TROGDON, III SECRETARY SUBJECT: Application for Section 404 General Permit No. 198200031 and Section 401 Water Quality Certification for the new interchange at Interstate 85 (I-85) and SR 1221 (Old Beatty Ford Road Relocation), Rowan County, Division 9. Federal Aid Project No. NHIMF-085-2(61)55, TIP Project No. I-3804. Debit $570.00 from WBS 38708.1.1 Dear Sir: The North Carolina Department of Transportation (NCDOT) proposes to construct a new interchange at I-85 and SR 1221 (Old Beatty Ford Road Relocation) in Rowan County. This project will be constructed concurrently with the I-3802B project which is underway. The I-3804 interchange project occurs at the location of the Old Beatty Ford Road Relocation project (TIP W-5516) which was previously permitted in 2015. In addition, a roundabout will be added at the intersection of Old Beatty Ford Road relocation and China Grove Road west of the new interchange; however there are no proposed impacts with the roundabout. There will be 359 linear feet of permanent stream impact and 90 linear feet of temporary stream impact associated with construction of the project. There will also be 73 linear feet of impact due to permanent bank stabilization. No impacts to wetlands are anticipated for the project. Please find enclosed the Pre-Construction Notification, Stormwater Management Plan, pertnit drawings, roadway plans, Culvert Survey Report, and Division of Mitigation Services letter. A Categorical Exclusion (CE) was completed for this project in April 2017. Additional copies are available upon request. The let date for this project was February 25, 2016. Final completion is anticipated in December 2019. NCDOT has deternuned that the proposed action does not require separate consultation for the NLEB on the grounds that the proposed action is consistent with the fmal Section 4(d) rule, codified at 50 C.F.R. § 17.40(0) and effective February 16, 2016. NCDOT may presume its determination is informed by best available information and consider Section 7 responsibilities fulfilled for NLEB. Potential suitable habitat for Schweinitz's sunflower is present in the project study area along roadsides, residential areas, field edges, maintained utility rights of way, old pastures, and open gap areas in woodlands. Past plant surveys in 2013, on October 16, 2014, and October 26, 2016 resulted in no Schweinitz's sunflowers being observed. The proposed project would have No Effect on the Schweinitz's sunflower. It has been deternuned that this project would not affect bald eagles due to the lack of habitat, the lack of known occurrences, and past surveys as detailed in the November 2016 NRTR. Cultural Resources There are no historic properties present or affected by this project. An archaeological survey was not required as the project did not extend outside of the Area of Potential Effects. Permit Impact Sites Permit Impact Sites 1, 2, and 5 are all bank stabilization impacts along Cold Water Creek. A bridge will span Cold Water Creek at Sta. 15+24 near Permit Site 2. Permit Site 3 is installation of a triple 12x12-foot reinforced concrete box culvert (RCBC) on Cold Water Creek. The RCBC will have a 2-foot sill in the left barrel of the culvert and the center and right barrels will have 1- foot sills. Native bed material shall be placed between the sills in the low flow culvert. Native materials consists of material that is excavated from the stream bed or floodplain at the project site during culvert construction. Rip rap may be used to supplement the native material. If rip rap is used, native material should be placed on top to facilitate animal passage. The top surface of the natural stream bed material shall be placed and leveled to a flat surface to allow for animal passage. The high flow barrels shall be back filled with native material and/or rip rap. Native material and rip rap are subject to approval by the engineer and may be subject to permit conditions. Permit Site 4 is extension of the existing 6x6-foot single barrel box culvert. This extension can not be buried and will have bank stabilization at the outlet. There are no additional impacts associated with the roundabout at the intersection of Old Beatty Ford Road relocation and China Grove Road A copy of this permit application will be posted on the NCDOT Website at https://connect.ncdot.gov/resources/Environmental/Pages/default.aspx, under Quick Links > Permit Applications.
