Mr. Temple,
The Division of Energy, Mineral, and Land Resources (DELMR), received a complete Stormwater Management Permit
Application for the subject project on June 08, 2017. Staff review of the plans and specifications has determined that the
project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 rules. We are
forwarding Permit No. SW6170603, dated August 07, 2017, for the construction, operation and maintenance of the
subject project and the stormwater system. This permit shall be effective from the date of issuance and shall be subject to
the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required.
The original signed permit package and approved plans are being mailed to Robert Wellons at:

This project will be kept on file after 30 days at the Fayetteville Regional Office. If you have any questions, or need

In response to your email below.
I have enclosed a pdf of the header in question. Please check the information matches the submitted package for the
permit.
There are several large problems with the design of the wet pond as submitted.
1. The pond, as designed, does not have a properly designed outlet structure.
o How would the design be built without crushing the 3” PVC pipe?
o How does the design allow for proper maintenance?
o How could the pipe be cleaned, prevent blockage and backup of the system?
2. Purpose of the emergency spillway is to handle flow outside of the normal design storms. The designed
“emergency spillway” appears to be a secondary outlet for most storms.
o Emergency spillway cannot be used as a control device for the pond.
o This design goes against Recommendation 2 in the Design for Wet Ponds (C-3).
3. The design may operate in a short term erosion control situation but please demonstrate how the design can be
operational and maintained over the long term operation of the site.
4. The design does not have a Trash Rack as required by MDC 10 of the Wet Pond Design to prevent debris of
exiting the system via the pipe or other outlet.

Please refer to the Stormwater Design Manual, particularly A-4 Common Structures and Materials, A-6 Operation and
Maintenance, and C-3 Wet Ponds for Minimum Design Criteria (MDC) and recommendations for the sites wet pond
design.
Please make the corrections to your application and resubmit any revised sheets and pages. Any changes to drawings will
need two copies mailed to our address.

Rick,
There is no outlet structure for the pond other than the 3" outlet orifice & the bypass weir due to the existing ditch
elevation at the outlet point.
I'm not seeing any incorrect header information - can you clarify?

Dear Fleet Temple,
I am in process of reviewing the plans and calculations submitted to us for Middleton Townes. I have noticed a
few things missing or in error for the application
A detail for the outlet structure for the wet pond not shown and is needed
A trash rack detail is missing
Inflow Hydrograph has wrong header information and possible wrong calculations
Check other submitted calculations for consistency.
I will continue with my review. Please mail two copies of revised sheet S-11 with the needed details back to
NCDEQ so I can include it with the stamped plans.
I’ll let you know if I find any other items for comment.
