River Bluff Holdings H, LLC, c/o Joseph Stillwell Page Two 9. PROJECT DESCRIPTION The project is located off Dogwood Road NE (SR #1428), adjacent to the Cape Fear River, in Northwest Township, Brunswick County. To find the project site travel south on US Highway 74/76 to Mt. Misery Road NE (the second Leland exit, SR # 1426). Turn right onto Mt. Misery Road and travel approximately 3.2 miles to Dogwood Road NE. Travel approximately 0.7 miles and the entrance to the development will be located past the railroad tracks on the right. The entire development consists of approximately 587 acres, which is located within the planning jurisdiction of Brunswick County. Construction is currently underway and some roads, bridges and utility lines have been completed. No coastal wetlands are present on site. An approved §404 wetland survey was not submitted as part of the application package; however, a Notice of Jurisdictional Determination was issued by the USACE on March 3, 2008 (Action Id: SAW-2006-32722). The majority of the waterfront lots are platted to the high water line, with the exception of Lots 240-244, located adjacent to the proposed marina. Lots 466 and 467, although shown on plans within the riparian area of the marina, currently appear to be shown on the Pender County GIS as platted to the high water line. The waters of the Cape Fear River, adjacent to the project site, are classified as SC by the North Carolina Division of Water Quality. They ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. PROPOSED PROJECT A total of 714 single-family lots are planned, with an average lot size of 13,000 square feet (see Sheet 1 of 11). Approximately 23 acres of highground would be disturbed. According to the applicant, the NC Division of Water Quality approved a state stormwater permit (#SW8 070677) on January 3, 2008 and a state sedimentation and erosion control plan (Project ID: Bruns-2006-221) was approved on November 30, 2007. Approximately 30% of the entire development site would be impervious, as proposed; however, approximately 0.6% of the area within the Estuarine Shoreline AEC would be impervious. The applicant states community water and sewer would service the development. A 50-slip marina is proposed on the Cape Fear River in the northwestern part of the development. A 6' wide elevated, wooden walkway would span the §404 wetlands from the upland parking area. From the application, it appears that the boardwalk would lead from the parking area to the river via an easement adjacent to Lots 239- 240 (see Sheet 2 of 11). The boardwalk would connect to a fixed pier originating at the river's edge, which would measure approximately 21' in length by 6' in width. The pier would then lead onto a floating dock aligned parallel to the shoreline along the Cape Fear River, measuring 755' in length and 6' in width. Twenty-seven finger piers are proposed, ranging from 20' to 30' in length, and measuring 4' in width, constructed perpendicular to the main dock spine. Fifty boatlifts, measuring 13' in length by 13' in width, are proposed within the resulting slips, providing docking for a total of 50 vessels. A pumpout station would be located on the western end of the dock with a proposed temporary tie-up slip in this location. The water depth at the waterward edge of the floating dock ranges from approximately -2' to -3' at normal low water (NLW). The water depth on the landward side of the dock ranges from approximately -5' to -9' at NLW. Three dolphin pilings are also proposed on both ends of the docking facility, totaling six in number. A "riverfront park" is also proposed on the Cape Fear River at the northeast corner of the development, which would include a concrete boat ramp with associated retaining walls/groins, a temporary tie-up dock, a fixed River Bluff Holdings H, LLC, c/o Joseph Stillwell Page Three platform (partially covered) over open water, and a covered pavilion on high ground. Picnic tables and grills are also proposed, which would be located outside of the 30' buffer. The boat ramp would measure 170' in length by 14' in width and would require the excavation of approximately 364 cubic yards (cy) of material, 34 cy of which would be located below existing mean high water (MHW). An area of approximately 434 square feet would be excavated from below existing MHW (a distance ranging from approximately 23 to 37 feet waterward of the current MHW line). Excavated material would be placed on site. Two retaining wall/groins would be installed on either side of the boat ramp to retain high ground material on either side of the ramp.The western wall would extend approximately 5' waterward of current MHW and the eastern wall would extend approximately 22' waterward of existing MHW. No backfill is proposed in conjunction with the wall construction. A temporary tie- up dock is proposed east of the boat ramp. A fixed pier measuring 17' in length by 6' in width would lead onto a floating dock aligned parallel to the channel, measuring 55' in length by 6' in width, with an additional 6' by 6' platform attached for the ramp landing/access. Water depths range from approximately - 3' to -5' on the waterward side of the proposed dock and from 0' (at the ramp landing) to -2' on the landward side at NLW. Two temporary tie-up slips are proposed at this dock, for vessels utilizing the boat ramp. A fixed platform, measuring 60' in length by 15' in width, is proposed west of the boat ramp, also aligned parallel to the shoreline. Two roofed areas, each measuring 15' in length by 15' in width (dripline dimensions), would be constructed over both ends of the platform, leaving a 30' long open area in its center. The platform would be located at the waterward edge of the river bank, entirely over open water. A 6' wide elevated boardwalk would lead from high ground to a short fixed pier, measuring approximately 3' in length by 6' in width, providing access to the platform area. A roofed pavilion, measuring 40' in length by 20' in width, is proposed on high ground, east of the boatramp and located outside of the 30' buffer. 10. ANTICIPATED IMPACTS The excavation of the proposed boat ramp would impact approximately 434 square feet of shallow bottom and 1,848 sq. ft. of high ground. The proposed groins/retaining walls would disturb approximately 350 square feet of high ground and approximately 40 square feet of shallow bottom. The proposed marina would incorporate approximately 22,163 sq. ft. of Estuarine Waters and Pubic Trust Area. The shoreline length on this site is approximately 867 linear feet, which meets the 27 sq. ft. allowable incorporated area for residential marinas. The proposed transient dock and fixed platform would incorporate an additional 1,464 sq. ft. of Estuarine Waters and Public Trust Area. Shoreline length at this site is approximately 315 linear feet, which also meets the allowable incorporated area threshold for the site. Due to shallow water depths (approximately 0' to -2' at NLW on the landward edge of the transient dock), it is likely that at least part of the floating dock would sit on the bottom occasionally at low tide. Water depths were surveyed by Arnold Carson and sealed on 10/10/06. A copy of the hydrographic survey is available in the WiRO office file for review. The proposed docking structures at both sites would not encroach into the adjacent 15' Riparian Corridor Setback Areas, as shown on plans. However, according to the plat map referred to on the Pender County GIS website for Lots 466 and 467, it appears that these two lots are currently platted to the high water line and have riparian rights, although the plans do not show this to be the case. Increases in turbidity should be expected during construction. The proposed transient dock would extend approximately 45' from the shoreline, which meets the '/4 width rule. The dock at the marina site would extend a maximum distance of approximately 65' from the shoreline, which appears to meet the 1/4 width, as it is shown on plans. The marina boardwalk access would shade approximately 1,770 square feet of §404 wetlands. The upland development would result in the disturbance of approximately 23 acres of high ground. Submitted by: Heather Coats Date: 2/2/09 Office: Wilmington Project Narrative CAMA Major Permit Application The Bluffs On The Cape Fear Northwest Township, Brunswick County, North Carolina River Bluff Holdings II, LLC, Property Owner/ Applicant Revised 1-6-09 River Bluff Holdings, LLC, applicant, proposes to construct an open water community marina that will offer fifty (50) permanent boat slips on the Cape Fear River. All slips will offer a boat lift system to further protect vessels from floating debris and wave action. The proposed project will provide residents of The Bluffs On The Cape Fear access to the waters of the Cape Fear River. A boat ramp will be located to the east of the proposed community marina. There will be a dock with two (2) temporary tie-ups located adjacent to the boat ramp. One additional temporary tie-up will be located at the marina, adjacent to the pumpout station. The proposed project will also feature a 15 ft by 60 ft waterfront amenity featuring two 15 ft by 15 ft gazebos and a 15'x30' open deck area that will be accessed via an elevated wooden pier and will offer recreational opportunities for residents of The Bluffs On The Cape Fear. An additional 40 ft by 20 ft covered pavilion and several picnic tables and grills are proposed on uplands within the DMC AEC to the east of the boat ramp. The Bluffs On The Cape Fear is located on the Cape Fear River in the Township of Northwest, Brunswick County, North Carolina. Waters of the Cape Fear River in this vicinity are designated by the NC Division of Marine Fisheries as primary nursery area (PNA); and are classified as C; SW Waters by the North Carolina Environmental Commission (EMC). The subdivision is currently under construction with the installation of roads and utilities. The proposed marina will be a floating system that will total 755 ft in length (Figures 4 and 5). Slips will range in length from 20 ft to 30ft and will be accessed by a floating dock that will be 6 ft in width. Pilings will anchor the floating dock system and provide support for individual boat lifts. Vessels will be double loaded between floating fingers with the exception of the outermost slips, which will be single loaded. Fingers will be 4 ft in width. There will be a permanent marine pumpout station located on the western end of the marina with a temporary tie-up slip. There will be one ramped access point that will be hinged at the base of the access pier and will feature rollers for the floating dock surface. Forty parking spaces are proposed in the vicinity of the boat ramp. The community marina covers 21,671 square feet of public trust area. Lots 240 - 244 and Lots 466 and 467 are not platted to mean high water. The dimensions of the common area as shown between riparian corridors is 867 linear ft at mean high water. The length of the common area shoreline at the boat ramp site is approximately 412 feet. There are no existing structures at the site. The marina and boat ramp will be privately owned and utilized solely by owners and their guests. No commercial activities or services are proposed. The conceptual plan for The Bluffs On The Cape Fear, that has received approval from Brunswick County collectively includes approximately 587 acres of land. The approved conceptual plan includes 714 single-family units, a community marina and a riverfront park with a boat ramp and temporary tie-up facilities. Associated amenities for The Bluffs On The Cape Fear include an upland lake with a community clubhouse.
