Snell, William H Subject: RE: U-2524C Outlet Ditch from Hazardous Spil) Basin (Site 10) Jerry, According to the original stream determination letter regarding U-2524C dated October 15, 2012, Jordan Buffer Rules are not applicable to this project due to the project reaching concurrence point 4A prior to Jordan Buffer Rules implementation. Because buffer rules do not apply, NCDWR finds your request acceptable. Please keep in mind that if any new impacts occur within the stream, buffer rules will apply. One is showing the original permit plans for the 2' base ditch at Site 10 and the other is describing how NCDOT is proposing to construct the ditch with Class B riprap in the base of the ditch with Geotextile along the banks and tied into the stream with coir fiber matting and riprap (See Detail U). NCDOT feels that this is necessary because of the anticipated high volume of water that will outlet out of the Hazardous Spill Basin. It is feared that without the riprap in the base of the ditch, NCDOT will face recurring maintenance problems due to bank destabilization and sediment loss combined with the difficulty and damage associated with accessing the site. No additional impacts are proposed within the jurisdictional stream. Since only buffer impacts are anticipated within an already permitted 2' base ditch, we are requesting that this work be performed under an infield modification from DWR. Please let me know if you have any questions and if you concur with our proposed plans.
