Please reference our letter to you, dated September 28, 2017, regarding non-compliance with
the terms and conditions of the Department of Army (DA) Individual Permit, dated April 4,
2016, for permanent impacts to an Unnamed Tributary to West Fork Deep River and adjacent
wetlands, for phase II of Triad Business Park, in Kernersville, Guilford County, North Carolina.
Please also reference our follow-up e-mail to you, dated November 6, 2017.
On October 5, 2017, November 3, 2017, and December 8, 2017, we received written
responses to our letter from your agent, Mr. Brad Luckey of Pilot Environmental, Inc., which
included itemized comments addressing our requirements and a stream and wetland restoration
plan. Upon review of this correspondence and the ensuing administrative record, we determine
that you satisfactorily completed the following requirements:
1) You provided an explanation for the several items of non-compliance with the terms and
conditions of the subject DA authorization, and included a proposal to prevent further
non-compliance;
2) Per requirement A, you provided an as -built survey of the current fill limits, including
comparisons of permitted versus existing stream and wetland impacts;
3) Per requirement B, you provided a plan to achieve continued stability of the stream
channel above the constructed culvert, while maintaining aquatic function, using natural
channel design principles;
4) Per requirement C, you provided information related to the temporal impacts to the
dewatered stream channel downstream of the construction area, and successfully justified
a negligible loss of aquatic function based on aquatic macroinvertebrate sampling;

5) Per. requirement D, ,you provided a written plan for resolving non-compliance with
Special Conditions 1 and 2 of the subject DA authorization. Generally, your plan includes
restoration of impacts to streams and wetlands, authorized as temporary- =impacts by the.
DA Individual Permit,, as well as unauthorized_impacts to streams and wetlands. This
proposal is detailed in.your revised stream and wetland restoration. plan (Plan) submitted
via e-mail on December 8, 2017, specifically plansheets C1.1, C 1.2, C;L.3, CIA, and,
C 1..5.
The Corps is amenable to your requestto authorize changes in the permitted plans from
those referenced DA Individual Permit Special Condition :1)„ to those, shown ;in the
"Proposed vs Approved Changes" drawing on plansheet C1.1 and all drawings on
plansheet C 1.4. However, please note that such after -the -fact permit modifications are
contingent on successful completion of temporary stream and wetland impact, restoration
per approved plans.
Thecproposed Plan,copy, enclosed for your reference; is ,approved as submitted' with the
following clarifications:
i) Contrary to item 14 listed on the Restoration Construction Sequence on plansheets C1.2
and C 1.3, backfilling or pre -charging the culvert- with sediment is not necessary;
ii) Stream restoration grading, structure: installation, stabilization, and planting must be
complete within 60 days of the date of this correspondence. Wetland restoration grading,
stabilization, and planting must be complete no later than. April 30, 2018. Any requests to
alter the completion timeframes forthe stream and wetland restoration activities are
subject to approval from U.S. Army Corps of Engineers, Wilmington District, Raleigh
Regulatory Field Office (Corps); such requests must be sent in writing including
justification ihat;meeting such timeframes is not ;practicable;
iii) Monitoring of the stream and wetland restoration areas is required per -the monitoring
plan °submitted in your November 3, 2017 letter. Note, however, that such monitoring
efforts are required annually for 5 years following, post -construction confirmation from
the Corps°that the stream and wetland restoration workrwas completed according -to the
approved plan. The monitoring requirement can be ended prior to 5: years: upon your
request, subject to Corps approval, that the restoration trajectory is, acceptable and that
subsequent monitoring is unnecessary; such Corps approval is dependent upon stability
.of the stream channel and associated structures, hydric soils and hydrology, and survival
of the planted species;
iv) Fo'llowing`-the _monitoring period, in the event that the strearn and/or wetland restoration
areas are not.successful, including instability of the soils or stream channel, loss of
jurisdictional status in terms of hydric soils, wetland hydrology; hydrophytic vegetation,

or indicators of ordinary high water marks, the Corps may take further enforcement
action. Such action may include contingencies such as requirements to, purchase stream
and/or wetland credits from mitigation banks with available credits in the appropriate
service.area�or the North CarolinaDivision of Mitigation Services.
v) The Corps agrees with your proposal to amend the recorded Conservation Areas. These
amendments must include within the Conservation Areas all.restored wetland and stream
areas, except narrow access corridors on either side of the crossing -where future culvert
or roadway maintenance may necessitate site access. A draft amended Conservation
Areas map .and associated recordable language must be submitted to the Corps for
approval within 30 -days of completion of the wetland and stream restoration work:
Within 30 days of Corps approval, the -amended conservation area map and associated
recordable language must be recorded byGuilford County and a, copy provided to the
Corps.
We stronglyrecommend your prompt attention.in completing the required restoration plan.
Please be aware that your compliance with this directive does, not foreclose: the Department of
the Army's option to initiate additional appropriate legal action including ,pursuing a Class'I
Administrative Penalty'undetlhe.author ty of 33 U S.C. § 13.19(g) and.3:3: CFR.Part 326.6or
referral to the U' nited States Attorney or the United States Environmental'Protection Agencywith
arecommendation for civil action.
