This letter is in response to a request for more information concerning the House Creek
Greenway project (DWQ Project #08-1814). Our original permit submittal occurred on
December 12, 2008. Your letter requesting additional information was dated January 8 h, 2008.
In this Request For More Information, attached to this letter, you requested additional information
on 4 items. Please find the following responses to your request as follows:
1. The project consists of varying dimensions depending upon funding source and NCDOT
requirements. As a result of the project having State and Federal funding involvement, the
required greenway width is 10 feet in accordance with the NCDOT Division of Bicycle &
Pedestrian Transportation guidelines.
2. Based on correspondence with Mr. James Shem of the Raleigh Regional office of the U.S.
Army Corp of Engineers (COE), this project will be permitted through the NWP permit
process. According to Mr. Shern, he has approved the use of NWP #14 for this project.
3. Please see attached table showing the square footage of Zone 1 and Zone 2 impacts for
each location. The impacts areas are shown and calculated to the proposed construction
easement lines. Actual buffer disturbance that the contractor will require for construction,
staging, and clearance for setting cored slab bridge units may be less than shown. The
importance of minimizing buffer disturbance to the minimum required for project
construction will be discussed with the contractors during the pre-construction meeting.
4. Based on correspondence with Mr. James Shem of the COE, the mitigation required for
the impacts to jurisdictional streams will be provided through purchasing credits from a
local mitigation bank. No on-site mitigation will be utilized for the proposed project;
therefore a mitigation plan as described in the Section VIII will not be necessary. Based
on mitigation guidelines for buffer impacts associated with greenway projects, buffer
mitigation is not required. Therefore, based on current regulations and correspondence
with the COE, no additional mitigation will be required.

Dear Sir or Madam:
On December 12, 2008, the Division of Water Quality (DWQ) received your application dated November
11, 2008,with additional information received from you on December 22, 2008, to fill or otherwise
impact 52 linear feet of perennial stream (temporary impact), 189 linear feet of intermittent stream
(permanent impact), and 45,435 square feet of Zone I Neuse River basin protected riparian buffers and
48, 612 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed
greenway project at the site. The DWQ has determined that your application was incomplete and/or
provided inaccurate information as discussed below. The DWQ will require additional information in
order to process your application to impact protected wetlands and/or streams on the subject property.
Therefore, unless we receive five copies of the additional information requested below, we will place this
project on hold as incomplete until we receive this additional information. If we do not receive the
requested information, your project will be formally returned as incomplete. Please provide the following
information so that we may continue to review your project.
Additional Information Requested:
1. Please verify that the entire proposed greenway width is 8 feet or less.
2. Please verify that the USACE will be permitting your project under a Nationwide Permit and not
an Individual Permit. Additionally, if this project is to be permitted under a Nationwide Permit,
you state in your PCN application that it will be "14, 3 or 12", please identify which Nationwide
Permit No. it will be.
3. Please update buffer impact sheets to show the square footage (numerical values) of Lone I and
Zone 2 impacts. Additionally, assuming that the shaded areas on the buffer impact sheets are
buffer areas proposed for impact, please explain why the amount of impacts at a number of
locations appear to extend well beyond the footprint of the greenway trail.
4. Please provide more details on the in-stream enhancement. Section VIII, No. 1, states that the
Enhancement Plan was attached, but no plan was in the application package.

and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
