PROJECT SUMMARY: The applicant proposes to modify their existing active major permit no. 66-10 to replace the existing marina facility in the same footprint and conduct maintenance dredging. Lookout Harbour HOA Page 2 9. PROJECT DESCRIPTION: The project site is located at Lookout Harbour Way, adjacent to Banks Channel, on Harbor Island, in Wrightsville Beach, New Hanover County. To locate the project site from the WiRo take US Hwy 74/76 to Wrightsville Beach. Travel across the drawbridge and keep left on West Salisbury Street/ US 74. Travel approximately 3/4 mile; at the base of the bridge over Banks Channel turn right onto Lookout Harbour Way. The property is adjacent to Banks Channel to the east with coastal Keenan's Creek/Lee's Cut to the west. The project site is adjacent to residential properties on the north and south sides. Highground development on the project site includes a 35 -unit condominium complex, pool, cabana, associated parking drives and landscaping, community marina and bulkhead. Upland vegetation consists of ornamental landscaping and lawn grasses. The lot is approximately 3.37 acres in size and has an average elevation of approximately 9.5' above normal high water. The entire project site has 709 linear feet of shoreline frontage of which 321' is stabilized by an existing timber bulkhead. The applicant received State Permit No. 66-10 on June 10, 2010 to construct 321 linear feet of new timber bulkhead waterward of the existing asbestos wall on the east side of the property adjacent to Bank's Channel. This work has been completed. State Permit No. 66-10 was then modified through a Major Modification to install a new timber bulkhead waterward of the existing asbestos bulkhead along the Kenan's Creek/Lee's Cut shoreline. This portion of the bulkhead has not been built, but according to the application materials the applicant would like to keep that portion of the permit active. This permit will expire on 12/31/17. Waterward of the existing bulkhead on the east side of the property is an area of Coastal Wetlands. This area of Coastal Wetlands adjacent to the bulkhead ranges from 100' in width to 25' in width from north to south and consists of high and low marsh vegetation. Located waterward of the existing bulkhead, extending from the northern property boundary to the south approximately 220' is an area, approximately 70' in width, of mixed vegetation consisting of coastal wetland species and high ground species, which include marsh elder (Iva frutescens), sea ox -eye (Borrichia frutescens), seaside goldenrod (Solidago sempervirens) and salt meadow hay (Spartina patens). This area of high marsh varies in elevation with the highest elevations located directly adjacent to the existing bulkhead. A few woody plants have begun to emerge along the bulkhead including small specimens of Red Cedar, Yaupon and Wax Myrtle. Normal High Water is located approximately 10-20' waterward of the existing bulkhead along the north property and extends to the south where NHW meets the bulkhead approximately 55' from the property boundary to the south. Waterward of NHW the vegetation transitions to low marsh vegetation measuring approximately 25' wide, consisting primarily of Smooth Cordgrass (Spartina alterniflora), sea lavender (Limonium carolinianum), and glasswort (Salicornia spp.). Extending in an easterly direction from the bulkhead towards Banks Channel is an approximately 50' by 6' existing access pier, which extends over the marsh and open water. At the terminus of the access pier is an existing open platform measuring approximately 17' by 17'. Extending from this platform toward the north is an approximately 98' by 6' access pier, and extending to the south is an approximately 140' by 6' access pier. From these two access pier are four floating docks extending perpendicular to the channel (two from each access pier), three of which are "T-shaped" and one is "T-shaped" with an additional finger pier. The two southernmost floating docks are identical with the body of the "T" measuring approximately 48' by 6' and the top of the "T" measuring approximately 48' by 6'. The third "T-shaped" float is slightly smaller, with the body of the "T" measuring approximately 32' by 6' and the top of the "T" measuring approximately 48' by 6'. The northernmost floating dock is mainly "T-shaped" with the body of the "T" measuring approximately 32' by 6' and the top measuring approximately 48' by 6', with an additional finger pier extending in a northerly direction approximately 10' from the landward side of the body of the "T" and measuring approximately 32' by 6'. There are 18 tie pilings associated with slips in the marina (see Page 1 of 4). The marina currently provides dockage for 28 vessels in water depths ranging from approximately -2.5' to -6.0' at NLW. Lookout Harbour HOA Page 3 The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground area of project site as Conservation. There are no known archaeological sites located in the project vicinity. The waters of Banks Channel are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to modify their existing active major permit no. 66-10 to replace the existing marina facility in the same footprint and conduct maintenance dredging. This facility would continue to accommodate 28 vessels in water depths of -6 at NLW once maintenance dredging is complete. The applicant proposes to dredge the area where vessels currently dock with a footprint that would measure approximately 300' by 60'. The current depths range from -2.5' at NLW to -6.0' at NLW. The proposed footprint would require removal of approximately 1,333 cubic yards of sandy material which would be excavated using a mechanical dredge. No shellfish or SAV were identified in the dredge footprint during the site visit. The spoil disposal site would be identified and inspected by DCM once a dredging contractor is identified. No changes are proposed to the upland portion of the project site or the community marina. 11. ANTICIPATED IMPACTS: The proposed community marina would continue to incorporate approximately 59,552 sq. ft. of Estuarine Waters and Public Trust Area, which includes the marina access piers, open platform and floating docks. It would also result in the shading of 180 ft2 of Coastal Wetlands. These impacts would be in the exact same footprint of the existing facility. As proposed, the marina does not appear to exceed the Y, width limitation and would extend approximately 80' into a waterbody measuring approximately 600' in width. The proposed marina would not encroach into either 15' adjacent riparian setback area and would meet the Town of Wrightsville Beach's Pierhead Line. As proposed, the marina configuration would accommodate up to 28 permanent vessels and there is potential for 8 temporary side -to dock spaces at the end of each floating "T". The application states that the existing water depths in the location of the proposed marina ranges from -2.5' to -6.0' at NLW. Maintenance dredging would disturb approximately 18,000 ft' of shallow bottom habitat in Estuarine Waters and Public Trust Area consisting primarily of sand and would result in the removal of approximately 1,333 cubic yards of material. The resulting water depths in the marina area would be -6.0' at NLW. Connecting water depths at the terminus of the floating docks is currently -6.0' at NLW. Minor turbidity should be expected during project construction and maintenance dredging. Fixed Pier pilings and all other components will be removed and replace as a part of the project. Floating dock pilings and mooring pilings are planned to remain. The existing floating docks will be removed and replaced as part of the proposed project. The elevation, size and configuration of the replacement fixed pier, floating dock and boat slips are to remain the same as the existing conditions layout. Four existing wooden ramps transitioning from the existing fixed pier will be removed and replaced with aluminum ramps as a part of the project. Electrical and plumbing will be removed and replaced in a similar layout as existing. Lookout Harbour HOA is proposing to perform a bucket to barge dredge in the footprint of the boat basin. Permit application drawings detail the parameters and depth of the proposed dredge area.
