The Division of Water Resources (Division) is in receipt of a response to a Notice of Violation
issued by this Division on September 20, 2017 restoration plan submitted on your behalf by Pilot
Environmental Inc dated December 8, 2017. The Division appreciates your attention to this
matter.
The Division approves the proposed stream and wetland restoration plan with the following
additional requirements:
1. The stream restoration shall be completed within 60 days of receipt of this letter. You
shall notify the Division upon completion of the stream restoration activities.
2. The wetland restoration shall be completed by April 30, 2018. You shall notify the
Division upon completion of the wetland restoration activities.
3. The stream and wetland restoration areas are to be monitored as proposed in the
restoration plan for a minimum of three (3) years following the completion of
construction activities. Monitoring may be extended by the Division if repairs or
maintenance are required in either the stream or wetland restoration areas during the
monitoring period.

Thank you for your attention to this matter. Pursuant to G.S. 143-215.6A, these violations and
any future violations are subject to a civil penalty assessment of up to a maximum of $25,000.00
per day for each violation. Your above-mentioned response to this correspondence, the degree
and extent of harm to the environment and the duration and gravity of the violation(s) will be
considered in any civil penalty assessment process that may occur. Should you have any
