impact area shortly after the pipe is installed. 2. We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in-fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Searstone project is a small mixed use development within a highly development watershed. The Town of Cary is requiring stormwater treatment and in addition is requiring their additional 50' Urban Transitional Buffer. We anticipate that the DWQ will advise us if any additional information is needed. 4. Sewage Disposal (DWQ Requirement) 4a. Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. This project will connect to the Town of Cary Sanitary Sewer System. The Town of Cary will ensure that the capacity of their treatment facility will not be exceeded.
