At some time presumably between 2015 and early 2017, an easement encroachment occurred in
Tract C-1 of the Contentnea Creek / Little Contentnea Creek Parcel (CLCP) mitigation bank.
Though the final annual monitoring reported was submitted to and approved by NC DWR ca.
2012, Greene Environmental Services currently holds the conservation easement as is
negotiating for easement transfer to a land management agency.
At some time during 2015 or 2016, the landowner entered into an agreement with Barnhill
Contracting Company, Ayden, NC to mine sand on a portion of his farm that was not within the
Bank, for road construction uses in the new Greenville Southwest By -Pass. However, to access
the sand mine site, a temporary dirt road was constructed. During construction of this temporary
road, a 0.1 acre portion of Tract C-1 was impacted. Trees approximately 20 to 30 feet in height
were removed and the impacted area was levelled with a bulldozer or similar equipment. Sand
mining was completed in November 2017 and the access road was removed by disking the site
and planting with a grass cover crop.
The acreage affected totaled 0.1 acres (4536 ft2) of nutrient offset easement. Remediation of the
damage done to the site will consist of plant no less than 40 seedlings; 20 will be containerize
(1 -gallon) tree seedlings and the remainder will be bare root seedlings.
Summary of planned remediation activities as per guidelines provided by NC DWR:
• A total of at least 40 seedlings will be planted in the remediation area. Twenty, 1 -gallon,
containerized seedlings will be purchased from Native Roots Nursery of Clinton, NC and
planted in the site, and at least 20 bareroot seedlings obtained from the NC Forest
Services' Claridge Nursery will be planted. Depending on availability, a combination of
containerized species will be obtained including: sycamore (Platanus occidentalis), river
birch (Betula nigra), or similar species. Bareroot species will include persimmon
(Diospyros virginana) and native southern crabapple (Malus angustifolia). Pre -planting
and post -planting photo -documentation will be made. All seedlings will be flagged with
blue, plastic flagging tape.
• A letter has been sent to Barnhill Contracting Company describing the encroachment and
its consequence pertinent to the conservation easement; DWR will receive a copy of the
letter.
• Permanent boundary markers, posts and signage will be installed at the remedial area and
other key locations in Tract C-1.
• All planting and other remedial work will be accomplished no earlier than January 8,
2018 and no later than February 28, 2018.
Upon approval of this adaptive management plan by NC DWR, GES will implement the plan
and notify NC DWR of its completion in the form of a report.

The purpose of this letter is to inform you of a minor conservation easement encroachment on
Tract C-1 of the Contentnea Creek / Little Contentnea Creek Parcel (CLCP) mitigation bank on
the Moye Family Farm south of Scuffleton, NC. Tract C- I's conservation easement is owned by
our company, Greene Environmental Services. This encroachment occurred as the result of
temporary road constructed for access to a sand mining site used to obtain fill material for the
construction of nearby, Greenville SW bypass. The encroachment was inconsistent with Section
2: Resources Uses and Restricted Activities of the CLCP Conservation Easement
In order to repair the damaged area we estimate approximately 40 hardwood trees will have to be
replanted. In addition, easement borders will have to be marked with permanent posts and
signage. A remediation plan (Adaptive Management Plan) has been submitted to the Division of
Water Resources. GES expects to implement the plan with site work in January or February
2018.
We realize the encroachment was not intentional, however, under Section 3: Enforcement and
Remedies, of our recorded conservation easement we are required to repair damage areas even if
minor in nature. Once final costs/repairs have been completed, Greene Environmental Service
will forward an itemized bill for reimbursement of expenses associated with our repair efforts.
Again, we recognize that the damage that occurred was not intentional and did not seriously
damage Tract C-1. If in the future your company is working near one of GES mitigation banking
projects, feel free to give us a call and will assist you in an effort avoid future easement
encroachments.
