Summary of Section 4(f) coordination with USFS
Havelock Bypass
� 5/01/1998 — Letter from USFS to NCDOT stating that the "USFS has determined that this project
doesn't encroach on or use land form(sic) of any of the types of specially designated areas
described above and consideration under Section 4(f) is not required.
� 07/20/2010 — USFS provides comments on the preliminary DEIS. No comments are made in
regards to the reference of the 1998 USFS letter and the determination that Section 4(f) is not
applicable to the use of land within the Croatan National Forest within the build alternative
corridors.
• 9/06/2011— DEIS is approved. USFS is a cooperating agency. Section 4.5 of the DEIS references
the 05/01/1998 letter from USFS, stating that a Section 4(f) evaluation is not necessary.
• 11/21/2011— Letter is submitted from USFS to NCDOT providing comments on the DEIS. No
comments in regards to the Section 4(f) discussion in the DEIS.
• 04/10/2012 — Merger Team concurred (reaffirmed) on LEDPA (concurrence point 3). No
concerns regarding the applicability of Section 4(f) for all build alternatives within the
boundaries Croatan National Forest were raised.
• 02/19/2014 — USFS met with NCDOT and FHWA to discuss USFS comments on the DEIS and
actions taken to date to resolve comments, and identify any further actions needed to resolve
lingering concerns. The USFS requested that the FEIS disclose recreation/hunting areas in the
FEIS.
� 08/20/2014 - Merger Team concurred on avoidance and minimization measures (concurrence
point 4a). No concerns regarding the applicability of Section 4(f) for the preferred alternative
were raised.
� 01/28/2015 — Letter is submitted from USFS to NCDOT regarding USFS requested surveys,
analyses, and mitigation coordination for the Havelock Bypass. No comments on Section 4(f)
applicability were included in the letter.
� 03/06/2015 - USFS provides comments on the preliminary FEIS. USFS suggested the following
language be included "Currently there are no developed recreation areas in the vicinity of the
proposed bypass". Per USFS request via 02/19/2014 meeting, NCDOT provided information
regarding recreation/hunting areas in the FEIS. USFS acknowledged that the preliminary FEIS
included the information requested and suggested the language shown above.
