On behalf of the City of Raleigh, Kimley-Horn is submitting the attached application for authorization
under Nationwide Permit (NWP) 12 for the above referenced project. The project proposes to
upgrade the existing, aging, and undersized sewer line currently servicing the North Hills area in
Raleigh in order to accommodate anticipated existing demand while reducing risk of overflows and
failures in Wake County.
Kimley-Horn staff delineated the project study area on August 2, 2017 and identified two perennial
streams (S1 and S2). Andy Neal of NCDWR issued a Buffer Determination Letter for the project on
August 31, 2017 (RRO #17-293). A Preliminary Jurisdictional Determination request has been
included as part of this application.
Where feasible, the new sewer line will be located within the existing sewer easement. Temporary
impacts will result to Stream S1 and its buffer zones to allow for construction access. Permanent
impacts will occur to Stream S1 due to open -cut trench installation of the utility line and permanent
riprap stabilization at the crossing location. Additionally, permanent impacts will occur to the buffer
zones of Stream S1 in order to replace and maintain the sewer line and easement. Compensatory
mitigation credits for permanent impacts to Buffer Zone 1 occurring due to new easement
construction have been reserved through Resource Environmental Solutions, LLC (RES).

Land use in the vicinity of the project area is urbanized development with a combination of mixed-use commercial
development, high-density residential housing, and patches of natural bottomland forest along Crabtree Creek. The
project corridor follows an unnamed tributary to Crabtree Creek and is bounded on both sides by residential housing.

3d. Explain the purpose of the proposed project:
The North Hills area of Raleigh has experienced a significant increase in commercial and resiential development that
exceeds the capacity of the existing sewer line. The proposed project will upgrade the existing, aging, and undersized
sewer line currently servicing the North Hills area in order to accommodate the growing demand while reducing risk of
overflows and failures.

Describe the overall project in detail, including the type of equipment to be used:
The project proposes to replace the existing 8" gravity sewer line connecting the North Hills area to the Crabtree Creek
interceptor with a 12" gravity sewer line. The project will stay within the existing 20' utility easement where feasible;
however, site constraints and design will require occassional deviation from the existing easement. In certain areas, the
limits of distrubance have been widened by 10' to allow for temporary construction access via a temporary construction
easement (TCE). In addition, staging areas will be strategically situated along the corridor, increasing the width of the
TCE in those areas. Upon completion of the project, the TCE will be revegetated to pre-existing conditions. The existing
20' utility easement varies from maintained (herbaceous cover) to infrequently maintained (tree cover), but after
completion of the project, all of the prior existing utility easement and new easement will be maintained as herbaceous
cover. Construction equipment including backhoe loaders, excavators, dump trucks, bulldozers, and other equipment
typical of utility projects will be utilized during construction of the proposed project.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
This project was designed to avoid and minimize impacts to jurisdictional features to the extent possible. Whenever feasible,
the proposed project was designed within the existing 20' maintenance easement in order to limit the amount of new impacts
to riparian buffer zones. All temporary construction easements were limited to 10' and will be revegetated upon project
completion. The single stream crossing within the proposed project will be buried to a depth greater than 2' below the
substrate.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Construction activities and staging will be located outside of the riparian buffer zones and jurisdictional features where ever
possible. Any temporary dewatering or pump -around areas necessary for construction will be protected with filter fabric, which
will be removed upon completion of the project. Stream banks at the stream crossing will be stabilized with rip -rap, which will
be keyed into the bank. Standard Best Management Practices (BMPs) and techniques will be used throughout the
construction process to avoid unnecessary or secondary impacts to the jurisdictional features within the project area.

The project will not result in any additional development. The project is upsizing an undersized sewer line in order to meet
the current needs in the North Hills area of Raleigh.

According to the NC Natural Heritage Program Element Occurrence Database (updated October 2017), no known
occurrences of any federally threatened or endangered species are present in or within 1.0 mile of the project area.
Suitable habitat is not present within the project area for red -cockaded woodpecker. The natural areas observed within
the project corridor have a canopy dominated by a mix of pine and hardwood trees and a dense understory of hardwood
species.
Suitable habitat for dwarf wedgemussel is also not present within the project corridor. The stream in the project area is
impacted by runoff and sedimentation, and the stream is fragmented by natural (bedrock) and man-made (sewer pipe,
perched culverts) barriers that prevent the migration of fish through the channel. Further, the stream drains to Crabtree
Creek which is a 303(d) listed stream for a degraded benthic community and for PCB fish tissue advisory.
Suitable habitat for Michaux's sumac is not present within the study corridor. The easements running the length of the
corridor are infrequently maintained, shaded, and overgrown with Japanese stilt grass.
There is suitable roosting habitat for northern long-eared bat within the project corridor, however there are no known
hibernacula sites or known maternity roosts within 1.0 mile of the project corridor. Due to the lack of known hibernacula or
maternity roosts, and the lack of known occurrrences within 1.0 mile of the study area, the proposed project will have no
effect on northern long-eared bat.

The SHPO HPOWEB GIS Service was accessed August 30, 2017 to review historical properties located within the vicinity
of the project. 17 National Register or Study List sites were found to occur within 1.0 mile of the project boundary. One
Study List individual entry (the William S. Ward House) is located adjacent to the project limits of disturbance, and a
portion of the property the House sits on would be bisected by the proposed easement. This property is also bisected by
the existing easement. The next closest National Register or Study List site is greater than 0.25 -mile from the project
boundary. Due to the existing use of the easement, the adjacency to residencies, and the minimal visual impact resulting
from undergound utility lines, it is anticipated that the proposed project will have no effect on any histroical or
archaeological resources.

Riparian Buffer Mitigation Credits from one of the following banks, EBX-Neuse I, LLC Neuse
Riparian Buffer Umbrella Mitigation Bank or EBX Upper Neuse Riparian Buffer Umbrella Mitigation
Bank. Specific bank sites that may be debited are Arrington Bridge I, Arrington Bridge II, Buffalo
Branch, Selma Mill, Cedar Grove, Hatley, and Ezell, all located in HUC 03020201. As the official Bank
Sponsor, EBX-Neuse I, LLC and EBX, attests to the fact that mitigation is available for reservation at this
time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the

A Preliminary Jurisdictional Determination (PJD) provides an indication that there may
be "waters of the United States" or "navigable waters of the United States"on a property.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a PJD constitutes agreement that all aquatic resources in the
review area affected in any way by that activity will be treated as jurisdictional, and
waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
that there "may be" waters of the U.S. and/or that there "may be" navigable waters of
the U.S. on the subject review area, and identifies all aquatic features in the review
area that could be affected by the proposed activity, based on the following
