Bridge No. 82 on NC 47 over Lick Creek, Class C, Davidson County, NC,
WBS Project No.: 17BP.9.R.73
Dear Mr. Lastinger,
We are requesting a Nationwide 14 permit for replacement of three-span Bridge No. 82 with a two-
span bridge on NC 47 over Lick Creek (Class C) in Davidson County. I have attached a pre-
construction notiiication application, vicinity and topographical map with the project area called
out, a No Survey Required form for Historic Architecture', and a'No Archaeological sites are
present or Affected' form for Archeology, and a Mitigation Acceptance Letter from NC Division of
Mitigation Services (NCDMS). Also attached are the Permit Drawings including a Stormwater
Management Plan. The project will permanently impact 2361inear feet (Lick Creek: 82' bank
stabilization; Intermittent UT to Lick Creek upstream of NC 47: 112' stream relocation/54" pipe
extension; UT downstream of NC 47: 32' S4" pipe extension, 10' bank stabilization) and 0.03
acres of wetlands due to roadway iill. The project will temporarily impact 241inear feet (Lick
Creek: 10' temporary dewatering/waterline installation; UT upstream of NC 47: 7' temporary
dewatering; UT downstream of NC 47: 7' temporary dewatering). Impacts to UT to Lick Creek
were separated up and downstream of NC 47 due to the differing stream quality classifications.
NCSAM forms showed a low quality stream upstream of the pipe, so 1:1 mitigation is being
proposed for the 112' of impacts upstream of the existing road, and 2:1 mitigation is being
proposed downstream of the existing road. NCSAM forms are attached for reference. The existing
54" pipe is steeper than 2% and is not buried — the proposed extension is not proposed to be buried
either.
The USFWS lists Schweinitz's sunflower (Helianthus schweinitzii) as endangered and Northern
Long-Eared bat (NLEB-Myotis septentrionalis) as threatened for Davidson County. Due to habitat
in the project area for Schweinitz's sunflower a survey was conducted on September 20, 2016. No
individuals were located. Therefore, it was determined that there will be `no effect' on
Schweinitz's Sunflower. We determined that the project'May Affect but is Not Likely to
Adversely Affect' the NLEB. Anticipated tree clearing impacts for this project are estimated to be

0.3 acres. A NLEB Screening checklist is attached. Thus, for the proposed action, NCDOT has
committed to the conservation measures listed below:
1. No alterations of a known hibernaculum's entrance or interior environment if it impairs an
essential behavioral pattern, including sheltering Northern long-eared bats (January 1
through December 31);
2. No tree removal within a 0.25 mile radius of a known hibernacula (January 1 through
December 31); and
3. No cutting or destroying a known, occupied maternity roost tree, or any other trees within a
150-foot radius from the known, occupied maternity tree during the period from June 1
through and including July 31.
NCDOT has deternuned that the proposed action does not require separate consultation on the
grounds that the proposed action is consistent with the final Section 4(d) rule, codified at 50 C.F.R.
§ 17.40(0) and effective February 16, 2016. Section 7 responsibilities are therefore considered
fulfilled.
By copy of this letter, we also request 401 review and approval from the NC Division of Water
Resources with one copy of the application package provided to Amy Chapman, Transportation
Permitting Unit Supervisor, and Dave Wanucha, DOT Project Coordinator. Please charge the
application fee of $270 to WBS Project No. 17BP.9.R.73.
