On August 25, 2017, the North Carolina Department of Environmental Quality (DEQ) notified
Duke of its position related to the establishment of compliance boundaries and instructions on how
to establish these boundaries for the 14 coal ash facilities. On October 19, 2017, the DEQ sent a
letter stating that Duke Energy could submit the current maps showing the location of the
compliance boundaries for each facility with the updated Comprehensive Site Assessment Reports.
In order to facilitate drafting of the NPDES permits, the DEQ requires Duke Energy to provide
updated compliance boundary maps at least 30 days prior to completion of the draft NPDES permit
for DEQ review and prior to that permit going out to public notice. Please contact the DEQ Water
Quality Permitting Section, speciiically the NPDES permit staff responsible for review of a
specific application, to establish the date by which the map should be submitted. These maps
should follow the instructions provided by DEQ in the August 25, 2017 letter. Please note the
NPDES permit application will not be considered complete until such time as an appropriate map
has been submitted and approved by the DEQ for inclusion into the permit.
DEQ requests updated compliance boundary maps for the Marshall Steam Station, Allen Steam
Station, and James E. Rogers Energy Complex (Cliffside) immediately for review and approval
before inclusion in the final draft NPDES permit. Please submit the maps for the Allen Steam
Station and James E. Rogers Energy Complex by January 15, 2018.
