The jurisdictional determination request for this project has been submitted to the Corps (Cathy). Alan Johnson conducted a site visit on December 7, 2017. No revisions were made to the jurisdictional determination map during the site meeting last week as Alan agreed with our delineation. The property has a newly constructed building on site. This building had to be constructed and have a certificate of occupancy issued by July 2017 in order to be a tax free exchange from a property that Mrs. Godley sold in December 2016 in Salisbury. KB Godley IV LLC is in the process of securing a lease for a 200,000 square foot tenant. This tenant requires a fenced and lighted trailer parking area. The likely tenant for the additional 100,000 square feet also requires another trailer parking. The application includes requests for a total of 63 linear feet of intermittent stream impact and 0.107 acre of wetland impact. Impact S1 is for 63 linear feet of intermittent stream impact for culvert installation for a dedicated trailer parking lot. Wetland impact W1 is for 0.006 acre and W2 is for 0.101 acre also requested to construct the same dedicated trailer parking lot. Impacts are requested to all streams and wetlands but are still minimal (less than 65 linear feet of stream impact and just over 0.10 acre of wetland impact). Both of the tenants that KB Godley IV LLC is in negotiation with for leases are national 3PL's that are involved in high volume logistics, quick inventory turns, and lots of tractor/trailer traffic. The market for warehousing is being dominated by 3PL businesses due to the economy and nature of the Dodd Frank laws as well as the advent of driverless tractors that require secured, unmanned lots for 24 hour staging. 3PL's are third party logistics companies that have been around for a number of years to provide out sourcing of warehousing (included refrigerated) storage, packaging services, and trucking to companies instead of the company leasing a warehouse and providing those services with their own employees. Most 3PL's lease warehouses, but there are quite a few that own their own warehouses and blend their customer's goods into the warehouses. Dodd Frank Act was passed in 2010 as both a Consumer Protection action as well as limiting the ability of Wall Street and the operation of the banks to encounter the "too big to fail" syndrome from 2008 as far as commercial mortgage lending, Dodd Frank Act phased in very stringent provisions for borrowings for real estate as well as business loans. The phase in of the Dodd Frank Act in the last few years mandates that companies are to recognize any leases for their buildings, warehouses, and other rental properties that the term is in excess of 12 months as a contingent liability on their financial statement for the full amounts of all rentals which dramatically and adverserly affects their ability to borrow additional capital and expand their businesses. The other compelling factor for developers and landlords is that the banks will set the term of owner's real estate loans to the term of our tenant's leases. Therefore, companies only want to sign a one year lease and with that short term the warehouse owner cannot borrow money with only 12 months of guaranteed rental under the lease. Due to this, 3PL business has skyrocketed. These companies take the lease for 3-5 years and then shuffle, combine, and mix their customer's needs around the warehouses that they have leased in proximity to their customers' plants. The 3PL concept results in more freight in and out per day and much more necessity to stage both empy and full trailers. The rapid surge of autonomous trucking for non -hazardous freight is already happening and that requires a 24 hour yard where a trailer can be dropped and an empty trailer picked up without human intervention. The full and empty trailers are then manipulated by 3PL employees utilizing "yard jockeys" or switchers, which are off road mini tractors. There are several lots for sale across Murdock Road beside the Iredell County fairgrounds that are available for highway/business and industrial development. The price of these lots make them cost prohibitive for use as a trailer parking lot. In addition the trailer parking lots need to be located within the property for the reasons mentioned above about moving the trailers (switchers operation does not require a CDL as long as it stays on private property) An employee without a CDL is much more cost effective than one with a CDL. Someone with a CDL would likely not accept a position to drive a switcher because they would be able to be an over the road driver and have much higher compensation. KB Godley IV LLC bought the subject parcel as well as the adjacent parcel in 1999. The Town of Trouman approached Mrs. Godley about developing the parcels as heavy industrial as part of their long term plan. The adjacent parcel that is also owned by KB Godley IV LLC is already developed.
