CAMA Major Modification- Project Narrative
Existing Conditions
The Pelican Marina is a 0.65 Acre (28,475 square feet) parcel of land located along US
Highway 158 West on the Camden Causeway along the Pasquotank River. The property is
predominantly covered with gravel and concrete with some areas of maintained grasses. The
site falls within the Elizabeth City city limits on the Camden Causeway. The property owners
Niels and Melissa Jensen received a CAMA Major permit (#40-17) on March 31, 2017 for
enhancement and repair of the Marina. Modifications to the existing permit are proposed and
detailed below and on the attached plans.
Proposed Work
Currently proposed work requiring a modification to CAMA Major permit #40-17 includes the
relocation of the permitted fueling facility from the end of the existing western most pier to a
proposed floating pier adjacent to the existing structure and boat ramp. The proposed floating
dock will be 53 -feet -long by 10.2 -feet -wide with a 23 -feet -long by 6.3 -feet -wide platform,
accessed by a 15 -feet -long by four -feet -wide metal gangway.
Septic pump out facilities and fuel will be available on the proposed floating dock. The new fuel
dock location requires the permitted Above Ground Storage Tanks (ASTs), to be moved from
the west side of the property to the new proposed fuel dock locations, as shown in blue on the
attached plan. Full specifications of the proposed floating dock and ASTs can be found in
Attachment A.
Relocation of the permitted AST location requires that the permitted boat ramp location move
west as shown on the attached Site Plan. The boat ramp shift will also affect the surrounding
wood walk way and bulkhead alignment. The permitted 778 square feet decking around the
existing structure will be modified to fit with the new boat ramp and fuel dock alignment, adding
an extra 205 square feet (983 total square feet) and squaring the shape of the permitted deck.
The existing western most pier, where the fueling facility was originally permitted, will be
reconfigured with six (6) 50 -feet -long by 20 -feet -wide slips with three 10 -feet -long by four -feet -
long floating finger piers and associated tie pilings. One "side to" slip is being added to the
platform of the proposed floating fuel dock to keep the existing slip count at 62.
The owner also proposes to add four (4) eight -feet -long by three -feet -wide fixed finger piers and
11 feet long by 2.5 feet long extension to the west side deck of the marina building to serve the
exiting four slips. All proposed modifications are shown on the updated CAMA Plan. In addition,
and as requested a color contrast plan showing existing, permitted, and proposed
improvements has been provided for convenience.
Purpose and Need
The Elizabeth City Fire Marshall did not approve of the formerly permitted fuel AST locations,
nor the fuel dispenser locations. Therefore, Pelican Marina is proposing to relocate the tanks,
dispensers, and sewage pump out to the locations shown on the attached plans. The relocation
of the ASTs and dispensers has an effect on the rest of the permitted marina layout and [these]
proposed changes require this CAMA Major Modification request.

Project Setting
Niels and Melissa Jensen purchased the Pelican Marina located at 43 Camden Causeway (U.S. Highway 158) in
Camden County under the name of NMJ Properties, LLC, in 2016. The property falls within the Extra Territorial
Jurisdiction (ETJ) of the City of Elizabeth City, and is situated -1,300' east of the Pasquotank/ Camden County line,
adjacent to the Pasquotank River. Camden County and Elizabeth City zone the property as Mixed Use - Commercial.
The property is classified as Urban Waterfront, with municipal services provided by the City of Elizabeth City. Adjacent
uses include a restaurant and a small strip of vacant land owned by the City of Elizabeth City. Pelican Marina is bounded
to the north by US 158 and to the south by the Pasquotank River, and consists of a small narrow strip of land along
Highway 158 totaling 28,475 square feet. The project site is completely within the 75' Area of Environmental Concern.
Approximately 80% of the property is covered by a gravel parking lot, and has - 542 linear feet of shoreline.
The property is the site of a marina that has been approved for 62 slips and includes the following amenities: 1) a 40' x
80' marina store located over the water, 2) a small dock along the west side of the store, 3) a storage building on a
platform over the water converted to a kitchen, 4) a second storage building located at the end of a 197'x 8' pier located
behind the marina store that is used to store a portable pump -out, 5) a boat ramp and small courtesy dock on the east
side of the marina store, 6) a 215'x 8' pier is on the east side of the boat ramp, 7) erosion control structures consisting of
wooden and stone/concrete bulkheads, 8) a gravel parking lot, 9) a fenced dumpster, 10) a kayak rack, 11) a 4' wide
floating dock, and an above ground 1,000 -gallon capacity fuel tank (immediately adjacent to the bulkhead).
The closest pier to the Pelican Marina property is over 295' west of the marina at a residential condominium complex.
Classification of the adjacent waterbody is SC starting at the Norfolk Southern Railroad Bridge above the causeway to a
line between Cobb Point and Hospital Point below the causeway. Waters within the project area are "Joint" and as such
are Estuarine Waters. Water depths along the bulkhead are between -2.8' and -4.5'. Water depths at the end of the
main pier (-200' waterward of NWL) are between -9.2' and -9.6'. There is no submerged aquatic vegetation adjacent to
the subject property, and there are no wetlands associated with the property with the exception of -14sf of Arrow Arum
along the timber bulkhead on the east side of the property where there is a small breach. Other vegetation on the
property is limited to a few ornamental shrubs and a variety of domestic grasses and weeds. There are no known
geologic formations or archaeological sites associated with the applicant's property.
The property is question is low lying with an average elevation of only 1' above NWL, and is subject to regular flooding.
All water entering the property drains directly into the Pasquotank River. The marina store is only a few inches higher that
the adjacent grade, and as such is subject to regular flooding.
On March 31, 2017, NMJ Properties was issued CAMA Major Permit No. 47-17, to replace the bulkhead, add a
boardwalk, add a fuel dock at the end of the main pier extending from the marina store, install a pump -out station at the
end of the main pier, enlarge an existing boat ramp, expand an existing platform adjacent to the boat ramp and repair an
existing storage building on the platform, add floating docks in front of the platform and storage building with three finger
piers, repair and expand the dock around the ships store, add a floating dock to the east side of the property with 3 finger
piers, and a total of 27 new tie pilings.
Development Proposal
The fuel dock approved by CAMA Major Permit No. 44-17, was determined by the City of Elizabeth City, to be
inconsistent with the Fire Code, necessitating the reconfiguration of the approved development. The inconsistency was
not discovered until after the issuance of the CAMA Major Permit. The need to reconfigure the fuel dock has necessitated
greater changes than original realized and gives the applicant an opportunity to refine the proposed development of the
existing marina facility as follows:
1) Marina Store Dock: The applicant would like to extend the approved dock on the west side of the marina store
11' x 2.5' and add three 8' x 3' finger piers. Notes on the plan also indicate that 4 pilings are to be repaired or
replaced. If replaced 1 will have to receive approval from the adjacent property owner as it is not located within

the applicant's riparian corridor, and the remaining 3 will require a waiver from the adjacent property owner.
Additional Impacts:-123.5sf of open water shading
2) Boat Ramp: Located on the property is an existing 13' x 25' concrete boat ramp. The relocation of the proposed
fuel dock and tanks will necessitate the shifting of the ramp 7' west of the current approved location. No work
had begun of the approve "expanded" boat ramp.
Additional Impacts: -175sf of shallow bottom disturbance
3) Platform and Storage Building: The shifting of the boat ramp would leave a 7' wide gap between the staging
pier and the existing platform. The applicant proposes to extend the platform and connect the two structures and
square off the platform. No work approved by the original permit has been undertaken to date.
Additional impacts: 205sf of open water shading
4) Floating Dock & Finger Piers: An approved (256sf) floating dock with (3) 10' x 4' finger piers (120so, to be
located waterward of the platform and storage building, adjacent to the concrete groin, will be shifted between
10' and 12' to the east and enlarged (287sf) to accommodate the fuel docking facility and accessed by a
gangway from the existing platform. The 5 associated boat slips and 3 finger piers will be relocated to the end of
the main pier where the fuel dock was originally approved. Neither of the approved floating docks or finger piers
have been constructed to date.
Additional Impacts: 431sf of open water shading
5) Main Pier (Immediately adjacent to the marina store): The approved floating fuel dock that was to be located
behind the marina store will remain as approved and be used as a docking facility for 6 relocated boat slips and
three relocated finger piers within the marina. The relocation of the slips will include the installation of 7 tie
pilings 50' waterward of the existing pier alignment. The total distance that the pier will extend into the
Pasquotank River, including the tie pilings, will be -250'. The Pasquotank River is -1,621' wide at the Pelican
Marina with a Federally Maintain Channel.
Additional Impact: 7 Tie Pilings
11. High Ground Disturbance: Relocation of the fuel tanks will result in no increased high ground impacts.
12. Replacement of Existing Tie Pilings: The CAMA Permit Site Plan states that 4 pilings on the west side of the
marina store will be repaired or replaced. Replacement of 3 pilings will require a waiver from the adjacent
property owner and the 4m piling on the waterward side of the slips is not within the riparian boundaries of the
applicant's property and cannot be replaced without authorization from the adjacent property owner.
Anticipated Impacts
1) Project will result in the shading of an additional 419.5sf of open water finger piers and platforms.
2) Proposed development will result in the disturbance of 175sf of shallow water bottom.
3) Installation of pilings for the proposed piers and tie pilings will result in a temporary increase in turbidity within
surrounding waters.
4) Treated wood leaches over time in surrounding waters and sediment. The amount of leaching is dependent on
the type of organic material present in the water bottom substrate, oxygen levels and water movement; however,
it is estimated that 90% of the leaching will occur within the first 90 days.
5) The proposed improvements will allow for safer access to existing boat slips.

Improvements requiring a Major Modification to CAMA Major #40-17 include relocation of the permitted fueling facility from
the end of the existing western most pier to a proposed floating pier adjacent to the existing structure and boat ramp.The
permitted AST location will be affected by this move and will be relocated to the new fueling dock location. These
adjustments will require a realigment of the permitted boatramp, bulkhead, woodwalk, and open decking around the existing
structure and reconfiguration of the existing slips. Four finger piers along the west side of the marina building are also
proposed. See attached Narrative for a detailed description of the proposed modifications.
