Train traffic will remain open during construction. A brief closure of Wesley Chapel-Stouts Road is anticipated, and a roadway detour will be coordinated with NCDOT Division 10 staff during the design phase of the project. Please fnd enclosed a PCN application, Stormwater Management Plan, permit drawings, culvert survey report, mitigation request letter, a USGS quad map, Soil Survey map, State Minimum Criteria Checklist, SHPO Concurrence letters, and photographs. A wetland mitigation acceptance letter from the Department of Mitigation Services is also attached. Stream mitigation has been requested and will be forwarded once received. The North Carolina Natural Heritage Database was checked for records of threatened and endangered species. The database lists four species for Union County that have federal status. Bald eagle (Haliaeetus leucocephalus) is protected in every county in North Carolina under the Bald and Golden Eagle Protection Act. Schweinitz's sunflower (Helianthus schweinitzii), Carolina heelsplitter (Lasmigona decorata), and Micha�'s sumac (Rhus michauxii) are listed as endangered. Habitat for bald eagle primarily consists of mature forest in proximity to large bodies of open water for foraging. Large dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. A desktop-GIS assessment of the project study area, as well as the area within a 1.13-mile radius (1.0 mile plus 660 feet) of the project limits, was performed on July 19, 2016 using 2015 color aerials. Several waterbodies were identified southeast of the study area that are large enough and sufficiently open to be considered a potential feeding source. A survey of the study area and the area within 660 feet of the study area boundary was conducted on March 15, June 28, and September 19, 2016; no individuals or nests were observed. Additionally, a review of the June 2016 NCNHP database on August 25, 2016 indicates no known occurrences of this species within 1.0 mile of the project study area. Schweinitz's sunflower is endemic to the Piedmont of North and South Carolina. The few sites where this rhizomatous perennial herb occurs in relatively natural vegetation are found in Xeric Hardpan Farests. The species is also found along roadside rights-of-way, maintained power lines, and other utility rights- of-way, edges of thickets and old pastures, clearings and edges of upland oak-pine-hickory woods and Piedmont longleaf pine farests, and other sunny or semi-sunny habitats where disturbances (e.g., mowing, clearing, grazing, blowdowns, storms, frequent fire) help create open or partially open areas for sunlight. It is intolerant of full shade and excessive competition from other vegetation. Schweinitz's sunflower occurs in a variety of soil series, including Badin, Cecil, Cid, Enon, Gaston, Geargeville, Iredell, Mecklenburg, Misenheimer, Secrest, Tatum, Uwharrie, and Zion, among others. It is generally found growing on shallow sandy soils with high gravel content; shallow, poor, clayey hardpans; or shallow rocky soils, especially those derived from mafic rocks. Suitable habitat for Schweinitz's sunflower is present in the study area along the railroad siding, roadsides, utility right-of-ways, and field/forest edges. A review of the June 2016 NCNHP database on August 25, 2016, indicates no known occurrences within 1.0 mile of the study area. Surveys were conducted by Three Oaks on September 19, 2016. No plants were seen during the survey; therefore, this project will not affect this species. The Carolina heelsplitter was historically known from severallocations within the Catawba and Pee Dee River systems in North Carolina and the Pee Dee and Savannah River systems, and possibly the Saluda River system, in South Carolina. In North Carolina, the species is now known only from a handful of streams in the Pee Dee and Catawba River systems. The species exists in very low abundances, usually within 6 feet of shorelines, throughout its known range. The general habitat requirements for the Carolina heelsplitter are shaded areas in large rivers to small streams, often burrowed into clay banks between the root systems of trees, or in runs along steep banks with moderate current. The more recent habitat where the Carolina heelsplitter has been found is in sections of streams containing bedrock with perpendicular crevices filled with sand and gravel, and with wide riparian buffers. As habitat is present in streams within the project study area, a survey was conducted by Three Oaks Engineering (Three Oaks) on February 2, 2017. Based on these survey results, it was determined that this project will have no effect on this species. Michaux's sumac, endemic to the inner Coastal Plain and lower Piedmont, grows in sandy or rocky, open, upland woods on acidic or circumneutral, well-drained sands or sandy loam soils with low cation exchange capacities. The species is also found on sandy or submesic loamy swales and depressions in the fall line Sandhills region as well as in openings along the rim of Carolina bays; maintained railroad, roadside, power line, and utility rights-of-way; areas where forest canopies have been opened up by blowdowns and/or storm damage; small wildlife food plots; abandoned building sites; under sparse to moderately dense pine or pine/hardwood canopies; and in and along edges of other artificially maintained clearings undergoing natural succession. In the central Piedmont, it occurs on clayey soils derived from mafic rocks. The plant is shade intolerant and, therefore, grows best where disturbance (e.g., mowing, clearing, grazing, periodic fire) maintains its open habitat. Suitable habitat for Micha�'s sumac is present in the study area along the railroad siding, roadsides, and utility right-of-ways. A review of the June 2016 NCNHP database on August 25, 2016, indicates no known occurrences within 1.0 mile of the study area. Surveys were conducted by Three Oaks on September 19, 2016. No plants were observed during the survey; therefore, this project will not affect this species. This project was submitted to the State Historic Preservation Office (SHPO) for review on February 4, 2016. A survey of architectural properties was conducted on February 2, 2016. It was determined that no historical architecture would be impacted by the project. Additionally, it was determined there would be no eligible archaeological resources present within the project study area. The project study area is comprised mostly of maintained rail right-of-way, but also contains hardwood and pine farest along the stream banks. There are several jurisdictional streams and wetlands within the project study area, including South Fork Crooked Creek and associated unnamed tributaries. NCDOT best management practices (BMPs) will be used to minimize and control sedimentation and erosion. The construction foreman will review the BMPs daily to ensure erosion and sedimentation is being effectively controlled. If the foreman determines the devices are not functioning as intended, they will be replaced immediately with better devices. Impacts to Waters of the United States South Fork Crooked Creek (DWR Class: C) is shown on the USGS topographic map as a perennial stream. The channel is well defined with a substrate primarily composed of sand, silt, gravel, cobble, and is approximately 4-7 feet in width. From the project site, South Fork Crooked Creek flows approximately 10.6 river miles (RM) to its confluence with Crooked Creek. Crooked Creek then flows approximately 13.1 RM to its confluence with Rocky River. The Rocky River meets the definition of a Traditional Navigable Water. For these reasons, we believe South Fork Crooked Creek is a Relatively Permanent Water and is under the jurisdiction of the U.S. Army Corps of Engineers. In order to construct the project, it will be necessary to impact waters of the United States in the Yadkin-Pee Dee River Basin (HLTC 03040105). Work adjacent to the track will be protected by current CSX Safety and Roadway Worker Protection rules. A brief closure of Wesley Chapel-Stouts Road is anticipated, and a roadway detour will be coordinated with NCDOT Division 10 staff during the design phase of the project. Erosion and sedimentation control measures will be installed. Water will be diverted around the construction area. Water will gravity flow through a 24" pipe around the work area during construction by installed impervious dikes upstream and downstream of the existing bridge. Special stilling basins will be utilized on an as needed basis to pump water trapped between the impervious dikes if a storm event overtops the dikes. Equipment to be used includes a track hoe, dump truck, paving equipment, pumps, and various hand tools, possibly a crane to move construction material such as reinforced bars of steel, and concrete buckets to place concrete. 4. Flow to the wetland is being carried by a grass lined 2' base ditch. The Q10 velocity into the wetland is calculated to be 0.8 ft/sec. The project impacts three jurisdictional stream crossings, one at South Fork Crooked Creek, one at an unnamed tributary to South Fork Crooked Creek, and a third at another unnamed tributary. At South Fork Crooked Creek, Sta. 429+80, there is an existing rock arch culvert with a 60" CMP outlet extension. The proposed design calls to extend the existing rock arched culvert by replacing the existing 60" CMP outlet end with a 52" smooth steel liner pipe. The outlet of the extension will be placed so that the outlet elevation matches that of the existing stream channel. An additional 34" smooth steel pile will be installed adjacent via trenchless installation to assist with higher flows. The northeast quadrant contains a proposed 2' lateral base ditch to maintain the existing condition flow pattern to the stream channel. The channel is lined with rip rap for stabilization and velocity control. The Q100 ditch velocity is 3.5 ft/sec. The crossing of the unnamed tributary to South Fork Crooked Creek, Sta. 432+75, contains four existing 60"x66" elliptical concrete pipes. The proposed design calls to extend these pipes to maintain flow. The northwest quadrant contains a proposed 6' lateral base ditch lined with rip rap for stabilization and velocity control. The Q100 ditch velocity is 4.5 ft/sec. At the third crossing, Sta. 469+90, there is an existing 2.5' x 4' rock box culvert that will be extended with a 2.5' x 4' reinforced concrete box culvert to maintain flow. The culvert is to be buried approximately 1.5' and backfilled with native stream material. The northwest quadrant includes a 2' base, grass lined ditch with a Q100 velocity of 4.2 ft/sec. Rip rap is utilized on the stream banks and within some proposed drainage ditches to prevent scour and erosion at the pipe outlets. Velocities for all ditches are designed to be non-erosive for the Q100 storm and are lined for protection as needed. Project No. 46398.11 Proiect Location: Stouts Siding Extension project; proposed extension of the existing rail siding track along CSX Transportation's (CSX) SF-line from east of Indian Trail Road (SR 1008) to west of Wesley Chapel Stouts Road. The project limits begin west of the existing Indian Trail Road rail- highway crossing to east of the existing Hayes Road (SR 1378) rail-highway crossing in the Town of Indian Trail, Union County, North Carolina. Proiect Description: The proposed project involves the extension of the existing rail siding track along the CSX SF- line in Union County. The proposed project is included in the 2016-2025 North Carolina State Transportation Improvement Program (STIP). It is anticipated that construction will occur within existing CSX right of way; therefore, no additional right of way will be required. Construction is scheduled for state fiscal years 2018 and 2019 in the STIP. The project proposes the following improvements; construction of new siding track extending approximately 10,000 feet from railroad milepost (MP) SF-313.4 to SF-315.3; rebuilding the existing siding track from railroad (MP) SF-312.8 to SF-313.4, a distance of approximately 3,200 feet; installation of new interlocking railroad signals and powered turnouts on the main track at each end of the siding; and drainage improvements that will extend existing culverts to the north side of the existing main track (see Figure 3). Train traffic will remain open during construction. Work adjacent to the track will be protected by current CSX Safety and Roadway Worker Protection rules. A brief closure of Wesley Chapel-Stouts Road is anticipated, and a roadway detour will be coordinated with NCDOT Division 10 staff during the design phase of the project. Puruose and Need: The purpose of the project is to support and enhance freight operations along the CSX-SF line by constructing a passing siding in the middle of a 30-mile segment of single track railroad. The passing siding will efficiently and effectively allow trains traveling in opposite directions to pass, and for fast, high priority trains to pass slower or lower priority trains traveling in the same direction. Tvpe of Document A State Minimum Criteria Determination Checklist is used as the appropriate documentation. In accordance with House Bi11795 "An Act to Reform and Amend the State Environmental Policy Act", "Significant expenditure of public moneys" means expenditures of public funds greater than ten million dollars for a single project or action or related group of projects or actions. Contributions of funds and in-kind contributions by a non-State entity shall not be considered an expenditure of public funds for purposes of calculating whether such an expenditure is significant. The expenditures of public funds on this project is less than the ten million dollar threshold to consider it to be significant but the land-disturbing activity is greater than the ten acres threshold resulting in substantial, permanent changes in the natural cover or topography will require SEPA documentation. Anticipated Permit or Consultation Requirements: Nationwide Permits (NWP) 14 and 23 will likely be applicable. A NWP No. 33 may also apply for temporary construction activities such as stream dewatering, work bridges, or temporary causeways that are often used during bridge construction or rehabilitation. The USACE holds the final discretion as to what permit will be required to authorize project construction. If a Section 404 permit is required, then a Section 401 Water Quality Certification (WQC) from the NCDWR will be needed. Estimated Costs: The total cost for the project included in the 2016-2025 STIP is $11,000,000. Of this total, $5,500,000 is for construction using State Highway Trust Funds (public funds), and $5,500,000 is for construction using CSX funds (other funds). Pedestrian and Bicycle Accommodations: N/A Alternatives Considered: No Build — The no build alternative does not meet the purpose and need of the project. Construct Siding on the South Side of the Existing Railroad — Due to the existence of a siding on the north side of the railroad, and conflicting industry services located on the south side of the railroad, this alternative was determined not feasible. Construct Siding on the North Side of the Existing Railroad (Recommended) - Due to the conflicts associated with constructing the siding on the south side of the railroad (as described above), an alternative to construct the siding on the north side of the railroad was developed and selected as the preferred alternative. Public Involvement: A landowner notification letter was sent to all property owners whose property, or a portion of their property, was included within the project study area boundary. Property owners were asked to provide comments. Questions received from the residential and business communities involved connectivity across the railroad corridor, safety, and construction timing. An informal public workshop meeting was held on June 13, 2016. There were seven citizens in attendance. The majority supported the proposed improvements. PART A: MINIMUM CRITERIA 1. A review of the July 2016 NCNHP database on January 26, 2017 indicates no known occurrences within 1.0 mile of the study area. Habitat evaluations were conducted by Three Oaks personnel on February 2, 2017 within all the streams crossed by the project alignment. The Carolina heelsplitter was not found during the surveys and is not expected to occur within the surveyed portions of South Fork Crooked Creek, or the easternmost UT, nor is it expected to occur in close proximity downstream of the respective project crossings, as South Fork Crooked Creek is impounded by a golf course and the UT flows through a highly-urbanized area. Based on these conditions and the survey results, impacts are not expected to occur to this species. Strict adherence to erosion control standards should minimize the potential for any adverse impacts to occur to the aquatic fauna in these streams. The biological conclusion is No Effect. Suitable habitat for Michaux's sumac (Rhus michauxii) is present in the study area along the railroad siding, roadsides, and utility right of ways. A review of the July 2016 NCNHP database on August 25, 2016 indicates no known occurrences within 1.0 mile of the study area. Surveys were conducted on September 19, 2016 in which no plants were observed during the survey. The biological conclusion is No Effect. Suitable habitat for Schweinitz's sunflower (Helianthus schweinitzii) is present in the study area along the railroad siding, roadsides, utility right of ways, and field/forest edges. We have checked our maps and files and determined that the only historic property within the project's Area of Potential Effects (APE) is the James Orr Store (UN0302), located at the southeast corner of the intersection the railroad and Indian Trail Road. The store was determined eligible for listing in the National Register of Historic Places in 2002. Given the scope of the project, there is little likelihood that other historic structures are in the APE and no further survey work is needed. There are no known archaeological sites within the proposed project area. Based on our knowledge of the area, it is unlikely that any archaeological resources that may be eligible for inclusion in the National Register of Historic Places will be affected by the project. We, therefore, recommend that no archaeological investigation be conducted in connection with this project. Please note that we have discussed this project with the Architectural History and Archaeological Units in the Human Environment Section and determined that it does not fall under the Programmatic Agreement for Minor Transportation Project since the Federal Railway Administration may fund the project and that agency is not a party to the PA.
