The Pretreatment, Emergency Response, and Collection Systems Unit (PERCS) of the Division of Water
Resources has reviewed the Industrial User Pretreatment Permit (IUP) modifications submitted by Town
of Pembroke for the following Significant Industrial Users (SIUs). These IUPs were received by the Division
on December 18, 2017.
IUP # SIU Name
001 Trinity Frozen Foods, LLC
002 Steven Roberts Original Desserts, LLC
The review indicates that the IUPs are adequate and meet the minimum requirements of 15A NCAC 2H
.0905 and .0916 and 40 CFR 403.8(f)(1)(iii) The allocation table, maintained in the Division's database,
has been updated accordingly
Please take note of the following- comments-*
1. Steven Roberts: The next time this IUP is modified or renewed include the nature of this
modification in the Permit History.
2. For both:
a. The SIUs are still required to record and submit flow monthly. Please ensure that
compliance judgment regarding on-time submittal of reports is performed.
b. If a limits violation occurs during the sampling event done on the SIU's behalf, the Town
must re -sample within 30 days (Part II, 2, c).
c. NOVs have been sent to both SIUs for failure to submit required reports If the reports
are not received within 45 days of the due dates stated in the IVPs, it would be considered
significant non-compliance and escalated enforcement action required.

Federal and State pretreatment regulations require the local delegated pretreatment program to
effectively control and document the discharge of wastewater from Significant/Categorical Industrial
Users to the POTW. It is the POTW's responsibility to ensure that these objectives are consistently met.
