North Cazolina Department of Transportation (NCDOT) Project Development and Environmental Analysis Natural Environment Section Head 1598 Mail Service Center Raleigh NC 27699-1598 Deaz Mr. Harris: Reference the Department of the Army permit issued to the North Carolina Department of Transportation (NCDOT) on Mazch 24, 2014, to authorize the discharge of fill material into waters of the United States, for construction of TIP No. U-0071; East End Connector; from US 147 between Ellis Road and Briggs Avenue, to NC 98 at US 70, in Durham County, North Carolina. Also, please reference the May 7, 2015, December 7, 2015, and May 17, 2016 modifications of the pernut, your November 3, 20171etter, requesting modification of the permit for a net increase of permanent riprap bank stabilization impacts to streams of 121ineaz feet, a net decrease of temporary impact to streams of 161inear feet, and a net increase of wetland mechanized clearing impacts of 0.02 acre, and the revised permit drawing sheet no. 74 of 91, submitted by email on November 8, 2017. These changes in impacts result from observation of actual site topography and stability conditions, and necessary construction access, and sediment and erosion control. No additional stream or wetland mitigation is proposed, since no additional permanent stream or wetland loss is proposed. We have reviewed the requested modification, and deternuned that it is appropriate and reasonable, and that no public notice is required for this modification. Therefore, the permit is hereby modified to authorize a net increase of temporary impacts to streams of 16 lineaz feet, a net increase of permanent impacts to streams of 121ineaz feet, and a net increase of wetland impacts of 0.02 acre, as shown on the enclosed Permit Drawings, Sheets 20, 21, 43, 44, 75, 90, and91,of91. All other conditions of the pernut, including the expiration date of December 31, 2019, and the modified mitigation requirements, remain applicable.
