The receiving waters are Wading Creek, which is classified SA-HQW. However, the original application notes "no discharge" because they plan to dewater into an adjacent property's old mine pit. The NPDES permit is still required because they will need a pumping plan to ensure nearby wetlands are protected, and in the rare event that there is an event large enough to prompt overflow, it is considered a potential discharge and requires a permit. Because the receiving waters for any discharge would be ultimately be class SA, our rules require approval from DMF's Shellfish Sanitation before issuing the site coverage under the NPDES NCG020000 General Permit. Note that fecal coliform monitoring is required for wastewater discharges to SA waters (Part IV Sec D) — unless there's no discharge in event smaller than the 10 -year, 24-hour storm (which may well be the case here). The applicant has provided an initial pumping plan, but it is incomplete in how it addresses nearby wetlands. In the meantime, I wanted to go ahead and send the review request to you.
