Swift Creek Sanitary Sewer Project that was submitted for review on January 13 2009.

Dear Mr. Burkhardt:
Thank you for your December 24, 2008 letter regarding the proposed sanitary sewer line
along Swift Creek from the Indian Creek Mobile Home Park wastewater treatment plant to
NC 50 south of Garner in Wake County, North Carolina. The purpose of this sewer line is to
collect and pump sewage from the Indian Creek Mobile Dome Park into the City of
Raleigh's waste water treatment system and take the existing package plant offline, thereby
eliminating effluent from the plant going into Swift Creek. This letter provides the U.S. Fish
and Wildlife Service's (Service) response pursuant to section 7 of the Endangered Species
Act, as amended (16 U.S.C. 1531 et seq.) (Act).
I understand that Dale Suiter of my staff met with you today to look at the proposed
alignment and two small stream crossings. Based on the observations made during the site
visit and information that you provided related to the project alignment and the erosion
control plan, it appears that your project is not likely to adversely affect the federally
endangered dwarf wedgemussel (Alasmidonta heterodon)_ While this species occurs nearby
in Swift Creek, the proposed project will not have any direct impacts to Swift Creek.
Further, upon completion, effluent from the existing package plant will no longer go into
Swift Creek which will likely provide some water quality benefits to that stream.
We believe that the requirements of section 7(a)(2) of the Act have been satisfied. We
remind you that obligations under section 7 consultation must be reconsidered if. (1) new
information reveals impacts of this identified action that may affect listed species or critical
habitat in a manner not previously considered; (2) this action is subsequently modified in a
manner that was not considered in this review; or, (3) a new species is listed or critical
habitat determined that may be affected by the identified action.
