Salisbury Street Wake Forest, North Carolina 27587 Raleigh, North Carolina 27604 RE: Center Street Station NWP 29 Pre -Construction Notification Application 1100 Center Street, Apex, Wake County, North Carolina Dear Mr. Lastinger and Ms. Higgins: On behalf of Capital Properties of Raleigh II, LLC, we are requesting authorization from the USACE to use NWP 29 for 0.056 acres of permanent non -isolated, jurisdictional wetland impacts for fill/grading for roadway, infrastructure and stormwater conveyance for the proposed residential development, Center Street Station. We are also requesting a 401 WQC from the NC Department of Environmental Quality for the above referenced impacts. Center Street Station is a 7.43 acre, proposed residential development with 45 townhome units and associated infrastructure (e.g., road infrastructure, utilities and stormwater). The project is located at 1100 Center Street, Apex, Wake County (Latitude: 35.7275-N Longitude:-78.8358oW). The project is in the Middle Creek Watershed in the Neuse River Basin. The Water Quality Classification for Middle Creek is C; NSW. James Lastinger, USACE, visited the site with Timmons Group environmental staff to confirm the delineation. The delineated jurisdictional areas included a forested wetland. Cheng Zhang, DWR, visited the site with Timmons Group environmental staff October 28th, 2016 to make a surface water buffer determination, included with this submittal is the surface water buffer determination letter (NBRRO#16-348). The proposed project impacts consist of 0.056 acres of permanent non -isolated wetland impact. The impacts are required for fill/grading for roadway, infrastructure and stormwater conveyance. Mitigation is not anticipated for the permanent non -isolated wetland impacts. A request for a "No Practical Alternatives" Determination has been submitted to the Town of Apex for the required buffer impacts necessary to install a conveyance pipe and rip -rap dissipator pad that will discharge stormwater from the constructed wetland proposed for the residential development. Proposed buffer impacts total 1,429 ft2; hence, mitigation is not anticipated for the permanent stream buffer impacts. Please refer to attached PCN, supporting materials and plans for details describing the proposed impacts.
