SUBJECT: Consistency Certification Submission Status for Proposed Impacts to Wetlands to
Facilitate the Expansion of a Limestone Mining Operation, Pender County
(DCM#20080142)
Dear Ms. Lutheran:
We received the cor: istency certification of Southern Environmental Group, Inc. on behalf of Shelter
Creek Quarry, LLC "Applicant") on October 22, 2008 for proposed impacts to 46.92 acres of
wetlands and 721in, :.ir feet of stream to facilitate expansion of the limestone mining operation at an
approximate 397.7 ,re tract. The project site is approximately 11 miles east northeast of Burgaw and
4 miles west southu ,st of Maple Hill in Pender County, North Carolina.
The Division of Cor ;tal Management does not typically issue a consistency concurrence decision until
the Applicant has of ained all other required State permits and/or permissions and submitted copies of
them to DCM. Sinc;; the Applicant has yet to obtain these approvals, DCM will be unable to issue
either a letter of "concurrence" or "objection" by January 22, 2009.
Based on the requirements of 15 CFR 930.62, DCM has until April 22, 2009 to either concur or object
to the consistency certification unless an extension agreement is obtained. Upon the receipt of the
required State approvals, we will make every effort possible to complete our review before the
deadline. Thank you for your consideration of the North Carolina Coastal Management Program.
