Dear Mr. Slaughter:
Reference the Department of the Army permit issued to the North Carolina Department of
Transportation (NCDOT) on January 7, 2015, to authorize the discharge of fill rnaterial into
waters of the United States, for construction of TIP R-2915, 5ection A- E of the widening of US
Highway 221 from US 421 to US 221 Business/NC 88, in Watauga and Ashe Counties, Noi�th
Carolina, and the subsequent modification dated August 31, 2016. Also, please reference your
November 20, 2017 email, requesting modification of the permit to authorize an increase
(1,725 s fl in the size of the southern temporary construction access causeway under the old bridge
crossing the South Fork New River.
The increased impacts are necessary because of the condition of the old bridge, NCDOT
has concerns about sections of the old bridge falling into the river as pieces are cut. The expanded
causeway would catch those sections if they fall. This is a parallel impact to the causeway on the
other side from a linear foot perspective but will be a larger area of temporary impact than shovtm
in the fmal plans. The causeways will not extend mare than halfway across the river at any one
time.
We have reviewed the requested modification, and have determined that it is appropriate
and reasonable, and, since it is minimal, does not require public notice. Therefore, the permit is
hereby modified to include the requested change, as shown in the annotated drawing (attached)
with the November 20, 2017 email, for a net increase in temporary stream impacts of 1,725 square
feet (no increase in stream length impacted). No additional compensatory mitigation is required
for this modification.
All other conditions of the permit, including the pernut expuation date of
Decernber 31, 2019, and the previous mitigation requirements, remain applicable.
