LCD Acquisitions, LLC is proposing to develop the approximately 19.0 -acre Station at Raleigh Site within a two -parcel property assemblage (the "Site") primarily used for event parking associated with Carter -Finley Stadium and the North Carolina State Fairgrounds. The northern and northeastern portions of the Site are forested and undeveloped. The proposed multifamily residential development will consist of multifamily residential buildings, parking lots, internal feeder roads and sidewalks, stormwater control measures (SCMs), open space areas, and landscaping. The project area was delineated by Kimley-Horn staff in March 2017 and a Preliminary Jurisdictional Determination (JD) was issued by the US Army Corps of Engineers (USACE) in May 2017. Documentation is currently pending (Action ID: SAW -2017-00623). The NC Division of Water Resources (NCDW R) issued a Buffer Determination Letter for the Site on March 28, 2017 (NBRRO #17-088). One perennial stream (S1) is located within the Site, beginning offsite to the east and crossing through the northern forested portion of the Site. Stream S1 will be permanently impacted in two locations by the construction of a new road crossing to provide access into the property from Westchase Boulevard, and a second City of Raleigh -required stub road in the northeastern corner of the property necessary to provide access to the adjacent property parcel. The proposed crossings will impact a total of 280 LF of stream between the two crossings (134 LF Site 1, 146 LF Site 2) due to culvert installation, and an additional 10 LF of outlet protection will be keyed into the stream banks downstream of Site 1 to stabilize the culvert outlet and prevent downstream receiving water impacts. To allow for construction access during culvert construction, 53 LF of temporary disturbance are also proposed as part of this application. Kimley»>Horn Page 2 Impact Site 1 is the primary entrance and exit road into the property, carrying traffic from Westchase Boulevard and Trinity Road. Riprap stabilization will be utilized for outlet protection at Site 1 and will be keyed into the bank during installation so no permanent loss of waters will result. Site 2 is a secondary parallel road that terminates as a stub road in the northeastern corner of the property. This road is a required connection by the City of Raleigh as a condition of site plan approval due to the project's location within a planned urban development district (a "block layout" district). The road alignment continues from the Station at Raleigh development to northern property boundary, and provides clear and logical connections from the adjacent property to the interior road network being constructed by the proposed project. The secondary road terminates at a stub street at a high ground area at the property boundary, and ample high ground is available on the adjacent property to construct any City of Raleigh -required road corridors on the adjacent parcel independent of the Station at Raleigh project without additional environmental impacts. Temporary impacts to S1 will also occur at Site 1 and Site 2 due to temporary dewatering activities needed to facilitate construction access in the stream bed for the culvert construction/installation at the crossings. All temporary disturbance areas will be returned to pre -construction contours after completion of the project. Unavoidable impacts to the protected riparian buffer associated with stream S1 (UT to Richlands Creek) will result from the proposed construction of a main north -south connector road between Westchase Boulevard to the north and Trinity Road to the south (Site 1). A second road crossing will result from the proposed project in the northeastern corner of the Site due to the project's location within a City of Raleigh urban development block district (Site 2). A third impact site will result from the construction of a stormwater management pond outfall through the buffer (Site 3). All riprap protection associated with Site 3 will stop at or before the stream top of bank to prevent additional stream impacts to S1. Impacts associated with the road crossings at Site 1 and Site 2 impact less than 150 LF and 1/3rd of an acre of riparian buffer and are considered "Allowable". Impacts associated with the new drainage conveyance carrying stormwater from a constructed BMP at Site 3 is considered "Allowable" since the BMP provides nutrient treatment and attenuates flow. To offset for the unavoidable stream impacts proposed, mitigation has been secured with the NC Division of Mitigation Services' (NCDMS) In -Lieu Fee (ILF) payment program. Mitigation has been proposed for impacts to S1 at a 2:1 ratio. The NCDMS ILF Acceptance Letter documenting approval for up to 280 LF of stream impact mitigation is included as part of this PCN application package. All riprap protection at Site 3 will stop at or before top of bank to prevent stream impacts to S1. D. Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Impacts to the streams and buffers within the project corridor were minimized to the extent practical. Stream impacts were minimized by aligning the road crossing to be as close to perpendicular crossing over S1 as possible at the crossing locations. Headwalls have also been utilized in the design to allow narrower fill slopes and minimize the culvert length and impacts to S1. Stream S1 crosses the entire property along the northern boundary, preventing any access to Westchase Boulevard without a stream impact. The stream crossings were selected to utilize perpendicular crossings with minimal buffer impact. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Impacts to streams and buffers within the corridor will be minimized to the extent practical throughout the construction process by avoiding stream and buffer features whenever possible. Where feasible, staging and construction access routes will be located in upland areas throughout the corridor. Silt fencing, sediment basins, and other Stormwater Control Measures (SCMs) will be used throughout the construction process to minimize impacts to downstream receiving waters and minimize runoff from the construction sites. 2. Habitat is not present for red - cockaded woodpecker due to the lack of mature pines and historic development within this area resulting in successional forests. Suitable habitat is also not present for dwarf wedgemussel due to the low -flow, encised, and rocky nature of stream S1. Incidental take of Northern long-eared bat (NLEB) is prohibited if it occurs within a hibernaculum, or if it results from tree removal activities within 0.25 mile of a known hibernaculum or the activity jeopardizes a known maternity roost tree or trees within a 150 -foot radius of the maternity roost tree. Per the NC Natural Heritage Program Element Occurrence Database (updated October 2017), there are no known occurrences of NLEB, hibernaculums, or roost trees within 1.0 mile of the project area. Due to the lack of known occurrences within the study area and the lack of suitable habitat within the study area, the proposed project is not anticipated to have any effect on any federally listed threatened or endangered species. The project area (Site) lies east of Carter -Finley Stadium and north of the North Carolina State Fairgrounds in Raleigh, and is used for event parking during Stadium and Fairgrounds events. Kimley-Horn is requesting your review of the project in advance of a federal Section 404/401 Nationwide Permit #39 that will likely be required for the development of the Trinity Road Site. The federal permit will likely be applied for under the Clean Water Act for unavoidable impacts to stream features within the project area, and Kimley-Horn is requesting this review due to the presence of a previously surveyed structure in the project area. Figures and updated site photos have been included with this request, as well as a copy of the NC SHPO's previous documentation on the structure. LCD Acquisitions, LLC is proposing to construct a multi -family development project within a larger urbanized area adjacent to Carter -Finley Stadium and the North Carolina State Fairgrounds. The 19 - acre Site consists of primarily cleared and frequently maintained land used for parking during stadium and fairground events. Approximately 13.5 acres of the Site are cleared and maintained. The remaining 5.5 acres of the Site are forested, and a stream runs through the northern portion of the property draining offsite. During an initial Site review on March 8, 2017 and a subsequent review on June 20, 2017, three structures were identified within the Site. The main structure within the property is an abandoned residence approximately located in the center of the property. This structure has been previously identified and surveyed in 1989, but is not listed on the National Register (NR) or NR Study List (SL). The structure appears in the NCSHPO database as the Medlin House and is designated as site WA0945. In addition to the Medlin House, a collapsed shed was located behind the house, and a family cemetary is located along the eastern property line northeast of the house. Within the northern forested portion of the Site, a relic concrete foundation was also identified, observed with mature trees growing inside the foundartion and against the remnant foundation walls. A review of the NCSHPO HPOWEB GIS database was conducted on June 21, 2017. No NR or SL locations were identified within the Site, but the Medlin House (WA0945) is shown within the Site. Two NR sites are located within a 1.0 -mile radius of the Site, the J.S. Dorton Arena (WA0012) and the NC State Fair Commercial and Educational Buildings (WA0202). These locations are associated with the NC State Fairgrounds, and are approximately 1,500 feet south of the Site. Due to the project's location within the central area of Raleigh, a total of 41 other known properties are within a Kimley»>Horn Page 2 1.0 -mile radius of the Site. These properties include three determined eligible (DOE) locations and one DOE historic district, nine building foundations, and 29 surveyed areas, landmarks, and/or sites. A review of the 1989 survey report of the Medlin House indicates that the house was originally built in the 1930s as a single-family home and has been through multiple additions and improvements over the years. The report further states that the chimneys have been replaced and the front porch is a relatively recent addition/replacement. The house is currently abandoned and is in a state of substantial disrepair compared to the 1989 photos. All lower doors and windows have been boarded up, exposed windows were found to be broken, and significant water damage was observed in many areas around the structure. The front porch has collapsed, and multiple holes were observed in the siding and walls of the structure. The grounds are heavily disturbed and are frequently used for parking during stadium and fairground events, subjecting the grounds to heavy traffic and frequent maintenance. The family cemetery was found enclosed by a fence, but has not been recently maintained. Three possible grave markers were visible, but the area is overgrown with vegetation so it was unclear during the site investigation how many grave sites are located within the cemetery. The proposed project would construct a multi -family development with associated parking, roads, and stormwater facilities. The proposed project would disturb the entire Site footprint. The Medlin House would be demolished as part of the project, and LCD Acquisitions, LLC is currently coordinating with an archaeological subconsultant to further investigate and document the gravesites, and investigate development and/or relocation options with respect to the cemetery grounds and proposed land use. While the Medlin House was built in the 1930s, the history of improvements and additions to the structure coupled with the current use of the property for parking mean that this property does not represent a substantial historical resource for this area. Additionally, the state of substantial disrepair of the house and the two other structures on the property further subtract from any potential historical value. As previously discussed, the known cemetery site will be further evaluated before any disturbance is proposed. Based on these factors, it is anticipated that the demolition of the structures and proposed development will fit within the urban landscape of the surrounding area of Raleigh.
