Asheville, NC 28801 Marcus Barksdale, The Corps has received (December 15) and reviewed the submitted development plans for the proposed Oakwood Acres Residential Subdivision project off North Clear Creek Road in Hendersonville, Henderson County, NC. The development plans were submitted in response to the Corps requests for additional information e-mailed to Advantage Civil Engineering on July 19, August 9,and December 15. The submitted plans do not provide information which clearly depicts potential jurisdictional waters of the U.S. (WoUS) and does not provide information which shows the limits of jurisdictional WoUS within the planned development. The Corps needs to evaluate all of the development's potential impacts to WoUS in order determine if the project meets the conditions of our NWP program. The Corps has to evaluate all potential impacts to WoUS that would result from all project activities (road construction, installation of utilities, storm water features, clearing and grading, etc.) under our 404(b)(1) Guidelines. The guidelines require that the applicant first avoid impacts to WoUS to the maximum extent practicable. For those impacts that cannot be avoided, impacts must be minimized and compensatory mitigation for those impacts must be provided, if needed. The submitted development plans did not provide the requested additional information to evaluate all of the development's potential impacts to WoUS. Please submit a request for jurisdictional determination (JD) with the required supporting information/data for the parcel. After the JD has been verified by the Corps, you will need to submit a figure which clearly depicts potential jurisdictional WoUS within the limits of the development's project area. All other requested information has been received by the Corps for this project. Please note oversized plan sheets and drawings need to be submitted in 11x17 -inch format. Please copy Andrew Moore with NC Department of Environment Quality, Division of Water Resources and Andrea Leslie with NC Wildlife Resources Commission on your response to this request. At this time, the request to utilize NWP 29 for authorization of impacts to WoUS for this project is on hold until the above noted information is submitted.
