Arendell Avenue Zebulon, NC 27597 Dear Mr. Corbett: You have our approval, in accordance with the attached conditions and those listed below. to fill 0.06 acres of wetlands and impact the associated riparian buffers in Wake County for the purpose of commercial construction, as you described in your application received by the Division of Water Quality on January 19, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3287 and 3288. This certification allows you to use Nationwide Permit Number 39 and 12 when the Corps of Engineers issues them. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150E of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Dear Mr. Tugwell and Mr. Dorney, Soil & Environmental Consultants (S&EC) is submitting on behalf of Zip Developers, Inc. a Pre- Construction Application (PCN) for proposed impacts to wetlands ("waters of the U. S.") and Neuse River Riparian Buffers located Nvitlun the subject property. The approximately 60-acre property is located adjacent to the north of Gannon Avenue (N.C. 97) and south of the Highway 64/264 Interchange, Zcbulon, Wake County, North Carolina. A USGS topographic map and Wake County soil map depicting the limits of the property boundary have been enclosed. The proposed wetland impacts will result from the installation of two individual road crossings (wetland crossings) and an 8-inch sanitary sewer line. No stream channel impacts are proposed. The proposed road crossings will complete a previously graded extension of North Industrial Drive. The sanitary sewer line will provide sewer service by extending the existing service located north of N.C. 97. The sewer line crossing of the stream channel will be elevated utilizing concrete priers resulting i 0 linear feet of impact. The permanent sewer line right-of-way will consist of a 20-foot wide corridor with a temporary -foot wide construction corridor, totaling a maximum 40-foot wide clearing zone located within the Fvetland/Neuse Buffer area. Total wetland impacts resulting from (2) road crossings utilizing Nationwide 39, and the installation of an 8-inch sanitary sewwer line utilizing Nationwide 12 will be 0.057 acres. The site consists of three individual stream channels that area subject to the Ncuse Riparian Buffer Rule. These features were detennincd by S&EC to meet the minimum stream criteria required for buffered surface waters and subsequently confirmed by Mr. Steve Mitchell of the N.C. Division of Water Quality (see enclosed buffer confirmation letter). Work proposed on-site that will impact the buffer is limited to the elevated sewer line crossing of the unnamed tributary of Moccasin Creek (sec Impact 3 Figure). S&EC believes that impacts have been minimized and avoided to the greatest extent practical in order to provide road access and sewer service to the property. Total riparian buffer impacts consist of 0.05 total acres (Zone 1 and 2). The total riparian impact for each channel is below the 1/3-acre and will be limited to a maximum of 40 feet. Per the Neuse River Riparian RulS, the proposed non-electric utility lines are exempt from regulation because the crossings are crpendicular'and will disturb up to 40 linear feet of buffer. S&EC believes that minimization and a-M ad nce of` ie re airing natural features should be adequate mitigation for the USACE. Installation of an elevated 8-inch sewer line. The sewer line will be elevated utilizing 6'x3' support piers and 6 piers will result be located within the wetland area. Approximately 0.004 acres of wetland will be temporarily excavated for the purpose of installing the sewer line below grade. Proposed activities will be completed utilizing typical contraction techniques and mechanical equipment i.e. graders, trackhoes, etc. 13. Purpose of proposed work: Installation of an 8-inch gravity fed sewer line and 2 individual road crossings. 14. State reasons why it is believed that this activity must be carried out in wetlands (include any measures taken to minimize wetland impacts): Currently sewer service is not available on-site, therefore, the nearest service will be extented to accept the additional service area. The sewer line was aliened in such a way to minimize wetland and stream impacts while achieving functionality. The perennial channel will not be excavated or temporarily impacted because the sewer line will be elevated and the pier supports will avoid impacting the stream channel The road crossings will occur within a previously graded roadbed that was not completed. The culvert installations will result in a minimal wetland impact. 15. You are required to contact the U.S. Fish and Wildlife Service (USFWS) and/or National Marine Fisheries Service (NMFS) (see agency addresses sheet) regarding the presence of any federally listed or proposed for listing endangered or threatened species or critical habitat in the permit area that may be affected by the proposed project. The proposed road crossings will complete a previously graded extension of North Industrial Drive. The sanitary sewer line will provide sewer service by extending the existing service located north of N.C. 97. The sewer line crossing of the stream channel will be elevated utilizing concrete priers resulting in 0 linear feet of impact. The permanent sewer line right-of-way will consist of a 20-foot wide corridor with a temporary 20-foot wide construction corridor, totaling a maximum 40-foot wide clearing zone located within the wctland/Neuse Buffer area. Total wetland impacts resulting from (2) road crossings utilizing Nationwide 39, and the installation of an 8-inch sanitary sewer line utilizing Nationwide 12 will be 0.057 acres. The site consists of three individual stream channels that area subject to the Neuse Riparian Buffer Rule. These features were determined by S&EC to meet the minimum stream criteria required for buffered surface waters and subsequently confirmed by Mr. Steve Mitchell of the N.C. Division of Water Quality (see enclosed buffer confirmation letter). Work proposed on-site that will impact the buffer is limited to the elevated se«,er line crossing of the unnamed tributary of Moccasin Creek (see Impact 3 Figure).
