PROJECT SUMMARY: The applicant proposes to construct a private pier and docking facility capable of accommodating of up to three (3) vessels. PROJECT DESCRIPTION The applicant's property is located at 709 Shoreline Dr. W., adjacent to the AIWW in the town of Sunset Beach, Brunswick County. Directions from Highway 17 south of Shallotte: Turn Left onto Seaside Rd. SW/NC-904 and travel approximately 3.60 miles. Turn right onto Sunset Blvd N/NC -179 Bus and travel approximately 1.25 miles. The project site will be located on the left hand side of the street. The project site measures approximately 1.5 acres in area and is currently developed with a single family residence. The property has approximately 91 feet of shoreline frontage and maintains an elevation approximately 12.8' above Normal High Water (NHW). High ground vegetation consists mainly of hardwoods including live oaks, pines, and red cedar as well as natural shrubs and herbaceous vegetation. Coastal wetlands consisting primarily of Smooth Cord Grass (Spartina alterniflora) extend waterward approximately 550' waterward of the NHW mark. The waters of the AIWW are classified SA; HQW by the Division of Water Resources and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to construct a private pier and docking facility capable of accommodating of up to three (3) vessels. The proposed project would consist of a pier measuring approximately 6' in width by 636.5' in length, which would span an area of Coastal Wetlands measuring approximately 550' in width. The pier would terminate at a fixed platform ("Fixed Pierhead 2") measuring approximately 17' in width by 13' in length (See Figure No. 6). A finger pier measuring approximately 3' in width by 12' in length is proposed to extend off the northeast corner of the platform and run parallel to the shoreline. A second finger pier, measuring approximately 3' in width by 25' in length is proposed to extend off the southeast corner of the fixed platform and run perpendicular to the shoreline, providing access to the two (2) proposed boatlifts. As proposed, Boatlift #1 would measure approximately I F in width by 20' in length. Boatlift #2 would measure approximately 13.5' in width by 20' in length and would abut the 15' Adjacent Riparian Corridor Setback to the east. A third fixed finger pier measuring approximately 3' in width by 13' in length is proposed to extend off the southwest corner of the fixed platform and run parallel to the shoreline, terminating approximately 3' from the adjacent riparian line to the west, for which the adjacent property owner (Lide) has waived for the proposed encroachment into the 15' setback. A second, partially covered, fixed platform ("Fixed Pierhead 1") is proposed to extend waterward off the southwest corner of "Fixed Pierhead 2". "Fixed Pierhead 1" is proposed to measure approximately 10' in width by 25' in length and would contain a roof covered section measuring approximately 7' in width by 14' in length. A proposed floating platform aligned perpendicular to the waterway is proposed to extend off the westernmost finger pier and would measure approximately 6' in width by 16' in length, providing an additional slip for docking, for a total of 3 slips proposed for the facility. The proposed floating platform would also encroach into the 15' adjacent riparian corridor setback to the west, for which a waiver has been obtained by the adjacent property owner to the west (Lide). Pratt & Nfiller c/o Southern Palmetto Environmental Consulting, LLC Page Three According to the application, water depths in the vicinity of the proposed slips range from approximately -2 to -3' @ Mean Low Water (MLW). The proposed docking facility would extend a total distance of approximately 130' into a water body measuring approximately 525' in width. As proposed, this distance would conform to the 1/4 width rule and would not exceed the U.S. Army Corps of Engineers 80' Federal Channel Setback. The docking facility, as proposed would not exceed the established pier head line between docking facilities located at 811 Shoreline Dr. W and 701 Shoreline Dr. W. The proposed new docking facility would meet an established pier -head line for piers that have similar use but would exceed the directly adjacent piers to east and west. 11. ANTICIPATED IMPACTS The proposed docking facility would incorporate approximately 1,831 sq. ft. of Estuarine and Public Trust Area and would shade approximately 3,300 sq. ft. of Coastal Wetlands. Minor increases in turbidity should be expected during construction. The proposed configuration of the docking facility would provide docking space for three (3) vessels in water depths ranging from approximately 2' to 3' @ MLW. Division of Coastal Management 127 Cardinal Drive Extension Wilmington, North Carolina 28405-3545 Subject: Major Permit Application for Proposed Residential Dock Facility 709 Shoreline Drive Dock Brunswick County Parcel ID# 255LA007 Sunset Beach, Brunswick County, North Carolina Ms. Wilson: We have prepared a complete application package in order to provide a residential docking facility for Mr. James Pratt and Ms. Beverly Miller of 709 Shoreline Drive in Sunset Beach, North Carolina. This application package is considered complete and it contains all of the pertinent information required in order for your office to approve these proposed actions. The following narrative explains the history, our approach, purpose, and need as well as any applicable agency oversight during this development process. Background The project site is located along the banks of the Atlantic Intracoastal Waterway (ICW) in Brunswick County. The applicants wish to construct a residential docking facility and since adequate water depth and the edge of marsh was greater than 400 feet from their upland shoreline, the need for a CAMA Major Permit was determined. The applicant's riparian rights extends well into the ICW and adequate water depths have been discovered between the edge of marsh and the federal channel setback. In addition, there are several docks within the area several lots over from each side of the applicant's property line and the proposed dock will conform to these surrounding structures with respect to size, shape, boat storage capacity, and distance from the shoreline. Since the project area is located within designated primary nursery area, no dredging is planned. All proposed docking structures were designed based on a recent riparian survey completed by Registered Surveyor, Rick Thompkins of Thompkins Surveying of Ocean Isle Beach in 2016. All depths and property markers illustrated on the attached drawings were identified by Thompkins Surveying. V 2 1 P a g e Description of Proposed Structures The applicant(s) intend to construct a residential docking facility for their family and their guests. Construct a residential docking facility for personal/private use with three slips and with a proposed walkway of greater than 400 feet. Specifically, the applicant proposed to build a 636.5 -foot walkway from the property owners upland area to a fixed, partially covered pierhead (10ft.x 25ft.) with two boat lifts (1-13.5ft.x 20ft. & I-11ft.x 20ft.) and one floating dock (6ftx16ft).Additionally an access ramp (3f.tx16ft.) and three finger piers will be constructed to access all components. Since the applicant's shoreline is 91 feet wide, regulations allow for 8 square feet per foot or 728 square feet. The current design less gangway and boat lifts is 721 square feet that is less than the maximum square footage of 728 square feet. Additionally, the walkway and its fixed structures will be elevated four feet above normal high water to prevent any access, small craft navigation, and tidal flow issues down below. The elevation of the proposed dock height was designed to be similar to the nearby dock to the south at 715 Shoreline Drive. Regulatory Coordination Prior to submitting this package, SPE contacted Sean Farrell on multiple occasions in August 2017 to discuss the proposed dock plan and to review our preliminary drawings. Mr. Farrell provided crucial comments, direction, and all necessary forms to be able to submit this package. The included package is a result of the multiple conversations and correspondence concerning this project during August 2017. Adiacent Landowner Official Notification When any development activity along the riparian corridor is proposed, the adjacent riparian property owners must be notified and given the opportunity to comment. The landowner's riparian area is determined by a vector extending perpendicularly from the ICW channel centerline to the common property corner along the water -ward boundary of the subject properties. And the riparian area was identified by Thompkins Surveying in 2016. These lines were drawn on the plans from the most recent survey to determine the distances the proposed structures are to these riparian area designations. Adjacent landowners are Clara Moorman of Fayetteville, North Carolina and Dr. Lanneau Lide of Columbia, South Carolina. Dr. Lanneau Lide was sent a waiver form and the signed waiver is attached. Since the dock is greater or equal to 15 foot from her shared riparian line, Clara Moorman was mailed a certified mailing announcing the design and plans that contained the application package including the drawings and locations of the proposed structures for review. The additional length of docking structure was required to access deep water docking. Every attempt has been made to add functionality and to protect the environmental resources of which these structures are to be placed.
