On November 09, 2017, the Division of Water Resources (DWR) received your application dated
November 3, 2016, requesting a Buffer Authorization from the Division for the subject project.
However, this project will require the issuance of a 401 Water Quality Certification and a Buffer
Authorization. For this type of approval, the following items are needed for DWR staff to
conduct a review:
1. The US Army Corps of Engineers has determined that the proposed work will be covered
or require a 404 Permit Nationwide 13. For activities under a Nationwide 13 and in the
Tar -Pam River Basin, DWR requires that a 401 Water Quality General Certification # 4134
be issued.
2. DWR requires 3 copies of a complete Pre -Construction Notification (PCN) Form with the
appropriate fee to begin the review and approval process. Please visit
https://deg.nc.gov/401-wetlands-buffer-permits/401-application-forms-help-documents for
application and fee structure information. Note that if the total impacts are 150 linear
feet or greater, then the required fee will be $570. Please the application and fee to:
Karen Higgins, DWR 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh,
NC 27699-1617.
3. Please include plan details of each of the impact areas.
a. Be sure to include Please submit your site plans on full plan sheets at a scale of no
smaller than 1" = 50' with topographic contours shown.
b. Please enumerate stream and all riparian buffer impacts on the site plan and
clearly label the impacts clearly showing Zone 1 and Zone 2 of the buffer.
c. Please enumerate any impacts above and below the top of bank or below the
normal water level or rooted herbaceous vegetation. Please be sure to indicate all

permanent impacts and any temporary impacts such as construction corridors on
the plan.
d. Please include details of the impact areas including plan and profile views.
4. Please provide photographs of the areas to demonstrate that stabilization is needed.
5. Please provide a CD, flash drive, or email of full size plans so they can be uploaded into
our database.
Pursuant to Title 15A NCAC 02H .0502(e) the applicant shall furnish the above requested
information for the proper consideration of the application. Please be aware that you have no
authorization under Section 401 of the Clean Water Act or the Riparian Buffer Rules for this
activity and any work done may be a violation of North Carolina General Statutes and
Administrative Code.
