Sediment and Erosion Control:
2. Erosion and sediment control practices must be in full compliance with all specifications governing
the proper design, installation and operation and maintenance of such Best Management Practices in
order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor-owned or leased borrow pits associated with the project.
c. Sufficient materials required for stabilization and/or repair of erosion control measures and
stormwater routing and treatment shall be on site at all times.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the 404/401 Permit Application. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality standards,
statutes, or rules occur;
4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, they shall be removed and the natural grade restored within six months of the date that the
Division of Land Resources has released the project;
5. Protective Fencing - The outside buffer, wetland or water boundary and along the construction corridor
within these boundaries approved under this authorization shall be clearly marked with orange warning
fencing (or similar high visibility material) for the areas that have been approved to infringe within the
buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15 NCAC 2H,

7. Construction Stormwater Permit NCG010000
Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land
Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an
NPDES General stormwater permit (NCGO10000) administered by DWQ is automatically issued
to the project. This General Permit allows stormwater to be discharged during land disturbing
construction activities as stipulated by conditions in the permit. If your project is covered by this
permit [applicable to construction projects that disturb one (1) or more acres], full compliance
with permit conditions including the sedimentation control plan, self-monitoring, record keeping
and reporting requirements are required. A copy of this permit and monitoring report forms may
be found at http //h2o enr.state.nc.us/su/Forms Documents.htm.;
8. Culvert Installation
Culverts required for this project shall be installed in such a manner that the original stream profiles
are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and
longitudinal profile) must be maintained above and below locations of each culvert. Culverts shall
be designed and installed to allow for aquatic life movement as well as to prevent head cutting of
the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall
be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re-
installed correctly.
Culvert(s) shall not be installed in such a manner that will cause aggradation or erosion of the
stream up or down stream of the culvert(s). Existing stream dimensions (including the cross section
dimensions, pattern and longitudinal profile) shall be maintained above and below locations of each
culvert.
Placement of culverts and other structures in waters, streams, and wetlands must be placed below
the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches,
and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow
low flow passage of water and aquatic life. Design and placement of culverts and other structures
including temporary erosion control measures shall not be conducted in a manner that may result in
disequilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the
above structures. The applicant is required to provide evidence that the equilibrium shall be
maintained if requested in writing by DWQ.
The establishment of native, woody vegetation and other soft stream bank stabilization techniques
must be used where practicable instead of rip rap or other bank hardening methods. If rip-rap is
necessary, it shall not be placed in the stream bed, unless specifically approved by the Division of
Water Quality.
Installation of culverts in wetlands must ensure continuity of water movement and be designed
to adequately accommodate high water or flood conditions.
Upon completion of the project, the Applicant shall complete and return the enclosed "Certificate of
Completion" form to notify NCDWQ when all work included in the §401 Certification has been
completed. The responsible party shall complete the attached form and return it to the
401/Wetlands Unit of the NC Division of Water Quality upon completion of the project. Please
send photographs upstream and doivnstream of each culvert site to document correct installation
along with the Certificate of Completion form.

W&R Project #: 2040365 Ut'T ?DWQ Project #: o6-116o WATER QUALITY
YrE1T At?OS NvD 5TORMWATER BRANCH
Dear Ms. Karoly,
We received your request for additional information on dated July 25, 2oo6, regarding the
proposed impacts associated with the construction of Greystone Subdivision.
Additionally, on August 28`h, 2oo6, we met with staff to review the project and work out
an agreement that would allow the project to move forward. Based on this meeting, it is
our understanding that the NC-DWQ requires an alternative analysis of the proposed
Morrisville Parkway alignments in order to demonstrate that the preferred alignment
minimizes impacts to the stream channels/wetlands and the surrounding residents. We
have included an exhibit with the attachments that depicts the 4 alignments (labeled A-
D) and will discuss each alignment in detail below. The streams and riparian buffer
locations are taken from the Town of Cary GIS data and while not an actual field
delineation, do allow a qualitative assessment of the potential impacts for each
alignment. Wetland impacts were estimated using the National Wetland Inventory maps.
The alternatives analysis began in late 2003 and included input from the NC-DOT, Town
of Cary officials and staff and their consultant and resulted in three alternatives. Based
on input from two Public Information Workshops, a fourth alternative was proposed.
URS Corporation prepared a Categorical Exclusion (CE) comparing the roadway
alternatives and with their permission we are providing some of the pertinent information
form this document. Please note that the CE is still in its draft form and has not been
submitted to any regulatory agency.
Selected text from the CE prepared by URS:

phase. This alternative provided the best horizontal connection between NC 55 and
Green Level to Durham Road considering the adjacent roadway network and expected
development along with environmental constraints. The route was designed to minimize

the valuable natural systems located in the study area. This alternative fulfills all needs
expressed for the Extension.
A. Study Alternatives Considered
Initial planning studies for the proposed action occurred over a 12-month period
beginning in January 2004. Coordination between NCDOT, TOC officials and staff,
and their consultant resulted in the development of three alternatives (A, B and
Q. Two (2) Public Information Workshops held for local citizens in June and
September 2oo4, resulted in modifications to the original alternatives and the
addition of a fourth alternative (D). The four alternatives are shown on Exhibit 3
and described below.
Alternative A (Northern Alternative) - Alternative A consists of a new
location roadway extending westward from the existing terminus at SR
1617 (Carpenter Upchurch Road), crossing over CSX rail and NC 55 with an
at-grade intersection, extending parallel to and south of Wackena Road to
just north of Twyla Road, then heading south to intersect Green Level to
Durham Road at Green Level Church Road. This alternative had a total
length of 2.34 miles.
Alternative B (Middle Alternative) - Alternative B begins at the same point
as Alternative A; however, this alternative extends southward to intersect
at a midway point on Twyla Road before extending to the same terminus
with Green Level to Durham Road at Green Level Church Road. This
alternative has a length of 2.24 miles.
Alternative C (Southern Alternative) - Alternative C begins at the same
point as Alternatives A and B; however, this alternative extends further to
the south. The alternative utilizes part of existing Green Hope School
Road, beginning in the area of Highcroft subdivision and Friars Frontier
Road, before extending to the same terminus with Green Level to Durham
Road at Green Level Church Road. This alternative has a length of 2.36
miles.
Alternative D - (Upgrade Existing Green Hope School Road) - Alternative
D is not proposed as a new location roadway but as an upgrade of existing
facilities, specifically SR 1621 Green Hope School Road. Alternative D
would upgrade the roadway to a four-lane, median divided cross section
with partially controlled access. The length of this alternative is 2.19 miles.

B. Preferred Alternative
A/temative Bwas chosen as the Preferred Alternative to carry forward to the
design phase. This alternative provided the best horizontal connection
between NC 55 and Green Level to Durham Road considering the adjacent
roadway network and expected development along with environmental
constraints. The route was designed to minimize impacts to the properties
located along Twyla Road with a perpendicular crossing, avoided properties
located along Green Level School Road, and minimized impacts to the

valuable natural systems located in the study area. This alternative fulfills all
needs expressed for the Extension.
Altemative A was dropped from consideration due to having more potential
impacts to the residents along the south side of Wackena Drive and the
largest potential impacts to important surface water systems; including
wetlands, streams, and riparian buffers.
Alternative Cwas dropped from consideration as it did not meet an important
aspect of the purpose and need for the Extension, adding a new east-west
connection. In addition, by utilizing a portion of Green Level School Road
human environment impacts would be greater for this alternative in the area
of the proposed interchange due to loss of connectivity for some residents.
Altemative Dwas dropped from consideration due to the expected impacts to
existing neighborhoods located along Green Level School Road, estimated as
right-of-way takings from 44 properties and 13 potential relocations. Issues
with connectivity and access would also occur due to the proposed facility
being partially access controlled. In addition, this alternative did not provide
an additional east-west connection for the local area.
Based on the information presented above, we believe that this should satisfy DWQ's request
for additional information and allow the project to move forward. In summary, alternative B
was chosen as the preferred alignment because it minimized the overall impacts to wetlands
and waters and minimized impacts to the existing residents.
Please feel free to call if you have questions or require additional information.

(6) Impacts were calculated using GIS data layers and have not been field verified.
(7) Costs were calculated using standard costs per mile for the roadway portion of the
alternatives (R/W costs not included).
B. Preferred Alternative
Alternative B was chosen as the Preferred Alternative to carry forward to the
design phase.
O Page 4 September 6, 2006
Altemative A was dropped from consideration due to having more potential
impacts to the residents along the south side of Wackena Drive and the
largest potential impacts to important surface water systems; including
wetlands, streams, and riparian buffers.
Alternative Cwas dropped from consideration as it did not meet an important
aspect of the purpose and need for the Extension, adding a new east-west
connection. In addition, by utilizing a portion of Green Level School Road
human environment impacts would be greater for this alternative in the area
of the proposed interchange due to loss of connectivity for some residents.
Alternative Dwas dropped from consideration due to the expected impacts to
existing neighborhoods located along Green Level School Road, estimated as
right-of-way takings from 44 properties and 13 potential relocations. Issues
with connectivity and access would also occur due to the proposed facility
being partially access controlled. In addition, this alternative did not provide
an additional east-west connection for the local area.
Based on the information presented above, we believe that this should satisfy DW(Ts request
for additional information.
Please feel free to call if you have questions or require additional information.
Sincerely,
WITHERS & RAVENEL, INC.

Dear Ms. Karoly,
.? -'

AUG 0 3 Z006
?'.I r:Z CSI\!j.rti
We received your request for additional information on dated July 25, 20o6, regarding the
proposed impacts associated with the construction of Greystone Subdivision. Additionally, I
spoke with Mr. Ian McMillan of your office regarding this project to clarify what items are needed
to keep this project moving forward. I have included a detailed accounting of the percent
impervious on this site and I believe this should satisfy your request regarding the percent
impervious. I have also included a brief response to each of your requests below. Your letter asks
forthe following information:
1) Please provide cross section details showing provisions for aquatic life passage.
We included a profile of the culvert crossing with our initial submittal, but are providing an
additional diagram showing the culvert end view. The base of the culvert will be buried 1.3
feetbelowthe invert ofthe existingstreambed in orderto facilitate aquatic life passage.
2) Please provide details on the proposed road eastward from the intersection from the
intersection of Green Level to Durham Road and Green Level Church Road. Please clearly
discuss and provide plans indicating where the road terminates and what type and size
road you are proposing.
M/I Homes will onlybe responsible for constructing a 2-lane section ofMorrisville Parkway
from MR-1 to the eastern property line as needed to serve 5F6 and as shown on the overall
wetlands impact map. The roadway section will consist of26' ofasphalt with concrete curb &
gutter on each side with y-11'grassed shoulders. In areas of the stream crossings, 2:1 slopes
will be used to minimize channel impacts. This will be the lastphase of Greystone and
development ofSF 6 and extension ofthe 2-lane section is not expected to begin unti12008
orlater. Atpresent the road is needed to serve the subdivision and will terminate at the
property line.
Please note that Morrisville Parkway will ultimately be a 4-1ane median divided section
through Greystone; however, since 4 lanes are not warranted at this time for the Greystone
development, only2 lanes will be permitted and constructed by A411 Homes. The Town ofCary
will be responsible for constructing the other2 lanes in the future once these additional lanes
are warranted.

Additionally, site meetings were conducted with the USACEin orderto ascertain whetherthe
proposed alignment meets the avoidance and minimization criteria. Based on these
meetings it was determined that the current alignment minimizes impacts to the maximum
extent possible. Moreover, the applicant has agreed to re-vegetate the base of the drained
pond with woodyplantmatenal in orderto facilitate the conversion of emergent wetlands to a
forested wetland system.
3) You referred to a future phase (SF-6) for which impacts will be proposed at a later date.
For recordkeeping purposes, please advise of the names to be associated with the
portions of the Greystone subdivision in the current submittal.
The overall site plan has been revised to include the phase names for each portion of the
project and is included with the attachments.
4) Please provide calculations for the percent imperviousness within the entire subdivision
as well as the multipurpose portion of this project.
The proposed impervious forthe entire subdivision is 25.1 % and the impervious for the multi-
family portion of the project is 22 %. A detailed accounting of the impervious area is included
on the overall site plan. Please note, because the impervious surface for this project is less
than 3091o, rve do not believe that a stormwater management plan should be required by
DWQ.
5) The topographic map included with the application is illegible. Please provide a legible
version of this map.
A legible map is included with the attachments.
Please feel free to call if you have questions or require additional information.

Re: Greystone Subdivision
404/4o1 Request
W&R Project Number - 205228.0
DWQ Project Number - 03-330
Dear Mr. Matthews and Ms. Karoly,
On behalf of M/I Homes, we are requesting authorization from the USACE to use
NWP's 12 and 39 and 401-certification from the NC-DWQ for the installation of
roadways and lot fill associated with construction of the proposed Greystone
Subdivision.
Project Location
The proposed subdivision is approximately 177 acres in size and is located in Cary, at
the intersection of Green Level to Durham Road (SR 1625) and Green Level Church
Road (SR 16oo) (see attached USGS Quadrangle). The site is located in the Cape
Fear River Basin and contains un-named tributaries to Panther Creek. The Hydrologic
Unit Code for this basin is 03030004. The Water Quality classification is WS-IV;
NSW, stream index 16-41-1-17-3.
Project History
A wetland delineation was conducted by Soil and Environmental Consultants and
site visits were conducted by the USACE to review the delineation. On February 1o,
2oo6, a pre-application meeting was held with the USACE and the NC-DWQ to
discuss permitting issues associated with the proposed Green Level to Durham Road
Improvements, located next to the proposed Greystone Subdivision. During this
meeting, it was decided that the `Green Level to Durham' road improvements had
independent utility (i.e. are a stand-alone project) and could be permitted as a Town
of Cary Project, with M/I Homes listed as the co-applicant. Therefore, the roadway
impacts should not be considered cumulatively with the adjacent development.

Proposed Impacts
The current request is for 136 linear feet of perennial stream channel impact and
0.27 acres jurisdictional wetland impact. An additional 138 linear feet of stream
channel and o.119 acres of wetlands will be temporarily impacted for the installation
of a sewer line. A detailed accounting of the wetland and stream impacts is
provided below as well as in the attached PCN tables.

Avoidance and Minimization
Prior to site plan development the applicant requested that a detailed delineation be
conducted so that wetland and stream channel impacts could be avoided to the
maximum extent possible. In fact, of the 4 acres of wetlands on-site, the applicant
proposes only 0.27 acres of impact and intends to preserve the remaining wetlands
through deed restrictions. I have included comments from the project engineer on
the need for road crossing Rs. Road crossing Rs is needed in order to provide
necessary access within the development in accordance with local ordinance
requirements as well as national fire code requirements. This road will serve
approximately 9o single-family lots and 34 molt-family units and a second access
point is needed for the amount of trips that will be generated. Note that this is the
only stream crossing proposed for the internal development, as we were able
to provide access to far most eastern and western tracts without additional stream
crossings. Also note that we were concerned with proposing another access point
from the single-family portion onto Green Level to Durham since NCDOT has asked us
to reduce the number of access points onto Green Level to Durham Road and
Morrisville Parkway especially near the intersection. Lastly, it would be impractical
to make a roadway connection from the single-family portion onto Green Level to
Durham Road due to the grade difference.
Stormwater Management Plan
The overall percent impervious for this site is less than 30%, therefore we do not
believe that a stormwater management plan should be required for this project. The
applicant will comply with the Town of Cary stormwater requirements and provide
the appropriate BMP devices to preserve downstream water quality. Additionally,
the multifamily portion of this project is also below 30% impervious, however; the
stormwater plans have not been finalized. If the NC-DWQ requires a stormwater
management plan for this phase, we are asking the permit be issued with a
condition that construction will not begin this area until the final stormwater plans
are reviewed and approved by the NC-DWQ.
Mitigation
Because the impacts to perennial channels are less than 150 linear feet, we do not
believe that mitigation should be required for stream impacts. In order to satisfy
mitigation requirements for the wetland impacts the applicant proposes preservation
of the remaining wetlands on site or payment to the NC-EEP. We have requested an
acceptance letter from the NC-EEP and will forward this to your office as soon as it is
received.
Please feel free to call if you have questions or require additional information.
Sincerely,
WITHERS &-R AVENEL, INC.

2006, a pre-application meeting was held with the USACE and the NC-DWQ to discuss
permittin,Q issues associated with the proposed Green Level to Durham Road improvements,
located next to Greystone S/D. During this meeting, it was decided that the proposed `Green
Level to Durham' road improvements had independent utility (i.e. are a stand-alone project and
could be permitted as a Town of Cary Project, with M/I Homes listed as the co-applicant.
Therefore, the roadway impacts should not be considered cumulatively with the adjacent
development.
V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.
Additional impacts will be needed to construct an access road that will serve phase SF-6.
However, construction drawings have not been completed for this portion of the project.
VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
Page 5 of 9
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts. Prior to site plan development
the applicant requested that a detailed delineation be conducted so that wetland and stream
channel impacts could be avoided to the maximum extent possible. In fact, of the 4 acres of
wetlands on-site, the applicant proposes only 0.27 acres of impact and intends to preserve the
remaining wetlands through deed restrictions. Below ore comments from the project engineer
that explain the purpose and need for road crossing RI. Road crossing RI is needed in order to
provide necessary access within the development in accordance with local ordinance
requirements as well as national fire code requirements. This road will serve approximately 90
single-family lots and 34 molt-family units and a second access point is needed for the amount of
trips that will be generated. Note that this is the only stream crossing proposed for the internal
development as we were able to provide access to far most eastern and western tracts
without additional stream crossings. Also note that we were concerned with proposing another
access point from the single-family portion onto Green Level to Durham since NCDOT has
asked us to reduce the number of access points onto Green Level to Durham Road and
Morrisville Parkway especially near the intersection. Lastly, it would impractical to make a
roadway connection from the single-family portion onto Green Level to Durham Road due to
the grade, difference.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic enviromnent are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://12o.enr.state.nc.us/ncwetiands/strmgide.litm1.
I. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Because the impacts exceed 0.1 acres of wetlands the applicant proposes preservation of
the remaining 4 acres of wetlands on-site or payment to the NC-EEP to satisfy mitigation
requirements. We have forwarded a copy of our request to NC-EEP for their review and
approval.
2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement
Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at
(919) 715-0476 to determine availability, and written approval from the NCEEP indicating
that they are will to accept payment for the mitigation must be attached to this form. For
additional information regarding the application process for the NCEEP, check the NCEEP
website at http://112o.enr.state.ne.us/wrp/index.litm. If use of the NCEEP is proposed, please
check the appropriate box on page five and provide the following information:
Amount of stream mitigation requested (linear feet): NA
Amount of buffer mitigation requested (square feet): NA
Amount of Riparian wetland mitigation requested (acres): 0.27 - 1 acre (if required)
Amount of Non-riparian wetland mitigation requested (acres): NA
Amount of Coastal wetland mitigation requested (acres): NA
IX. Environmental Documentation (required by DWQ)
1. Does the project involve an expenditure of public (federal/state/local) funds or the use of
public (federal/state) land? Yes ? No
2. If yes, does the project require preparation of an environmental document pursuant to the
requirements of the National or North Carolina Environmental Policy Act (NEPA/SEPA)?
Note: If you are not sure whether a NEPA/SEPA document is required, call the SEPA
coordinator at (919) 733-5083 to review current thresholds for environmental documentation.
Yes ? No ?
If yes, has the document review been finalized by the State Clearinghouse? If so, please
attach a copy of the NEPA or SEPA final approval letter. Yes ? No ?
X. Proposed Impacts on Riparian and Watershed Buffers (required by DWQ)
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
required state and local buffers associated with the project. The applicant must also provide
Page 7 of 9
justification for these impacts in Section VII above. All proposed impacts must be listed herein,
and must be clearly identifiable on the accompanying site plan. All buffers must be shown on a
map, whether or not impacts are proposed to the buffers. Correspondence from the DWQ
Regional Office may be included as appropriate. Photographs may also be included at the
applicant's discretion.
1. Will the project impact protected riparian buffers identified within 15A NCAC 2B .0233

2B .0250 (Randleman Rules and Water Supply Buffer Requirements), or other (please
identify )? Yes ? No
If "yes", identify the square feet and acreage of impact to each zone of the riparian buffers.
If buffer mitigation is required calculate the required amount of mitigation by applying the
buffer multipliers.
Zone* Impact
(square feet) Multiplier Required
Mitigation
1 NA 3 (2 for Catalvba) NA
2 NA 1.5 NA
Total NA NA
* Zone 1 extends out 30 feet perpendicular from the top of the near bank of channel; Zone 2 extends an
additional 20 feet from the edge of Zone 1.
XI.
XII.
If buffer mitigation is required, please discuss what type of mitigation is proposed (i.e.,
Donation of Property, Riparian Buffer Restoration / Enhancement, or Payment into the
Riparian Buffer Restoration Fund). Please attach all appropriate information as identified
within 15A NCAC 2B .0242 or .0244, or .0260. NA
Storinwater (required by DWQ)
Describe impervious acreage (existing and proposed) versus total acreage on the site. Discuss stormwater
controls proposed in order to protect surface waters and wetlands downstream from the property. If
percent impervious surface exceeds 20%, please provide calculations demonstrating total proposed
impervious. The overall percent impervious for this site is less than 30%, therefore we do not
believe that a stormwater mana_ement plan should be required for this project. The applicant
will comply with the Town of Cary stormwater requirements and provide the appropriate BMP
devices to preserve downstream water quality. Additionally, the multifamily portion of this
project is also below 30% impervious, however; the stormwater plans have not been finalized. If
the NC-DWQ requires a stormwater management plan for this phase, we are asking the permit be
issued with a condition that construction will not begin this area until the final stormwater plans
are reviewed and approved by the NC-DW
Sewage Disposal (required by DWQ)
Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of
wastewater generated from the proposed project, or available capacity of the subject facility.
Sanitary Sewer
XIII. Violations (required by DWQ)
Is this site in violation of DWQ Wetland Rules (15A NCAC 2H.0500) or any Buffer Rules?
Yes ? No
Is this an after-the-fact permit application? Yes ? No
XIV. Cumulative Impacts (required by DWQ)
Will this project (based on past and reasonably anticipated future impacts) result in additional
development, which could impact nearby downstream water quality? Yes ? No
If yes, please submit a qualitative or quantitative cumulative impact analysis in accordance with
the most recent North Carolina Division of Water Quality policy posted on our website at
http://h2o.enr.state.nc.us/newetlands. If no, please provide a short narrative description: A
majority of the area has already been developed therefore, we do not believe that this project will
degrade downstream water quality. During construction the applicant will employ
appropriate BMP devices in order to protect downstream water quality. In addition, the applicant
will be comply with the Town of Cary Stormwater requirements as well as DWQ requirement, in
an effort to protect water quality.
XV. Other Circumstances (Optional):
It is the applicant's responsibility to submit the application sufficiently in advance of desired
construction dates to allow processing time for these permits. However, an applicant may
choose to list constraints associated with construction or sequencing that may impose limits on
work schedules (e.g., draw-down schedules for lakes, dates associated with Endangered and
Threatened Species, accessibility problems, or other issues outside of the applicant's control).

Re: Request forAdditional information - Greystone Subdivision
W&R Project #: 2040365
DWQ Project #: 06-1160
Dear Ms. Karoly,
We received your request for additional information on dated July 25, 2oo6, regarding the
proposed impacts associated with the construction of Greystone Subdivision.
Your letter asks
for the following information:
1) Please provide cross section details showing provisions for aquatic life passage.
We included a profile of the culvert crossing with our initial submittal, but are providing an
additional diagram showing the culvert end-view. The base of the culvert will be buried 1.3
feetbelowthe invert ofthe existing streambed in orderto facilitate aquatic life passage.
2) Please provide details on the proposed road eastward from the intersection from the
intersection of Green Level to Durham Road and Green Level Church Road. Please clearly
discuss and provide plans indicating where the road terminates and what type and size
road you are proposing.
M/l Homes will onlybe responsible for constructing a 2-lane section ofMorrisville Parkway
from MR-1 to the eastern property line as needed to serve 5F6 and as shown on the overall
wetlands impact map. The roadway section will consist Of 26' of asphalt with concrete curb &
gutter on each side withg-11'grassed shoulders. In areas of the stream crossings, 2:1 slopes
will be used to minimize channel impacts. This will be the lastphase of Greystone and
development of 5F-6 and extension of the 2-lane section is not expected to begin until 2008
orlater. At present the road is needed to serve the subdivision and will terminate at the
property line.
Please note that Morrisville Parkway will ultimately be a 4-lane median divided section
through Greystone; however, since 4 lanes are not warranted at this time for the Greystone
development, only2 lanes will be permitted and constructed byM/I Homes. The Town of Cary
will be responsible for constructing the other2 lanes in the future once these additional lanes
are warranted.

Additionally, site meetings were conducted with the USA CE in order to ascertain whether the
proposed alignment meets the avoidance and minimization criteria. Based on these
meetings it was determined that the current alignment minimizes impacts to the maximum
extent possible. Moreover, the applicant has agreed to re-vegetate the base of the drained
pond with woodyplantmaterial in orderto facilitate the conversion of emergent wetlands to a
forested wetland system.
The proposed impervious for the entire subdivision is 25.1 % and the impervious for the multi-
family portion of the project is 22%. A detailed accounting of the impervious area is included
on the overall site plan. Please note, because the impervious surface for this project is less
than 305'o, we do not believe that a stormwater management plan should be required by
DWQ.
5) The topographic map included with the application is illegible. Please provide a legible
version of this map.
A legible map is included with the attachments.
Please feel free to call if you have questions or require additional information.

Re: Greystone Subdivision
404/4o1 Request
W&R Project Number- 205228.0
DWQ Project Number - 03-330
Dear Mr. Matthews and Ms. Karoly,
On behalf of M/I Homes, we are requesting authorization from the USACE to use
NWP's 12 and 39 and 401-certifi cation from the NC-DWQ for the installation of
roadways and lot fill associated with construction of the proposed Greystone
Subdivision.
Project Location
The proposed subdivision is approximately 177 acres in size and is located in Cary, at
the intersection of Green Level to Durham Road (SR 1625) and Green Level Church
Road (SR 1600) (see attached USGS Quadrangle). The site is located in the Cape
Fear River Basin and contains un-named tributaries to Panther Creek. The Hydrologic
Unit Code for this basin is o3030004. The Water Quality classification is WS-IV;
NSW, stream index 16-41-1-17-3.
Project History
A wetland delineation was conducted by Soil and Environmental Consultants and
site visits were conducted by the USACE to review the delineation. On February 10,
2006, a pre-application meeting was held with the USACE and the NC-DWQ to
discuss permitting issues associated with the proposed Green Level to Durham Road
Improvements, located next to the proposed Greystone Subdivision. During this
meeting, it was decided that the 'Green Level to Durham' road improvements had
independent utility (i.e. are a stand-alone project) and could be permitted as a Town
of Cary Project, with M/I Homes listed as the co-applicant.

I have included comments from the project engineer on
the need for road crossing R1. Road crossing R1 is needed in order to provide
necessary access within the development in accordance with local ordinance
requirements as well as national fire code requirements.
The
applicant will comply with the Town of Cary stormwater requirements and provide
the appropriate BMP devices to preserve dom water quality. Additionally,
the multifamily portion of this project is als below 30% impervious, however; the
stormwater plans have not been finalized. If the NC-DWQ requires a stormwater
management plan for this phase, we are asking the permit be issued with a
condition that construction will not begin this area until the final stormwater plans
are reviewed and approved by the NC-DWQ.
Mitigation
Because the impacts to perennial channels are less than 15o linear feet, we do not
believe that mitigation should be required for stream impacts.
Sincerely,
WITHERS &RAVENEL, INC.

Open Water Impact (acres): 0.0
Total Impact to Waters of the U.S. (acres) 0.402
Total Stream Impact (linear feet): 274
6. Isolated Waters
Do any isolated waters exist on the property? ® Yes ? No
Describe all impacts to isolated waters, and include the type of water (wetland or stream) and
the size of the proposed impact (acres or linear feet). Please note that this section only
applies to waters that have specifically been determined to be isolated by the USACE.
No innnacts Proposed
7. Pond Creation
If construction of a pond is proposed, associated wetland and stream impacts should be
included above in the wetland and stream impact sections. Also, the proposed pond should
be described here and illustrated on any maps included with this application.
Pond to be created in (check all that apply): ? uplands ? stream ? wetlands
Describe the method of construction (e.g., dain/embanktnent, excavation, installation of
draw-down valve or spillway, etc.): NA
Proposed use or purpose of pond (e.g., livestock watering, irrigation, aesthetic, trout pond,
local stormwater requirement, etc.): NA
Current land use in the vicinity of the pond: NA
Size of watershed draining to pond: NA Expected pond surface area: NA
In fact, of the 4 acres of
wetlands on-site the applicant proposes only 0.27 acres of impact and intends to preserve the
e
r
remaining wetlands through deed restrictions. Below ore comments from the project engine
that explain the purpose and need for road crossing R1.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 21-1 .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed.
Draft Technical Guide for Stream Work in North Carolina, available at
httn:/ih2o.enr.state.ne.us/ncwetlands/strmgide.html.
Because the impacts exceed 0.1 acres of wetlands the applicant proposes preservation of
the remaininp, 4 acres of wetlands on-site or payment to the NC-EEP to satisfy mitigation
requirements. We have forwarded a copy of our request to NC-EEP for their review and
approval.
2. Mitigation inay also be made by payment into the North Carolina Ecosystem Enhancement
Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at
(919) 715-0176 to determine availability, and written approval from the NCEEP indicating
that they are will to accept payment for the mitigation must be attached to this form. For
additional information regarding the application process for the NCEEP, check the NCEEP
website at http://li2o.enr.state.nc.us/wrp/index.litm. If use of the NCEEP is proposed, please
check the appropriate box on page five and provide the following information:
Amount of stream mitigation requested (linear feet): NA
Amount of buffer mitigation requested (square feet): NA
Amount of Riparian wetland mitigation requested (acres): 0.27 - 1 acre (if required)
Amount of Non-riparian wetland mitigation requested (acres): NA
Amount of Coastal wetland mitigation requested (acres): NA
IX. Environmental Documentation (required by DWQ)
Does the project involve an expenditure of public (federal/state/local) funds or the use of
public (federal/state) land? Yes ? No
2. If yes, does the project require preparation of an enviromnental document pursuant to the
requirements of the National or North Carolina Environmental Policy Act (NEPA/SEPA)?
Note: If you are not sure whether a NEPA/SEPA document is required, call the SEPA
coordinator at (919) 733-5083 to review current thresholds for environmental documentation.
Yes ? No ?

Stormwater (required by DWQ)
Describe impervious acreage (existing and proposed) versus total acreage on the site. Discuss stormwater
controls proposed in order to protect surface waters and wetlands downstream from the property. If
percent impervious surface exceeds 20%, please provide calculations demonstrating total proposed
impervious. The overall percent impervious for this site is less than 30%, therefore we do not
believe that a stortwater management plan should be required for this project.

XIII. Violations (required by DWQ)
Is this site in violation of DWQ Wetland Rules (15A NCAC 2H .0500) or any Buffer Rules?
Yes ? No
Is this an after-the-fact permit application? Yes ? No
XIV. Cumulative Impacts (required by DWQ)
Will this project (based on past and reasonably anticipated future impacts) result in additional
development, which could impact nearby downstream water quality? Yes ? No
If yes, please submit a qualitative or quantitative cumulative impact analysis in accordance with
the most recent North Carolina Division of Water Quality policy posted on our website at
littp://h2o.enr.state.nc.us/ncwetlands. If no, please provide a short narrative description: A
majority of the area has already been developed therefore, we do not believe that this project will
degrade downstream water quality. During constriction the applicant will employ
appropriate BMP devices in order to protect downstream water quality.
