Asheville, NC 28801 Marcus Barksdale, The Corps has received (December 11) and reviewed the revised Pre -Construction Notification (PCN) application and supporting documents for the proposed Oakwood Acres Residential Subdivision project off North Clear Creek Road in Hendersonville, Henderson County, NC. The revised PCN was submitted in response to the Corps requests for additional information e-mailed to Advantage Civil Engineering on July 19 and August 9. The proposed project request utilization of Nationwide Permit (NWP) 29 for authorization of 34 linear feet of permanent stream impacts and 54 linear feet of temporary stream impacts for installation of a culvert for a stream crossing at the entrance of the proposed residential development. After review and evaluation of the revised PCN and supporting documents, the Corps has determined the project, as designed, does not meet the term and conditions of NWP 29. Therefore, the Corps cannot authorize the proposed impacts to WoUS under the requested NWP 29 verification. If this project is to move forward under a NWP 29 verification the following matters need to be addressed. As noted in the Corps' previous two request for additional information, under NWP 29 General Condition 15 the activity must be a single and complete project. The main purpose of the culvert stream crossing is for construction of an entrance road for the proposed residential development. This road is to provide access to the residential development. Because of this, all impacts to waters of the U.S. (WoUS) for the road and any additional impacts to WoUS for residential development need to evaluated in a single permit application. The Corps needs to evaluate all of the development's potential impacts to WoUS in order determine if the project meets the conditions of NWP 29. The resubmitted PCN did not provide the requested additional information to evaluate all of the development's potential impacts to WoUS. Provide an overall plan of the residential development noting layout of lots, roads, utilities, storm water management facilities, and other attendant features. Also, provide a figure clearly depicting potential jurisdictional WoUS within the limits of the development's project area. Please copy Andrew Moore with NC Department of Environment Quality, Division of Water Resources and Andrea Leslie with NC Wildlife Resources Commission on your response to this request. At this time, the request to utilize NWP 29 for authorization of impacts to WoUS for this project is on hold until the above noted information is submitted.
